Genealogy of Our Prophet Muhammad ﷺ and Some Accounts of His Forefathers and Ancestors

Translation

✧ The affair of ʿĀmir b. Ẓarib b. ʿAmr b. ʿIyādh b. Yashkur b. ʿAdwān [His judgment concerning a hermaphrodite and the counsel of his slave girl Sukhayla] Ibn Isḥāq said: And his saying “a wise one who judges” means ʿĀmir b. Ẓarib b. ʿAmr b. ʿIyādh b. Yashkur b. ʿAdwān al-ʿAdwānī. The Arabs had no dispute or knotty problem in a judgment but that they referred it to him and then accepted what he decided in it. A case was brought before him in one of the matters over which they used to differ, concerning a hermaphrodite man, who had what belongs to a man and what belongs to a woman. They said: Will you make him a man or a woman? And they did not bring him any matter more knotty than it. He said: Wait until I look into your affair, for by God, nothing like this from you has befallen me, O assembly of the Arabs. So they withdrew from him. He spent his night sleepless, turning over his affair and examining his situation, no solution presenting itself to him in it. He had a slave girl called Sukhayla who pastured his sheep for him, and he used to reproach her when she set out in the morning, saying: By God, you have delayed the morning, O Sukhayl, and when she returned in the evening he said: By God, you have delayed the evening, O Sukhayl. That was because she used to delay the morning pasturing until some of the people preceded her, and delay the evening return until some preceded her. When she saw his sleeplessness and his little rest upon his bed, she said: What is with you, may you have no father? What has come upon you this night of yours? He said: Woe to you, leave me; it is a matter not of your concern. Then she returned to him with the like of her words. He said to himself: Perhaps she will bring relief from what I am in. He said: Woe to you, a case was brought before me concerning the inheritance of a hermaphrodite—shall I make him a man or a woman? By God, I do not know what to do, and no solution presents itself to me in it. He said: She said: Glory be to God, may you have no father! Follow the decisive indication of urination. Seat him, for if he urinates from where a man urinates, then he is a man; and if he urinates from where a woman urinates, then she is a woman. He said: Delay the evening after it, O Sukhayl, or delay the morning—by God, you have relieved it. Then he went out to the people when morning came and judged according to what she had counseled him.
