ذِكْرُ مَنْ تُوُفِّيَ فِي هَذِهِ السَّنَةِ مِنَ الْأَكَابِرِ   1071 - بَقِيَّةُ بْنُ الْوَلِيدِ بْنِ صَائِدِ بْنِ كَعْبٍ، أَبُو مُحَمَّدٍ الْكُلَّاعِيُّ الْبَصْرِيُّ  . وُلِدَ سَنَةَ عَشْرٍ وَمِائَةٍ، وَسَمِعَ مِنْ خَلْقٍ كَثِيرٍ. وَرَوَى عَنْهُ: شُعْبَةُ، وَحَمَّادُ بْنُ زَيْدٍ، وَابْنُ الْمُبَارَكِ، وَيَزِيدُ بْنُ هَارُونَ. وَفِي أَحَادِيثِهِ مَنَاكِيرُ، إِلَّا أَنَّ أَكْثَرَهَا عَنِ الْمَجَاهِيلِ. قَالَ ابْنُ الْمُبَارَكِ: كَانَ ثِقَةً صَدُوقًا، لَكِنَّهُ كَانَ يَكْتُبُ عَنْ مَنْ أَقْبَلَ وَأَدْبَرَ. وَقَالَ يَعْقُوبُ بْنُ شَيْبَةَ: ثِقَةٌ صَدُوقٌ [وَيُتَّقَى حَدِيثُهُ عَنْ مَشْيَخَتِهِ الَّذِينَ لَا يَعْرِفُونَ، وَلَهُ أَحَادِيثُ مَنَاكِيرُ جِدًّا. تُوُفِّيَ بَقِيَّةُ فِي هَذِهِ السَّنَةِ. وَقِيلَ: فِي سَنَةِ سَبْعٍ وَتِسْعِينَ وَمِائَةٍ. 1072 - حَفْصُ بْنُ غِيَاثِ بْنِ طَلْقٍ، أَبُو عُمَرَ الْكُوفِيُّ  . سَمِعَ عُبَيْدَ اللَّهِ بْنَ عُمَرَ الْعُمَرِيَّ، وَهِشَامَ بْنَ عُرْوَةَ، وَإِسْمَاعِيلَ بْنَ أَبِي خَالِدٍ، وَأَبَا إِسْحَاقَ الشَّيْبَانِيَّ، وَسُلَيْمَانَ الْأَعْمَشَ، وَجَعْفَرَ بْنَ مُحَمَّدِ بْنِ عَلِيٍّ، وَلَيْثَ بْنَ أَبِي سُلَيْمٍ، وَدَاوُدَ بْنَ أَبِي هِنْدٍ، وَالْحَسَنَ بْنَ عَبْدِ اللَّهِ، وَأَشْعَثَ بْنَ عَبْدِ الْمَلِكِ، وَأَشْعَثَ بْنَ سِوَارٍ، وَابْنَ جُرَيْجٍ، وَمِسْعَرَ بْنَ كَدَامٍ، وَالثَّوْرِيَّ. رَوَى عَنْهُ: ابْنُهُ عُمَرُ، وَأَبُو نُعَيْمٍ الْفَضْلُ بْنُ دُكَيْنٍ، وَعَفَّانُ بْنُ مُسْلِمٍ، وَأَحْمَدُ بْنُ حَنْبَلٍ، وَابْنُ مَعِينٍ، وَابْنُ الْمَدَنِيِّ، وَأَبُو خَيْثَمَةَ، وَالْحَسَنُ بْنُ عَرَفَةَ، وَابْنُ رَاهَوَيْهِ، وَعَامَّةُ الْكُوفِيِّينَ. وَوَلِيَ حَفْصٌ الْقَضَاءَ بِبَغْدَادَ وَحَدَّثَ بِهَا، ثُمَّ عُزِلَ وَوَلِيَ قَضَاءَ الْكُوفَةِ. قَالَ يَحْيَى بْنُ اللَّيْثِ: بَاعَ رَجُلٌ مِنْ أَهْلِ خُرَاسَانَ جِمَالًا بِثَلَاثِينَ أَلْفِ دِرْهَمٍ مِنْ مَرْزُبَانَ الْمَجُوسِيِّ وَكَيْلِ أُمِّ جَعْفَرٍ فَمَطَلَهُ بِثَمَنِهَا وَحَبَسَهُ، فَطَالَ ذَلِكَ عَلَى الرَّجُلِ، فَأَتَى بَعْضُ أَصْحَابِ حَفْصِ بْنِ غِيَاثٍ فَشَاوَرَهُ، فَقَالَ: اذْهَبْ إِلَيْهِ فَقُلْ لَهُ أَعْطِنِي أَلْفَ دِرْهَمٍ وَأُحِيلُ عَلَيْكَ بِالْمَالِ الْبَاقِي، وَأَخْرُجُ إِلَى خُرَاسَانَ، فَإِنْ فَعَلَ هَكَذَا فَالْقَنِي حَتَّى أُشِيرَ عَلَيْكَ. فَفَعَلَ الرَّجُلُ وَأَتَى مَرْزُبَانَ فَأَعْطَاهُ أَلْفَ دِرْهَمٍ، فَرَجَعَ إِلَى الرَّجُلِ فَأَخْبَرَهُ فَقَالَ: عُدْ إِلَيْهِ فَقُلْ لَهُ: إِذَا رَكِبْتَ غَدًا فَطَرِيقُكَ عَلَى الْقَاضِي تَحَضَّرَ وَأَوْكِلْ رَجُلًا يَقْبِضُ الْمَالَ وَاخْرُجْ، فَإِذَا جَلَسَ إِلَيَّ الْقَاضِي فَادْعُ عَلَيْهِ مَا بَقِيَ لَكَ مِنَ الْمَالِ، فَإِذَا أَقَرَّ حَبَسَهُ حَفْصٌ وَأَخَذْتُ مَالَكَ. فَرَجَعَ إِلَى مَرْزُبَانَ فَسَأَلَهُ فَقَالَ: انْتَظِرْنِي بِبَابِ الْقَاضِي. فَلَمَّا رَكِبَ مِنَ الْغَدِ وَثَبَ إِلَيْهِ الرَّجُلُ فَقَالَ: إِنْ رَأَيْتَ أَنْ تَنْزِلَ إِلَى الْقَاضِي حَتَّى أُوكِلَ بِقَبْضِ الْمَالِ وَأَخْرُجَ، فَنَزَلَ مَرْزُبَانُ فَتَقَدَّمَا إِلَى حَفْصِ بْنِ غِيَاثٍ، فَقَالَ الرَّجُلُ: أَيَّدَ اللَّهُ الْقَاضِي لِي عَلَى هَذَا الرَّجُلِ تِسْعَةٌ وَعِشْرُونَ أَلْفِ دِرْهَمٍ، فَقَالَ حَفْصٌ: مَا تَقُولُ يَا مَجُوسِيُّ ؟ قَالَ: صَدَقَ أَصْلَحَ اللَّهُ الْقَاضِي. قَالَ: مَا تَقُولُ يَا رَجُلُ، قَدْ أَقَرَّ لَكَ ؟ قَالَ يُعْطِينِي مَالِي. قَالَ حَفْصٌ لِلْمَجُوسِيِّ: مَا تَقُولُ ؟ فَقَالَ: هَذَا الْمَالُ عَلَى السَّيِّدَةِ. قَالَ: أَنْتَ أَحْمَقُ، تُقِرُّ ثُمَّ تَقُولُ عَلَى السَّيِّدَةِ، مَا تَقُولُ يَا رَجُلُ ! ؟ فَقَالَ: إِنْ أَعْطَانِي مَالِي وَإِلَّا حَبَسْتَهُ. قَالَ: مَا تَقُولُ يَا مَجُوسِيُّ ؟ قَالَ: الْمَالُ عَلَى السَّيِّدَةِ، قَالَ حَفْصٌ: خُذُوا بِيَدِهِ إِلَى الْحَبْسِ. فَلَمَّا حُبِسَ بَلَغَ الْخَبَرُ أُمَّ جَعْفَرٍ، فَغَضِبَتْ وَبَعَثَتْ إِلَى السِّنْدِيِّ وَجِّهْ إِلَيَّ مَرْزُبَانَ فَأَخْرِجْهُ، وَبُلِّغَ حَفْصٌ الْخَبَرَ فَقَالَ: أَحْبِسُ أَنَا وَيُخْرِجُ السِّنْدِيُّ ؟ لَا جَلَسْتُ مَجْلِسِي هَذَا أَوْ يُرَدُّ مَرْزُبَانُ إِلَى الْحَبْسِ. فَجَاءَ السِّنْدِيُّ إِلَى أُمِّ جَعْفَرٍ فَقَالَ: اللَّهَ اللَّهَ فِيَّ، إِنَّهُ حَفْصُ بْنُ غِيَاثٍ، وَأَخَافُ مِنْ أَمِيرِ الْمُؤْمِنِينَ أَنْ يَقُولَ لِي: بِأَمْرِ مَنْ أَخْرَجْتَهُ ؟ رُدِّيهِ إِلَى الْحَبْسِ وَأَنَا أُكَلِّمُ حَفْصًا فِي أَمْرِهِ، فَأَجَابَتْهُ فَرَجَعَ مَرْزُبَانُ إِلَى الْحَبْسِ، فَقَالَتْ أُمُّ جَعْفَرٍ لِهَارُونَ: قَاضِيكَ هَذَا أَحْمَقُ، حَبَسَ وَكِيلِي، فَمُرْهُ لَا يَنْظُرُ فِي هَذَا الْحُكْمِ، وَتُوَلِّي أَمْرَهُ إِلَى أَبِي يُوسُفَ. فَأَمَرَ لَهُ بِالْكِتَابِ، وَبَلَغَ حَفْصًا الْخَبَرُ فَقَالَ لِلرَّجُلِ: أَحْضِرْ لِي شُهُودًا حَتَّى أُسَجِّلَ لَكَ عَلَى الْمَجُوسِيِّ بِالْمَالِ فَجَلَسَ حَفْصٌ، فَسَجَّلَ عَلَى الْمَجُوسِيِّ، وَوَرَدَ كِتَابُ هَارُونَ مَعَ خَادِمٍ لَهُ، فَقَالَ: هَذَا كِتَابُ أَمِيرِ الْمُؤْمِنِينَ. فَقَالَ: انْظُرْ مَا يُقَالُ لَكَ، فَلَمَّا فَرَغَ حَفْصٌ مِنَ السِّجِلِّ أَخَذَ الْكِتَابَ مِنَ الْخَادِمِ فَقَرَأَهُ فَقَالَ: اقْرَأْ عَلَى أَمِيرِ الْمُؤْمِنِينَ السَّلَامَ وَأَخْبِرْهُ أَنَّ كِتَابَهُ وَرَدَ، وَقَدْ أُنْفِذَ الْحَكْمُ، فَقَالَ الْخَادِمُ: قَدْ وَاللَّهِ عَرَفْتُ مَا صَنَعْتَ، مَا أَرَدْتُ أَنْ تَأْخُذَ كِتَابَ أَمِيرِ الْمُؤْمِنِينَ حَتَّى تَفْرَغَ مِمَّا تُرِيدُ، وَاللَّهِ لَأُخْبِرَنَّ أَمِيرَ الْمُؤْمِنِينَ بِمَا فَعَلْتَ. فَقَالَ حَفْصٌ: قُلْ لَهُ مَا أَحْبَبْتَ. فَجَاءَ الْخَادِمُ، فَأَخْبَرَ هَارُونَ، فَضَحِكَ وَقَالَ لِلْحَاجِبِ: مُرْ لِحَفْصِ بْنِ غِيَاثٍ بِثَلَاثِينَ أَلْفِ دِرْهَمٍ. فَرَكِبَ يَحْيَى بْنُ خَالِدٍ وَاسْتَقْبَلَ حَفْصًا مُنْصَرِفًا مِنْ مَجْلِسِ الْقَضَاءِ، فَقَالَ: أَيُّهَا الْقَاضِي، قَدْ سَرَرْتَ أَمِيرَ الْمُؤْمِنِينَ الْيَوْمَ، وَأَمَرَ لَكَ بِثَلَاثِينَ أَلْفِ دِرْهَمٍ، فَمَا كَانَ السَّبَبُ فِي هَذَا ؟ قَالَ: تَمَّمَ اللَّهُ نِعَمَ أَمِيرِ الْمُؤْمِنِينَ، وَأَحْسَنَ حِفْظَهُ وَكَلَاءَتَهُ، مَا زِدْتُ عَلَى مَا أَفْعَلُ كُلَّ يَوْمٍ. قَالَ: مَا أَعْلَمُ إِلَّا أَنِّي سَجَّلْتُ عَلَى مَرْزُبَانَ الْمَجُوسِيَّ بِمَا وَجَبَ عَلَيْهِ، فَقَالَ: فَمِنْ هَذَا سُرَّ أَمِيرُ الْمُؤْمِنِينَ. قَالَ حَفْصٌ: الْحَمْدُ لِلَّهِ كَثِيرًا. فَقَالَتْ أُمُّ جَعْفَرٍ لِهَارُونَ: لَا أَنَا وَلَا أَنْتَ، إِلَّا أَنْ تَعْزِلَ حَفْصًا. فَأَبَى عَلَيْهَا، ثُمَّ أَلَحَّتْ عَلَيْهِ فَعَزَلَهُ عَنِ الشَّرْقِيَّةِ، وَوَلَّاهُ قَضَاءَ الْكُوفَةِ، فَمَكَثَ عَلَيْهَا ثَلَاثَ عَشْرَةَ سَنَةً، وَكَانَ أَبُو يُوسُفَ لَمَّا وَلِيَ حَفْصٌ قَالَ لِأَصْحَابِهِ: تَعَالَوْا نَكْتُبُ نَوَادِرَ حَفْصٍ، فَلَمَّا وَرَدَتْ أَحْكَامُهُ وَقَضَايَاهُ عَلَى أَبِي يُوسُفَ قَالَ لَهُ أَصْحَابُهُ: أَيْنَ النَّوَادِرُ الَّتِي تَكْتُبُهَا ؟ قَالَ: وَيْحَكُمْ إِنَّ حَفْصًا أَرَادَ اللَّهَ فَوَفَّقَهُ اللَّهُ. قَالَ عُمَرُ بْنُ حَفْصٍ: لَمَّا حَضَرَتْ أَبِي الْوَفَاةُ أُغْمِيَ عَلَيْهِ، فَبَكَيْتُ عِنْدَ رَأْسِهِ، فَأَفَاقَ فَقَالَ: مَا يُبْكِيكَ ؟ قُلْتُ: أَبْكِي لِفِرَاقِكِ، وَلَمَّا دَخَلْتُ فِيهِ مِنْ هَذَا الْأَمْرِ - يَعْنِي الْقَضَاءَ - قَالَ: لَا تَبْكِ، فَإِنِّي مَا حَلَلَتْ سَرَاوِيلِي عَلَى حَرَامٍ قَطُّ، وَلَا جَلَسَ بَيْنَ يَدَيْ خَصْمَانِ فَبَالِيَتْ عَلَى مَنْ تَوَجَّهَ الْحُكْمُ مِنْهَا. عَنْ حَفْصِ بْنِ غِيَاثٍ قَالَ: وَلَدَتْ أُمُّ مُحَمَّدِ بْنِ أَبِي إِسْمَاعِيلَ أَرْبَعَةَ بَنِينٍ فِي بَطْنٍ، قَالَ: فَرَأَيْتُهُمْ كُلَّهُمْ قَدْ نَيَّفُوا عَلَى الثَّمَانِينَ. قَالَ عُبَيْدُ بْنُ غَنَّامٍ: حَدَّثَنِي أَبِي قَالَ: مَرِضَ حَفْصٌ خَمْسَةَ عَشَرَ يَوْمًا فَدَفَعَ إِلَيَّ مِائَةَ دِرْهَمٍ فَقَالَ: امْضِ بِهَا إِلَى الْعَامِلِ وَقُلْ لَهُ: هَذِهِ رِزْقُ خَمْسَةَ عَشَرَ يَوْمًا لَمْ أَحْكُمْ فِيهَا بَيْنَ الْمُسْلِمِينَ لَا حَظَّ لِي فِيهَا. تُوُفِّيَ حَفْصُ بْنُ غِيَاثٍ سَنَةَ سِتٍّ وَتِسْعِينَ وَمِائَةٍ. كَذَا قَالَ الْفَلَّاسُ، وَمُحَمَّدُ بْنُ الْمُثَنَّى. وَقَالَ خَلِيفَةُ بْنُ خَيَّاطٍ، وَمُحَمَّدُ بْنُ سَعْدٍ: سَنَةَ أَرْبَعٍ وَتِسْعِينَ. وَقَالَ عُبَيْدُ اللَّهِ بْنُ الصَّبَّاحِ: سَنَةَ تِسْعٍ وَتِسْعِينَ. وَقَالَ سَلْمُ بْنُ جُنَادَةَ: سَنَةَ خَمْسٍ وَتِسْعِينَ. 1073 - عَبْدُ اللَّهِ بْنُ مَرْزُوقٍ، أَبُو مُحَمَّدٍ الزَّاهِدُ.   زَعَمَ أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ الصُّوفِيُّ أَنَّهُ كَانَ وَزِيرَ الرَّشِيدِ، فَخَرَجَ مِنْ ذَلِكَ وَتَخَلَّى مِنْ مَالِهِ وَتَزَهَّدَ، وَكَانَ كَثِيرَ الْبُكَاءِ، شَدِيدَ الْحُزْنِ. قَالَ عَبْدُ اللَّهِ بْنُ مَرْزُوقٍ: يَا سَلَامَةُ، إِنَّ لِي إِلَيْكَ حَاجَةً. قُلْتُ: وَمَا هِيَ ؟ قَالَ: تَحْمِلُنِي فَتَطْرَحُنِي عَلَى تِلْكَ الْمَزْبَلَةِ لَعَلِّي أَمُوتُ عَلَيْهَا، فَيَرَى مَكَانِي فَيَرْحَمُنِي. 1074 - مُحَمَّدُ بْنُ زِينِ بْنِ سُلَيْمٍ، أَبُو الشِّيصِ الشَّاعِرُ  . انْقَطَعَ إِلَى عُقْبَةَ بْنِ جَعْفَرِ بْنِ الْأَشْعَثِ الْخُزَاعِيُّ، وَكَانَ أَمِيرًا عَلَى الرِّقَّةِ، فَمَدَحَهُ [فِي ] أَكْثَرِ شَعْرِهِ، وَكَانَ أَبُو الشِّيصِ سَرِيعَ الْخَاطِرِ، الشِّعْرُ عَلَيْهِ أَهْوَنُ مِنْ شُرْبِ الْمَاءِ. رَوَى أَبُو بَكْرٍ الْأَنْبَارِيُّ، عَنْ أَبِيهِ، عَنْ أَحْمَدَ بْنِ عُبَيْدٍ قَالَ: اجْتَمَعَ مُسْلِمُ بْنُ الْوَلِيدِ، وَأَبُو نُوَاسٍ، وَأَبُو الشِّيصِ، وَدِعْبَلٌ فِي مَجْلِسٍ، فَقَالُوا: لِيَنْشُدْ كُلٌّ مِنْكُمْ أَجْوَدَ مَا قَالَ مِنَ الشِّعْرِ، فَقَالَ رَجُلٌ كَانَ مَعَهُمْ: اسْمَعُوا مِنِّي أُخْبِرُكُمْ بِمَا يَنْشُدُ كُلٌّ مِنْكُمْ قَبْلَ أَنْ يَنْشُدَ. قَالُوا: هَاتِ. فَقَالَ لِمُسْلِمٍ: أَمَّا أَنْتَ فَكَأَنِّي بِكَ قَدْ أَنْشَدْتَ: إِذَا مَا عَلَتْ مِنَّا ذُؤَابَةُ وَاحِدٍ وَإِنْ كَانَ ذَا حِلْمٍ دَعَتْهُ إِلَى الْجَهْلِ     هَلِ الْعَيْشُ إِلَّا أَنْ تَرُوحَ مَعَ الصَّبَى وَتَغْدُو صَرِيعَ الْكَأْسِ وَالْأَعْيُنِ النُّجْلِ قَالَ: وَبِهَذَا الْبَيْتِ لُقِّبَ بِـ"صَرِيعِ الْغَوَانِي" لَقَّبَهُ بِهِ الرَّشِيدُ. فَقَالَ لَهُ مُسْلِمٌ: صَدَقْتَ. ثُمَّ أَقْبَلَ عَلَى أَبِي نُوَاسٍ فَقَالَ لَهُ: وَكَأَنِّي بِكَ قَدْ أَنْشَدْتَ: لَا تَبْكِ لَيْلَى وَلَا تَطْرَبْ إِلَى هِنْدِ     وَاشْرَبْ عَلَى الْوَرْدِ مِنْ حَمْرَاءَ كَالْوَرْدِ تَسْقِيكَ مِنْ عَيْنِهَا خَمْرًا وَمِنْ يَدِهَا     خَمْرًا فَمَا لَكَ مِنْ سُكْرَيْنِ مِنْ بُدِّ فَقَالَ لَهُ: صَدَقْتَ. ثُمَّ أَقْبَلَ عَلَى دِعْبَلٍ فَقَالَ لَهُ: كَأَنِّي بِكَ وَقَدْ أَنْشَدْتَ: أَيْنَ الشَّبَابُ وَأَيَّةً سَلَكَا     لَا أَيْنَ يُطْلَبُ ضَلَّ بَلْ هَلَكَا لَا تَعْجَبِي يَا سَلمَ مِنْ رَجُلٍ     ضَحِكَ الْمَشِيبُ بِرَأْسِهِ فَبَكَى فَقَالَ لَهُ: صَدَقْتَ، ثُمَّ أَقْبَلَ عَلَى أَبِي الشِّيصِ فَقَالَ لَهُ: كَأَنِّي بِكَ قَدْ أَنْشَدْتَ: لَا تُنْكِرِي صَدِّي وَلَا إِعْرَاضِي     لَيْسَ الْمُقِلُّ عَنِ الزَّمَانِ بِرَاضِي فَقَالَ لَهُ: لَا، مَا أَرَدْتُ [أَنْ ] أَنْشِدَ هَذَا، وَلَيْسَ هَذَا بِأَجْوَدِ شَيْءٍ قُلْتُهُ. قَالُوا: فَأَنْشِدْنَا مَا بَدَا لَكَ. فَأَنْشَدَهُمْ: وَقَفَ الْهَوَى بِي حَيْثُ أَنْتَ فَلَيْسَ لِي     مُتَأَخِّرٌ عَنْهُ وَلَا مُتَقَدِّمُ أَجِدُ الْمَلَامَةَ فِي هَوَاكَ لَذِيذَةً     حُبًّا لِذِكْرِكَ فَلْيَلُمْنِي اللُّوَّمُ أَشْبَهْتَ أَعْدَائِي فَصِرْتُ أُحِبُّهُمْ     إِذْ كَانَ حَظِّي مِنْكَ حَظِي مِنْهُمُ وَأَهَنْتَنِي فَأَهَنْتُ نَفْسِي صَاغِرًا     يَا مَنْ أَهُونُ عَلَيْكَ مِمَّنْ أُكْرِمُ فَقَالَ أَبُو نُوَاسٍ: أَحْسَنْتَ وَاللَّهِ وَجَوَّدْتَ. وَعَمِيَ أَبُو الشِّيصِ فِي آخِرِ عُمُرِهِ. 1075 - مُعَاذُ بْنُ مُعَاذٍ، أَبُو الْمُثَنَّى الْبَصْرِيُّ الْعَنْبَرِيُّ  . وُلِدَ سَنَةَ تِسْعَ عَشْرَةَ وَمِائَةٍ، وَسَمِعَ سُلَيْمَانَ التَّيْمِيَّ، وَشُعْبَةَ، [وَ ] الثَّوْرِيَّ، وَغَيْرَهُمْ. رَوَى عَنْهُ: أَحْمَدُ بْنُ حَنْبَلٍ، وَيَحْيَى بْنُ مَعِينٍ، وَأَبُو خَيْثَمَةَ، وَغَيْرُهُمْ. وَوَلِيَ قَضَاءَ الْبَصْرَةِ، وَكَانَ مِنَ الْأَثْبَاتِ فِي الْحَدِيثِ. وَقَالَ أَحْمَدُ بْنُ حَنْبَلٍ: مَا رَأَيْتُ أَحَدًا إِلَّا وَقَدْ تَعَلَّقَ عَلَيْهِ شَيْءٌ مِنَ الْحَدِيثِ إِلَّا مُعَاذَ الْعَنْبَرِيَّ، فَإِنَّهُمْ مَا قَدَرُوا أَنْ يَتَعَلَّقُوا عَلَيْهِ فِي شَيْءٍ مِنَ الْحَدِيثِ مَعَ شُغْلِهِ بِالْقَضَاءِ. تُوفِّيَ مُعَاذٌ بِالْبَصْرَةِ فِي رَبِيعٍ الْآخَرِ مِنْ هَذِهِ السَّنَةِ، وَهُوَ ابْنُ سَبْعٍ وَسَبْعِينَ سَنَةً. 1076 - هَاشِمُ بْنُ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرِ بْنِ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرٍ الصِّدِّيقِ، يُكَنَّى: أَبَا بَكْرٍ  . مَدْبَغِيٌّ، كَانَ مِنْ سَاكِنِي الْكُوفَةِ، فَقَدِمَ قَاضِيًا عَلَى مِصْرَ مِنْ قِبَلِ الْأَمِينِ فِي جُمَادَى الْآخِرَةِ سَنَةَ أَرْبَعٍ وَتِسْعِينَ، وَكَانَ يَذْهَبُ مَذْهَبَ أَبِي حَنِيفَةَ. تُوفِّيَ فِي مُحَرَّمِ هَذِهِ السَّنَةِ.

Translation

✧ Mention of the notables who died in this year 1071 - Baqiyyah b. al-Walīd b. Ṣāʾid b. Kaʿb, Abū Muḥammad al-Kullāʿī al-Baṣrī. He was born in the year 110 AH, and he heard from many people. From him narrated: Shuʿbah, Ḥammād b. Zayd, Ibn al-Mubārak, and Yazīd b. Hārūn. In his ḥadīths there are rejected reports, except that most of them are from unknown narrators. Ibn al-Mubārak said: He was trustworthy and truthful, but he used to write from whoever came and went. Yaʿqūb b. Shaybah said: He was trustworthy and truthful, [but his ḥadīth from his shaykhs whom they do not know is to be avoided, and he has very rejected ḥadīths. Baqiyyah died in this year. It was also said: in the year 197 AH. 1072 - Ḥafṣ b. Ghiyāth b. Ṭalq, Abū ʿUmar al-Kūfī. He heard ʿUbayd Allāh b. ʿUmar al-ʿUmarī, Hishām b. ʿUrwah, Ismāʿīl b. Abī Khālid, Abū Isḥāq al-Shaybānī, Sulaymān al-Aʿmash, Jaʿfar b. Muḥammad b. ʿAlī, Layth b. Abī Sulaym, Dāwūd b. Abī Hind, al-Ḥasan b. ʿAbd Allāh, Ashʿath b. ʿAbd al-Malik, Ashʿath b. Siwār, Ibn Jurayj, Misʿar b. Kidām, and al-Thawrī. From him narrated: his son ʿUmar, Abū Nuʿaym al-Faḍl b. Dukayn, ʿAffān b. Muslim, Aḥmad b. Ḥanbal, Ibn Maʿīn, Ibn al-Madanī, Abū Khaythamah, al-Ḥasan b. ʿArafah, Ibn Rāhawayh, and the general body of the Kufans. Ḥafṣ held the judiciary in Baghdad and related ḥadīth there, then he was dismissed and held the judiciary of Kufa. Yaḥyā b. al-Layth said: A man from the people of Khurasan sold camels for thirty thousand dirhams to Marzubān the Magian, the agent of Umm Jaʿfar, and he delayed paying him their price and imprisoned him. This went on long for the man, so he came to one of the companions of Ḥafṣ b. Ghiyāth and consulted him. He said: Go to him and say to him, "Give me a thousand dirhams and I will transfer to you the remaining money, and I will go out to Khurasan." If he does that, then meet me so that I may advise you. The man did that and came to Marzubān, and he gave him a thousand dirhams. He returned to the man and told him, and he said: Go back to him and say to him, "When you ride tomorrow, your way will be past the judge; be present and appoint a man to receive the money and leave." Then when the judge sits before me, make a claim against him for the rest of the money that remains to you. If he acknowledges it, Ḥafṣ will imprison him and you will take your money. So he returned to Marzubān and asked him, and he said: Wait for me at the judge's gate. When he rode the next day, the man sprang upon him and said: If you see fit to dismount to the judge so that I may appoint someone to receive the money and leave, then Marzubān dismounted and they went before Ḥafṣ b. Ghiyāth. The man said: May God support the judge; I have a claim against this man of twenty-nine thousand dirhams. Ḥafṣ said: What do you say, O Magian? He said: He has spoken truly, may God keep the judge righteous. He said: What do you say, O man? He has acknowledged to you. He said: He should give me my money. Ḥafṣ said to the Magian: What do you say? He said: This money is owed by the Lady. He said: You are a fool; you acknowledge and then say it is owed by the Lady. What do you say, O man!? He said: If he gives me my money, fine; otherwise you will imprison him. He said: What do you say, O Magian? He said: The money is owed by the Lady. Ḥafṣ said: Take him by the hand to prison. When he was imprisoned, the news reached Umm Jaʿfar, and she became angry and sent to al-Sindī: Send Marzubān to me and release him. The news was conveyed to Ḥafṣ, and he said: I imprison and al-Sindī releases? I will not sit in this seat of mine until Marzubān is returned to prison. Al-Sindī came to Umm Jaʿfar and said: I beseech you by God, spare me; he is Ḥafṣ b. Ghiyāth, and I fear that the Commander of the Faithful will say to me: By whose command did you release him? Return him to prison and I will speak to Ḥafṣ about his affair. She consented, and Marzubān returned to prison. Umm Jaʿfar said to Hārūn: This judge of yours is a fool; he imprisoned my agent. Order him not to look into this case, and entrust the matter to Abū Yūsuf. So he ordered a letter to be written to him. The news reached Ḥafṣ, and he said to the man: Bring me witnesses so that I may record for you the debt against the Magian. Ḥafṣ sat and recorded against the Magian. The letter of Hārūn arrived with a servant of his, and the servant said: This is the letter of the Commander of the Faithful. He said: See what is said to you. When Ḥafṣ finished the record, he took the letter from the servant and read it, then said: Convey peace to the Commander of the Faithful and inform him that his letter arrived, and the judgment has already been executed. The servant said: By God, I recognized what you did; you did not want to take the letter of the Commander of the Faithful until you finished what you wanted. By God, I will inform the Commander of the Faithful of what you did. Ḥafṣ said: Tell him whatever you like. The servant came and informed Hārūn, and he laughed and said to the chamberlain: Order thirty thousand dirhams to be given to Ḥafṣ b. Ghiyāth. Yaḥyā b. Khālid rode and met Ḥafṣ as he was leaving the court session, and said: O judge, you have pleased the Commander of the Faithful today, and he has ordered thirty thousand dirhams for you. What was the reason for this? He said: May God complete the blessings of the Commander of the Faithful and grant him good protection and care; I did nothing more than what I do every day. He said: I know nothing except that I recorded against Marzubān the Magian what was due from him. He said: So it was from this that the Commander of the Faithful was pleased. Ḥafṣ said: Praise be to God abundantly. Umm Jaʿfar said to Hārūn: Neither I nor you, unless you dismiss Ḥafṣ. He refused her, then she insisted, so he dismissed him from the eastern side and appointed him judge of Kufa. He remained there for thirteen years. When Ḥafṣ was appointed, Abū Yūsuf said to his companions: Come, let us write down the curious judgments of Ḥafṣ. When his rulings and cases reached Abū Yūsuf, his companions said to him: Where are the curious judgments you were writing? He said: Woe to you; Ḥafṣ intended God, and God granted him success. ʿUmar b. Ḥafṣ said: When death came to my father, he lost consciousness, and I wept at his head. He regained consciousness and said: What makes you weep? I said: I weep for separation from you, and for what I have entered into of this matter—meaning the judiciary. He said: Do not weep, for I have never loosened my trousers for anything forbidden, nor have two litigants sat before me and I cared on which of them the judgment fell. From Ḥafṣ b. Ghiyāth, he said: The mother of Muḥammad b. Abī Ismāʿīl gave birth to four sons at once. He said: I saw all of them exceed eighty. ʿUbayd b. Ghannām said: My father narrated to me: Ḥafṣ fell ill for fifteen days and handed me a hundred dirhams, saying: Take this to the tax collector and tell him: This is the stipend of fifteen days during which I did not judge between the Muslims; I have no share in it. Ḥafṣ b. Ghiyāth died in the year 196 AH. Thus said al-Fallās and Muḥammad b. al-Muthannā. Khalīfah b. Khayyāṭ and Muḥammad b. Saʿd said: in the year 194 AH. ʿUbayd Allāh b. al-Ṣabbāḥ said: in the year 199 AH. Salm b. Junādah said: in the year 195 AH. 1073 - ʿAbd Allāh b. Marzūq, Abū Muḥammad the ascetic. Abū ʿAbd al-Raḥmān al-Sulamī the Sufi claimed that he was the vizier of al-Rashīd, then he left that, divested himself of his wealth, and became ascetic. He was given to much weeping and intense sorrow. ʿAbd Allāh b. Marzūq said: O Salāmah, I have a need from you. I said: What is it? He said: Carry me and throw me on that rubbish heap, so that I may die upon it, and He may see my place and have mercy on me. 1074 - Muḥammad b. Zayn b. Sulaym, Abū al-Shīṣ the poet. He attached himself to ʿUqbah b. Jaʿfar b. al-Ashʿath al-Khuzāʿī, who was governor of al-Raqqah, and praised him in most of his poetry. Abū al-Shīṣ was quick of mind; poetry was easier for him than drinking water. Abū Bakr al-Anbārī narrated, from his father, from Aḥmad b. ʿUbayd, who said: Muslim b. al-Walīd, Abū Nuwās, Abū al-Shīṣ, and Diʿbil gathered in a gathering, and they said: Let each of you recite the best poetry he has composed. A man who was with them said: Listen to me, and I will tell you what each of you will recite before he recites. They said: Give it. He said to Muslim: As for you, it is as if I see you reciting: When the forelock of one of us rises high, even if he possesses forbearance, it calls him to ignorance. Is life anything but to go forth with youthful passion, and to go in the morning a victim of the cup and of wide, lovely eyes. He said: And by this verse he was nicknamed "Ṣarīʿ al-Ghawānī" (the one struck down by beautiful women), a nickname given to him by al-Rashīd. Muslim said to him: You have spoken truly. Then he turned to Abū Nuwās and said to him: It is as if I see you reciting: Do not weep for Laylā, nor be stirred with longing for Hind, but drink upon the rose from a red wine like the rose. She gives you to drink from her eyes wine, and from her hand wine, so you have no escape from two intoxications. He said to him: You have spoken truly. Then he turned to Diʿbil and said to him: It is as if I see you reciting: Where is youth, and which way did it take? Do not ask where it is sought; it has gone astray, nay, it has perished. Do not wonder, O Salmā, at a man whose head gray hair laughed at, and so he wept. He said to him: You have spoken truly. Then he turned to Abū al-Shīṣ and said to him: It is as if I see you reciting: Do not deny my turning away and my aversion; the one who has little is not content with time. He said to him: No, I did not intend to recite this, and this is not the best thing I have composed. They said: Then recite to us whatever you like. So he recited to them: Passion stopped me where you are, so I have no retreat from it and no advance. I find blame in love for you delightful, out of love for your mention, so let the blamers blame me. You have come to resemble my enemies, so I have begun to love them, since my share of you is my share of them. And you humiliated me, so I humiliated myself in abasement; O you to whom I am more contemptible than those I honor. Abū Nuwās said: By God, you have done well and excelled. Abū al-Shīṣ became blind at the end of his life. 1075 - Muʿādh b. Muʿādh, Abū al-Muthannā al-Baṣrī al-ʿAnbarī. He was born in the year 119 AH, and he heard Sulaymān al-Taymī, Shuʿbah, al-Thawrī, and others. From him narrated: Aḥmad b. Ḥanbal, Yaḥyā b. Maʿīn, Abū Khaythamah, and others. He held the judiciary of Basra, and he was among the most reliable in ḥadīth. Aḥmad b. Ḥanbal said: I have not seen anyone except that something of ḥadīth was held against him, except Muʿādh al-ʿAnbarī, for they were unable to hold anything of ḥadīth against him despite his being occupied with the judiciary. Muʿādh died in Basra in Rabīʿ al-Ākhir of this year, at the age of seventy-seven. 1076 - Hāshim b. Abī Bakr b. ʿAbd al-Raḥmān b. Abī Bakr b. ʿAbd Allāh b. ʿAbd al-Raḥmān b. Abī Bakr al-Ṣiddīq, known as Abū Bakr. He was a tanner; he was one of the inhabitants of Kufa, then he came as judge over Egypt on behalf of al-Amīn in Jumādā al-Ākhirah of the year 194 AH, and he followed the school of Abū Ḥanīfah. He died in Muḥarram of this year.
