Translation

✧ Several events In the year two hundred and eighty-three, in Shawwāl, died ʿAlī b. Muḥammad b. Abī al-Shawārib the judge. His tenure of the judgeship of Madīnat al-Manṣūr had lasted six months. In it, in Ramaḍān, ʿAmr b. al-Layth al-Ṣaffār and Rāfiʿ b. Harthama fought one another, and Rāfiʿ was defeated. The reason for that was that ʿAmr left Naysābūr, and Rāfiʿ went against him to it, seized it, and the khuṭba was delivered in it in the name of Muḥammad b. Zayd al-ʿAlawī. Then ʿAmr returned from Marw to Naysābūr and besieged it, and Rāfiʿ was defeated from it. ʿAmr sent an army in pursuit of him, and they overtook him at Ṭūs. He fled from them to Khuwārizm, and they overtook him there, killed him, and sent his head to al-Muʿtaḍid. It reached him in the year two hundred and eighty-four in Muḥarram, and he ordered it to be set up in Baghdādh and bestowed a robe of honor on the messenger who brought it. In it al-Muʿtaḍid wrote to the horizons, ordering that what remained over after the shares of the Qurʾānic heirs, when there were no ʿaṣaba, be returned to the dhū al-arḥām. That was based on the legal opinion of Abū Ḥāzim the judge. In his legal opinion he said: This is the consensus of the Companions, except Zayd b. Thābit, who alone held that what remained over in this situation should be returned to the bayt al-māl. ʿAlī b. Muḥammad b. Abī al-Shawārib concurred with Abū Ḥāzim. The judge Yūsuf b. Yaʿqūb gave a legal opinion in accordance with the statement of Zayd, but al-Muʿtaḍid paid no attention to him and gave effect to the legal opinion of Abū Ḥāzim. Along with this, he appointed the judge Yūsuf b. Yaʿqūb to the judgeship of the eastern side and bestowed on him splendid robes of honor as well. He entrusted Abū Ḥāzim with the judgeship of many places, and likewise Ibn Abī al-Shawārib, and bestowed on him splendid robes of honor as well.
