ذِكْرُ مَنْ تُوُفِّيَ فِي هَذِهِ السَّنَةِ مِنَ الْأَكَابِرِ 1195 - إِسْمَاعِيلُ بْنُ حَمَّادِ بْنِ أَبِي حَنِيفَةَ، يُكَنَّى أَبَا حَيَّانَ، وَقِيلَ: أَبَا عَبْدِ اللَّهِ . حَدَّثَ عَنْ أَبِيهِ، وَعَنْ مَالِكِ بْنِ مِغْوَلٍ وَعَنْهُمَا، وَكَانَ فَقِيهًا عَلَى مَذْهَبِ جَدِّهِ، وَتَوَلَّى قَضَاءَ الرَّصَافَةِ سَنَةَ أَرْبَعٍ وَتِسْعِينَ بَعْدَ مُحَمَّدِ بْنِ عَبْدِ اللَّهِ الْأَنْصَارِيِّ، فَأَقَامَ مُدَّةً ثُمَّ انْصَرَفَ، وَوَلِيَ قَضَاءَ الْبَصْرَةِ سَنَةَ عَشْرٍ وَمِائَتَيْنِ لَمَّا عُزِلَ عَنْهُ يَحْيَى بْنُ أَكْثَمَ، وَأَقَامَ بِهِ سَنَةً، ثُمَّ عُزِلَ بِعِيسَى بْنِ أَبَانَ. قَالَ أَبُو عَبْدِ اللَّهِ مُحَمَّدُ بْنُ الْقَاسِمِ: لَمَّا عُزِلَ إِسْمَاعِيلُ بْنُ حَمَّادٍ عَنِ الْبَصْرَةِ شَيَّعُوهُ فَقَالُوا: عَفَفْتَ عَنْ أَمْوَالِنَا وَعَنْ دِمَائِنَا. فَقَالَ: وَعَنْ أَبْنَائِكُمْ! يُعَرِّضُ بِيَحْيَى بْنِ أَكْثَمَ [فِي اللِّوَاطِ]. قَالَ إِسْمَاعِيلُ بْنُ حَمَّادِ بْنِ أَبِي حَنِيفَةَ: مَا وَرَدَ عَلَيَّ مِثْلُ امْرَأَةٍ تَقَدَّمَتْ إِلَيَّ فَقَالَتْ: أَيُّهَا الْقَاضِي، ابْنُ عَمِّي زَوَّجَنِي مِنْ هَذَا وَلَمْ أُعْلَمْ، فَلَمَّا أُعْلِمْتُ رَدَدْتُ، فَقُلْتُ لَهَا: وَمَتَى رَدَدْتِ؟ قَالَتْ: وَقْتَ عَلِمْتُ، قُلْتُ: وَمَتَى عَلِمْتِ؟ قَالَتْ: وَقْتَ رَدَدْتُ. فَمَا رَأَيْتُ مِثْلَهَا. عَنْ سَعِيدِ بْنِ مُوسَى الْبَاهِلِيِّ قَالَ: سَمِعْتُ إِسْمَاعِيلَ بْنَ حَمَّادِ بْنِ أَبِي حَنِيفَةَ فِي دَارِ الْمَأْمُونِ يَقُولُ: الْقُرْآنُ مَخْلُوقٌ وَهُوَ دِينِي وَدِينُ أَبِي وَجَدِّي. تُوُفِّيَ [إِسْمَاعِيلُ] فِي هَذِهِ السَّنَةِ. 1196 - خَلَفُ بْنُ الْوَلِيدِ، أَبُو جَعْفَرٍ الْجَوْهَرِيُّ. سَمِعَ ابْنَ أَبِي ذِئْبٍ، وَشُعْبَةَ، وَهُشَيْمًا. وَرَوَى عَنْهُ: أَحْمَدُ بْنُ حَنْبَلٍ، وَانْتَقَلَ إِلَى مَكَّةَ فَنَزَلَهَا. قَالَ يَحْيَى بْنُ مَعِينٍ: هُوَ ثِقَةٌ . تُوُفِّيَ فِي هَذِهِ السَّنَةِ.
Translation
✧ Mention of the notable figures who died in this year 1195 - Ismāʿīl b. Ḥammād b. Abī Ḥanīfah, whose kunyah was Abū Ḥayyān; some said: Abū ʿAbd Allāh. He narrated from his father and from Mālik b. Mighwal. He was a jurist according to the school of his grandfather. He assumed the judiciary of al-Ruṣāfah in the year 194 after Muḥammad b. ʿAbd Allāh al-Anṣārī, and he remained for a period, then he departed. He assumed the judiciary of al-Baṣrah in the year 210 when Yaḥyā b. Aktham was dismissed from it, and he remained in it for a year, then he was dismissed in favor of ʿĪsā b. Abān. Abū ʿAbd Allāh Muḥammad b. al-Qāsim said: When Ismāʿīl b. Ḥammād was dismissed from al-Baṣrah, they escorted him and said: "You were abstinent with regard to our wealth and our blood." He replied: "And with regard to your sons!" — alluding to Yaḥyā b. Aktham [concerning sodomy]. Ismāʿīl b. Ḥammād b. Abī Ḥanīfah said: I never encountered anything like a woman who came before me and said: "O judge, my paternal cousin married me to this man without my knowledge; when I learned of it, I rejected it." I said to her: "And when did you reject it?" She said: "At the time I learned of it." I said: "And when did you learn of it?" She said: "At the time I rejected it." I have never seen anyone like her. From Saʿīd b. Mūsā al-Bāhilī, who said: I heard Ismāʿīl b. Ḥammād b. Abī Ḥanīfah in the palace of al-Maʾmūn say: "The Qurʾān is created, and this is my religion and the religion of my father and my grandfather." [Ismāʿīl] died in this year. 1196 - Khalaf b. al-Walīd, Abū Jaʿfar al-Jawharī. He heard Ibn Abī Dhiʾb, Shuʿbah, and Hushaym. Aḥmad b. Ḥanbal narrated from him. He moved to Makkah and settled there. Yaḥyā b. Maʿīn said: He is trustworthy. He died in this year.
