حَدَّثَنَا الْحَسَنُ بْنُ مُوسَى قَالَ حَدَّثَنَا شَيْبَانُ عَنْ يَحْيَى قَالَ أَخْبَرَنِي أَبُو سَلَمَةَ أَنَّ أَبَا هُرَيْرَةَ أَخْبَرَهُ
أَنَّ خُزَاعَةَ قَتَلُوا رَجُلًا مِنْ بَنِي لَيْثٍ عَامَ فَتْحِ مَكَّةَ بِقَتِيلٍ مِنْهُمْ قَتَلُوهُ، فَأُخْبِرَ بِذَلِكَ رَسُولُ اللهِ ﷺ فَرَكِبَ رَاحِلَتَهُ فَخَطَبَ فَقَالَ: إِنَّ اللهَ حَبَسَ عَنْ مَكَّةَ الْفِيلَ وَسَلَّطَ عَلَيْهَا رَسُولَهُ وَالْمُؤْمِنِينَ، أَلَا وَإِنَّهَا لَمْ تَحِلَّ لِأَحَدٍ كَانَ قَبْلِي وَلَا تَحِلُّ لِأَحَدٍ كَانَ بَعْدِي أَلَا وَإِنَّهَا أُحِلَّتْ لِي سَاعَةً مِنَ النَّهَارِ، أَلَا وَإِنَّهَا سَاعَتِي هَذِهِ حَرَامٌ، لَا يُخْتَلَى شَوْكُهَا وَلَا يُعْضَدُ شَجَرُهَا، وَلَا يَلْتَقِطُ سَاقِطَتَهَا إِلَّا مُنْشِدٌ، وَمَنْ قُتِلَ لَهُ قَتِيلٌ فَهُوَ بِخَيْرِ النَّظَرَيْنِ: إِمَّا أَنْ يَقْتُلَ وَإِمَّا أَنْ يُفَادِيَ أَهْلَ الْقَتِيلِ. قَالَ: فَجَاءَ رَجُلٌ يُقَالُ لَهُ: أَبُو شَاهٍ فَقَالَ: اكْتُبْ لِي يَا رَسُولَ اللهِ، قَالَ: اكْتُبُوا لِأَبِي شَاهٍ، فَقَالَ رَجُلٌ مِنْ قُرَيْشٍ: إِلَّا الْإِذْخِرَ يَا رَسُولَ اللهِ، فَإِنَّا نَجْعَلُهُ فِي بُيُوتِنَا وَقُبُورِنَا، فَقَالَ رَسُولُ اللهِ ﷺ: إِلَّا الْإِذْخِرَ

Khuzāʿah killed a man from Banū Layth in the year of the conquest of Mecca, in retaliation for one of their own whom he had killed. The Messenger of Allah ﷺ was informed of that, so he mounted his riding camel and delivered a sermon. He said: "Indeed Allah restrained the elephant from Mecca and gave His Messenger and the believers power over it. Behold, it was not made lawful for anyone before me, and it will not be lawful for anyone after me. Behold, it was made lawful for me for an hour of the day. Behold, in this very hour of mine it is sacred: its thorns are not to be cut, its trees are not to be felled, and its fallen items are not to be picked up except by one who announces them. Whoever has a relative killed has the better of two options: either he kills, or he accepts ransom from the family of the slain." He said: Then a man called Abū Shāh came and said: "Write for me, O Messenger of Allah." He said: "Write for Abū Shāh." Then a man from Quraysh said: "Except the idhkhir, O Messenger of Allah, for we use it in our houses and our graves." So the Messenger of Allah ﷺ said: "Except the idhkhir."
