مَنْ تُوُفِّيَ فِي هَذِهِ السَّنَةِ مِنَ الْأَكَابِرِ   إِسْمَاعِيلُ بْنُ عَيَّاشِ بْنِ سُلَيْمٍ الْعَنْسِيُّ، أَبُو عُتْبَةَ إِسْمَاعِيلُ بْنُ عَيَّاشِ بْنِ سُلَيْمٍ الْعَنْسِيُّ، أَبُو عُتْبَةَ. مِنْ أَهْلِ حِمْصَ، وُلِدَ سَنَةَ اثْنَتَيْنِ وَمِائَةٍ. وَقِيلَ: سَنَةَ سِتٍّ. وَسَمِعَ مِنَ الْأَكَابِرِ مِنْ أَبِي بَكْرِ بْنِ أَبِي مَرْيَمَ، وَيَحْيَى بْنِ سَعِيدٍ الْأَنْصَارِيِّ، وَسَهْلِ بْنِ أَبِي صَالِحٍ، وَغَيْرِهِمْ. وَرَوَى عَنْهُ: الْأَعْمَشُ وَابْنُ الْمُبَارَكِ وَيَزِيدُ بْنُ هَارُونَ وَقَدِمَ بَغْدَادَ عَلَى الْمَنْصُورِ فَوَلَّاهُ خِزَانَةَ الْكُسْوَةِ، وَكَانَ يَقُولُ: وَرِثْتُ عَنْ أَبِي أَرْبَعَةَ آلَافِ دِينَارٍ فَأَنْفَقَهَا فِي طَلَبِ الْعِلْمِ. قَالَ يَحْيَى بْنُ مَعِينٍ: إِسْمَاعِيلُ ثِقَةٌ، وَالْعِرَاقِيُّونَ يَكْرَهُونَ حَدِيثَهُ. وَقَالَ الْبُخَارِيُّ: إِذَا حَدَّثَ عَنْ أَهْلِ بَلَدِهِ فَصَحِيحٌ، وَإِذَا حَدَّثَ عَنْ غَيْرِ أَهْلِ بَلَدِهِ فَفِيهِ نَظَرٌ. تُوُفِّيَ فِي هَذِهِ السَّنَةِ وَبَعْضُهُمْ يَقُولُ: فِي سَنَةِ إِحْدَى وَثَمَانِينَ. عَمَّارُ بْنُ مُحَمَّدٍ، أَبُو الْيَقْظَانِ الْكُوفِيُّ عَمَّارُ بْنُ مُحَمَّدٍ، أَبُو الْيَقْظَانِ الْكُوفِيُّ. ابْنُ أُخْتِ سُفْيَانَ الثَّوْرِيِّ، سَكَنَ بَغْدَادَ وَحَدَّثَ عَنِ الْأَعْمَشِ. رَوَى عَنْهُ: أَحْمَدُ بْنُ حَنْبَلٍ، وَالْحَسَنُ بْنُ عَرَفَةَ. وَقَدْ وَثَّقَهُ قَوْمٌ. وَقَالَ ابْنُ حِبَّانَ: كَانَ مِمَّنْ فَحُشَ خَطَؤُهُ وَكَثُرَ وَهْمُهُ فَاسْتَحَقَّ التَّرْكَ. تُوُفِّيَ فِي مُحَرَّمِ هَذِهِ السَّنَةِ. مُحَمَّدُ بْنُ أَبِي شَيْبَةَ بْنِ إِبْرَاهِيمَ بْنِ عُثْمَانَ [الْعَبْسِيُّ ] الْكُوفِيُّ مُحَمَّدُ بْنُ أَبِي شَيْبَةَ بْنِ إِبْرَاهِيمَ بْنِ عُثْمَانَ [الْعَبْسِيُّ ] الْكُوفِيُّ. وَالِدُ أَبِي بَكْرٍ وَعُثْمَانَ وَغَيْرِهِمَا. قَالَ أَبُو زَكَرِيَّا [ يَحْيَى بْنُ مَعِينٍ ] كَانَ رَجُلًا جَمِيلًا ثِقَةً كَيِّسًا، وَكَانَ عَلَى قَضَاءِ فَارِسَ، وَمَاتَ بِفَارِسَ فِي هَذِهِ السَّنَةِ وَهُوَ ابْنُ سَبْعٍ وَسَبْعِينَ سَنَةً. مُحَمَّدُ بْنُ حُمَيْدٍ، أَبُو سُفْيَانَ الْيَشْكُرِيُّ يُعْرَفُ بِالْمَعْمَرِيِّ مُحَمَّدُ بْنُ حُمَيْدٍ، أَبُو سُفْيَانَ الْيَشْكُرِيُّ يُعْرَفُ بِالْمَعْمَرِيِّ. [لَقِيَ ] مَعْمَرَ بْنَ رَاشِدٍ، وَلِرِحْلَتِهِ [إِلَيْهِ ] سُمِّيَ الْمَعْمَرِيَّ. وَسَمِعَ سُفْيَانَ الثَّوْرِيَّ وَغَيْرَهُ. وَكَانَ ثِقَةً صَدُوقًا فَاضِلًا. تُوُفِّيَ فِي هَذِهِ السَّنَةِ. مَرْوَانُ بْنُ سُلَيْمَانَ [بْنِ يَحْيَى ] بْنِ أَبِي حَفْصَةَ، أَبُو الْهَيْذَامِ مَرْوَانُ بْنُ سُلَيْمَانَ [بْنِ يَحْيَى ] بْنِ أَبِي حَفْصَةَ، أَبُو الْهَيْذَامِ. وَقِيلَ: أَبُو السِّمْطِ. وَاسْمُ أَبِي حَفْصَةَ: يَزِيدُ، وَكَانَ مِنْ سَبْيِ إِصْطَخْرَ، سُبِيَ غُلَامًا فَاشْتَرَاهُ عُثْمَانُ بْنُ عَفَّانَ، فَوَهَبَهُ لِمَرْوَانَ [بْنِ الْحَكَمِ ] فَأَعْتَقَهُ يَوْمَ الدَّارِ، لِأَنَّهُ أَبْلَى يَوْمَئِذٍ بَلَاءً حَسَنًا. وَقِيلَ: إِنَّ أَبَا حَفْصَةَ كَانَ طَبِيبًا يَهُودِيًّا أَسْلَمَ عَلَى يَدِ عُثْمَانَ بْنِ عَفَّانَ. وَقِيلَ: عَلَى يَدِ مَرْوَانَ بْنِ الْحَكَمِ. كَانَ مَرْوَانُ بْنُ سُلَيْمَانَ شَاعِرًا مُجِيدًا، وَمَدَحَ الْمَهْدِيَّ وَالرَّشِيدَ وَمَعْنَ بْنَ زَائِدَةَ. وَقَالَ الْكِسَائِيُّ: إِنَّمَا الشِّعْرُ سِقَاءٌ تَمَخَّضَ، فَدُفِعَتِ الزُّبْدَةُ إِلَى مَرْوَانَ بْنِ أَبِي حَفْصَةَ. وعن الْفَضْلُ بْنُ بَزِيعٍ قَالَ: رَأَيْتُ مَرْوَانَ بْنَ أَبِي حَفْصَةَ قَدْ دَخَلَ عَلَى الْمَهْدِيِّ بَعْدَ مَوْتِ مَعْنِ [بْنِ زَائِدَةَ ] فَمَدَحَهُ بِأَبْيَاتٍ، فَقَالَ: مَنْ أَنْتَ ؟ قَالَ: شَاعِرُكَ مَرْوَانُ بْنُ أَبِي حَفْصَةَ. فَقَالَ لَهُ: أَلَسْتَ تَقُولُ: أَقَمْنَا بِالْيَمَامَةِ بَعْدَ مَعْنٍ مَقَامًا مَا نُرِيدُ بِهِ زِيَالًا     وَقُلْنَا أَيْنَ نَرْحَلُ بَعْدَ مَعْنٍ وَقَدْ ذَهَبَ النَّوَالُ فَلَا نَوَالَا قَدْ جِئْتَ تَطْلُبُ نَوَالَنَا، وَقَدْ ذَهَبَ النَّوَالُ فَلَا شَيْءَ لَكَ عِنْدَنَا، جُرُّوا بِرِجْلِهِ. فَجُرَّ بِرِجْلِهِ حَتَّى أُخْرِجَ. فَلَمَّا كَانَ فِي الْعَامِ الْمُقْبِلِ تَلَطَّفَ حَتَّى دَخَلَ مَعَ الشُّعَرَاءِ. وَإِنَّمَا كَانَتِ الشُّعَرَاءُ تَدْخُلُ عَلَى الْخُلَفَاءِ فِي كُلِّ عَامٍ مَرَّةً، فَمَثُلَ بَيْنَ يَدَيْهِ فَأَنْشَدَهُ: طَرَقَتْكَ زَائِرَةً فَحَيِّ خَيَالَهَا إِلَى أَنْ بَلَغَ [مِنْهَا ] شَهِدَتْ مِنَ الْأَنْفَالِ آخِرُ آيَةٍ     بِتُرَاثِهِمْ فَأَرَدْتُمْ أَبْطَالَهَا فَجَعَلَ الْمَهْدِيُّ يَتَزَاحَفُ عَنْ مُصَلَّاهُ إِعْجَابًا بِقَوْلِهِ، ثُمَّ قَالَ: كَمْ هِيَ بَيْتًا ؟ قَالَ: مِائَةُ بَيْتٍ. فَأَمَرَ لَهُ بِمِائَةِ أَلْفِ دِرْهَمٍ، فَلَمَّا أَفْضَتِ الْخِلَافَةُ إِلَى الرَّشِيدِ أَنْشَدَهُ فَقَالَ: أَلَسْتَ الْقَائِلَ فِي مَعْنٍ كَذَا وَكَذَا ؟ وَذَكَرَ الْبَيْتَيْنِ، ثُمَّ أَمَرَ بِإِخْرَاجِهِ، فَتَلَطَّفَ حَتَّى عَادَ وَدَخَلَ بَعْدَ يَوْمَيْنِ، فَأَنْشَدَهُ قَصِيدَةً، فَأَمَرَ لَهُ بِعَدَدِ أَبْيَاتِهَا أُلُوفًا. وعن عَبْدُ اللَّهِ بْنُ إِسْحَاقَ بْنِ سَلَّامٍ قَالَ: خَرَجَ مَرْوَانُ مِنْ دَارِ الْمَهْدِيِّ وَمَعَهُ ثَمَانُونَ أَلْفَ دِرْهَمٍ، فَمَرَّ بِزَمِنٍ، فَسَأَلَهُ فَأَعْطَاهُ ثُلْثَيْ دِرْهَمٍ، فَقِيلَ لَهُ: هَلَّا أَعْطَيْتَهُ دِرْهَمًا ؟ فَقَالَ: لَوْ أُعْطِيتُ مِائَةَ أَلْفٍ لَأَتْمَمْتُ لَهُ دِرْهَمًا. قَالَ: وَكَانَ مَرْوَانُ يَبْخَلُ فَلَا يُسْرَجُ لَهُ فِي دَارِهِ، فَإِذَا أَرَادَ أَنْ يَنَامَ أَضَاءَتْ لَهُ الْجَارِيَةُ بِقَصَبَةٍ إِلَى أَنْ يَنَامَ. وعن عَلِيُّ بْنُ مُحَمَّدٍ النَّوْفَلِيُّ قَالَ: سَمِعْتُ أَبِي يَقُولُ: كَانَ الْمَهْدِيُّ يُعْطِي ابْنَ أَبِي حَفْصَةَ وَسَلْمًا الْخَاسِرَ عَطِيَّةً وَاحِدَةً، وَكَانَ سَلْمٌ يَأْتِي بَابَ الْمَهْدِيِّ عَلَى بِرْذَوْنٍ قِيمَتُهُ عَشْرَةُ آلَافِ دِرْهَمِ، وَلِبَاسُهُ الْخَزُّ وَالْوَشْيُ وَالطِّيبُ يَفُوحُ مِنْهُ، وَيَجِيءُ مَرْوَانُ وَعَلَيْهِ فَرْوٌ وَكْلٌ وَقَمِيصُ كَرَابِيسَ، وَكِسَاءٌ غَلِيظٌ، وَكَانَ لَا يَأْكُلُ اللَّحْمَ بُخْلًا حَتَّى يُقَدَّمَ إِلَيْهِ، فَإِذَا قُدِّمَ [إِلَيْهِ ] أَرْسَلَ غُلَامَهُ فَاشْتَرَى لَهُ رَأْسًا فَأَكَلَهُ، فَقِيلَ لَهُ: نَرَاكَ لَا تَأْكُلُ إِلَّا الرُّءُوسَ. فَقَالَ: الرَّأْسُ أَعْرِفُ شَعْرَهُ فَآمَنُ خِيَانَةَ الْغُلَامِ، وَلَيْسَ بِلَحْمٍ يَطْبُخُهُ الْغُلَامُ فَيَقْدِرُ أَنْ يَأْكُلَ مِنْهُ، وَآكُلُ مِنْهُ أَلْوَانًا: آكُلُ عَيْنَيْهِ لَوْنًا، وَأُذُنَيْهِ لَوْنًا، وَغَلْصَمَتَهُ لَوْنًا، وَدِمَاغَهُ لَوْنًا، وَأُكْفَى مَئُونَةَ طَبْخِهِ، فَقَدِ اجْتَمَعَتْ لِي فِيهِ مَرَافِقُ. قَالَ الْمَرْزُبَانِيُّ: بسنده عن أَبُو الْعَيْنَاءِ قَالَ: كَانَ مَرْوَانُ بْنُ أَبِي حَفْصَةَ مِنْ أَبْخَلِ النَّاسِ، خَرَجَ يُرِيدُ الْمَهْدِيَّ، فَقَالَتْ لَهُ امْرَأَةٌ مِنْ أَهْلِهِ: مَا لِي عَلَيْكَ إِنْ رَجَعْتَ بِالْجَائِزَةِ ؟ قَالَ: إِنْ أُعْطِيتُ مِائَةَ أَلْفِ دِرْهَمٍ أَعْطَيْتُكِ دِرْهَمًا، فَأُعْطِيَ سِتِّينَ أَلْفًا، فَدَفَعَ إِلَيْهَا أَرْبَعَةَ دَوَانِيقَ. تُوُفِّيَ مَرْوَانُ فِي هَذِهِ السَّنَةِ وَدُفِنَ بِبَغْدَادَ فِي مَقْبَرَةِ نَصْرِ بْنِ مَالِكٍ. الْقَاضِي أَبُو يُوسُفَ وَالْقَاضِي أَبُو يُوسُفَ وَهُوَ يَعْقُوبُ بْنُ إِبْرَاهِيمَ بْنِ حَبِيبِ بْنِ سَعْدِ بْنِ حَبْتَةَ،  وَهِيَ أُمُّهُ، وَأَبُوهُ بَحِيرُ بْنُ مُعَاوِيَةَ، وَسَعْدٌ هَذَا لَهُ صُحْبَةٌ، اسْتُصْغِرَ يَوْمَ أُحُدٍ، وَأَبُو يُوسُفَ الْقَاضِي هَذَا كَانَ أَكْبَرَ أَصْحَابِ أَبِي حَنِيفَةَ، رَحِمَهُ اللَّهُ، وَرَوَى الْحَدِيثَ عَنِ الْأَعْمَشِ، وَهِشَامِ بْنِ عُرْوَةَ، وَمُحَمَّدِ بْنِ إِسْحَاقَ، وَيَحْيَى بْنِ سَعِيدٍ، وَغَيْرِهِمْ. وَعَنْهُ مُحَمَّدُ بْنُ الْحَسَنِ، وَأَحْمَدُ بْنُ حَنْبَلٍ، وَيَحْيَى بْنُ مَعِيِنٍ. قَالَ عَلِيُّ بْنُ الْجَعْدِ: سَمِعْتُهُ يَقُولُ: تُوُفِّيَ أَبِي وَأَنَا صَغِيرٌ، فَأَسْلَمَتْنِي أُمِّي إِلَى قَصَّارٍ، فَكُنْتُ أَمُرُّ عَلَى حَلْقَةِ أَبِي حَنِيفَةَ، فَأَجْلِسُ فِيهَا، فَكَانَتْ أُمِّي تَتْبَعُنِي، فَتَأْخُذُ بِيَدِي مِنَ الْحَلْقَةِ وَتَذْهَبُ بِي إِلَى الْقَصَّارِ، ثُمَّ كُنْتُ أُخَالِفُهَا فِي ذَلِكَ وَأَذْهَبُ إِلَى أَبِي حَنِيفَةَ، فَلَمَّا طَالَ ذَلِكَ قَالَتْ أُمِّي لِأَبِي حَنِيفَةَ: إِنَّ هَذَا صَبِيٌّ يَتِيمٌ، لَيْسَ لَهُ شَيْءٌ إِلَّا مَا أُطْعِمُهُ مِنْ مِغْزَلِي، وَإِنَّكَ قَدْ أَفْسَدْتَهُ عَلَيَّ. فَقَالَ لَهَا: اسْكُتِي يَا رَعْنَاءُ، هَا هُوَ ذَا يَتَعَلَّمُ الْعِلْمَ، وَسَيَأْكُلُ الْفَالَوْذَجَ بِدُهْنِ الْفُسْتُقِ. فَقَالَتْ لَهُ: إِنَّكَ شَيْخٌ قَدْ خَرِفْتَ. قَالَ أَبُو يُوسُفَ: فَلَمَّا وَلِيتُ الْقَضَاءَ - وَكَانَ أَوَّلَ مَنْ وَلَّاهُ الْقَضَاءَ الْهَادِي، وَهُوَ أَوَّلُ مَنْ لُقِّبَ بِقَاضِي الْقُضَاةِ، وَكَانَ يُقَالُ لَهُ: قَاضِي قُضَاةِ الدُّنْيَا. لِأَنَّهُ كَانَ يَسْتَنِيبُ فِي سَائِرِ الْأَقَالِيمِ الَّتِي يَحْكُمُ فِيهَا الْخَلِيفَةُ - قَالَ أَبُو يُوسُفَ: فَبَيْنَا أَنَا ذَاتَ يَوْمٍ عِنْدَ الرَّشِيدِ إِذْ أُتِيَ بِفَالَوْذَجَ وَكُنْتُ لَا أَعْرِفُهَا، فَقَالَ لِي: كُلْ مِنْ هَذَا; فَإِنَّهُ لَا يُصْنَعُ لَنَا كُلَّ وَقْتٍ. فَقُلْتُ: وَمَا هَذَا يَا أَمِيرَ الْمُؤْمِنِينَ؟ فَقَالَ: هَذَا الْفَالَوْذَجُ. قَالَ: فَتَبَسَّمْتُ، فَقَالَ: مَا لَكَ تَتَبَسَّمُ؟ فَقُلْتُ: لَا شَيْءَ، أَبْقَى اللَّهُ أَمِيرَ الْمُؤْمِنِينَ. فَقَالَ: لَتُخْبِرَنِّي: فَقَصَصْتُ عَلَيْهِ الْقِصَّةَ مِنْ أَوَّلِهَا، فَقَالَ: إِنَّ الْعِلْمَ يَنْفَعُ وَيَرْفَعُ فِي الدُّنْيَا وَالْآخِرَةِ. ثُمَّ قَالَ: رَحِمَ اللَّهُ أَبَا حَنِيفَةَ، فَلِقَدْ كَانَ يَنْظُرُ بِعَيْنِ عَقْلِهِ مَا لَا يَرَاهُ بِعَيْنِ رَأْسِهِ. وَكَانَ أَبُو حَنِيفَةَ يَقُولُ عَنْ أَبِي يُوسُفَ: إِنَّهُ أَعْلَمُ أَصْحَابِهِ. وَقَالَ الْمُزَنِيُّ: كَانَ أَبُو يُوسُفَ أَتْبَعَهُمْ لِلْحَدِيثِ. وَقَالَ ابْنُ الْمَدِينِيِّ: كَانَ صَدُوقًا. وَقَالَ ابْنُ مَعِينٍ: كَانَ ثِقَةً. وَقَالَ أَبُو زُرْعَةَ: كَانَ سَلِيمًا مِنَ التَّجَهُّمِ. وَقَالَ بَشَّارٌ الْخَفَّافُ: سَمِعْتُ أَبَا يُوسُفَ يَقُولُ: مَنْ قَالَ: الْقُرْآنُ مَخْلُوقٌ. فَحَرَامُ كَلَامُهُ، وَفَرْضٌ مُبَايَنَتُهُ. وَمِنْ كَلَامِهِ الَّذِي يَنْبَغِي كِتَابَتُهُ بِمَاءِ الذَّهَبِ قَوْلُهُ: مَنْ طَلَبَ الْمَالَ بِالْكِيمْيَاءِ أَفْلَسَ، وَمَنْ تَتَبَّعَ غَرَائِبَ الْحَدِيثِ كَذَبَ، وَمَنْ طَلَبَ الْعِلْمَ بِالْكَلَامِ تَزَنْدَقَ. وَلَمَّا تَنَاظَرَ هُوَ وَمَالِكٌ بِالْمَدِينَةِ بِحَضْرَةِ الرَّشِيدِ فِي مَسْأَلَةِ الصَّاعِ وَزَكَاةِ الْخَضْرَاوَاتِ احْتَجَّ مَالِكٌ بِمَا اسْتَدْعَى بِهِ مِنْ تِلْكَ الصِّيعَانِ الْمَنْقُولَةِ عَنْ آبَائِهِمْ وَأَسْلَافِهِمْ، وَبِأَنَّهُ لَمْ تَكُنِ الْخَضْرَاوَاتُ فِي زَمَنِ الْخُلَفَاءِ الرَّاشِدِينَ. فَقَالَ: لَوْ رَأَى صَاحِبِي مَا رَأَيْتُ لَرَجَعَ كَمَا رَجَعْتُ. وَهَذَا إِنْصَافٌ. وَقَدْ كَانَ يَحْضُرُ فِي مَجْلِسِ حُكْمِهِ الْعُلَمَاءُ عَلَى طَبَقَاتِهِمْ، حَتَّى إِنَّ أَحْمَدَ بْنَ حَنْبَلٍ كَانَ شَابًّا، وَكَانَ يَحْضُرُ مَجْلِسَهُ فِي أَثْنَاءِ النَّاسِ، فَيَتَنَاظَرُونَ وَيَتَبَاحَثُونَ فِيهِ، وَهُوَ مَعَ ذَلِكَ يَحْكُمُ وَيُصَنِّفُ أَيْضًا. وَقَالَ: وُلِّيتُ هَذَا الْحُكْمَ، وَأَرْجُو اللَّهَ أَنْ لَا يَسْأَلَنِي عَنْ جَوْرٍ وَلَا مَيْلٍ إِلَى أَحَدٍ إِلَّا يَوْمًا وَاحِدًا; جَاءَنِي رَجُلٌ فَذَكَرَ أَنَّ لَهُ بُسْتَانًا، وَأَنَّهُ فِي يَدِ أَمِيرِ الْمُؤْمِنِينَ، فَدَخَلْتُ إِلَى أَمِيرِ الْمُؤْمِنِينَ فَأَعْلَمْتُهُ، فَقَالَ: الْبُسْتَانُ لِي، اشْتَرَاهُ لِي الْمَهْدِيُّ. فَقُلْتُ: إِنْ رَأَى أَمِيرُ الْمُؤْمِنِينَ أَنْ يُحْضِرَهُ لِأَسْمَعَ دَعْوَاهُ. فَأَحْضَرَهُ فَادَّعَى بِالْبُسْتَانِ، فَقُلْتُ: مَا تَقُولُ يَا أَمِيرَ الْمُؤْمِنِينَ؟ فَقَالَ: هُوَ بُسْتَانِي. فَقُلْتُ لِلرَّجُلِ: قَدْ سَمِعْتَ مَا أَجَابَ. فَقَالَ الرَّجُلُ: يَحْلِفُ. فَقُلْتُ: أَتَحْلِفُ يَا أَمِيرَ الْمُؤْمِنِينَ؟ فَقَالَ: لَا. فَقُلْتُ: سَأَعْرِضُ عَلَيْكَ الْيَمِينَ ثَلَاثًا، فَإِنْ حَلَفْتَ وَإِلَّا حَكَمْتُ عَلَيْكَ. فَعَرَضْتُهَا عَلَيْهِ ثَلَاثًا فَامْتَنَعَ، فَحَكَمْتُ بِالْبُسْتَانِ لِلْمُدَّعِي. قَالَ: فَكُنْتُ فِي أَثْنَاءِ الْخُصُومَةِ أَوَدُّ أَنْ نَنْفَصِلَ، وَلَمْ يُمْكِنِّي أَنْ أُجْلِسَ الرَّجُلَ مَعَ الْخَلِيفَةِ. وَبَعَثَ الْقَاضِي أَبُو يُوسُفَ فِي تَسْلِيمِ الْبُسْتَانِ إِلَى الرَّجُلِ. وَرَوَى الْمُعَافَى بْنُ زَكَرِيَّا الْجُرَيْرِيُّ، بسنده عَنْ بِشْرِ بْنِ الْوَلِيدِ، عَنْ أَبِي يُوسُفَ قَالَ: بَيْنَا أَنَا ذَاتَ لَيْلَةٍ قَدْ نِمْتُ فِي الْفِرَاشِ، إِذَا رَسُولُ الْخَلِيفَةِ يَطْرُقُ الْبَابَ، فَخَرَجْتُ مُنْزَعِجًا فَقَالَ: أَمِيرُ الْمُؤْمِنِينَ يَدْعُوكَ. فَذَهَبْتُ فَإِذَا هُوَ جَالِسٌ وَمَعَهُ عِيسَى بْنُ جَعْفَرٍ، فَقَالَ لِي الرَّشِيدُ: إِنَّ هَذَا قَدْ طَلَبْتُ مِنْهُ جَارِيَةً يَهَبُنِيهَا، فَلَمْ يَفْعَلْ، أَوْ يَبِيعُنِيهَا فَلَمْ يَفْعَلْ، وَإِنِّي أُشْهِدُكَ إِنْ لَمْ يُجِبْنِي إِلَى ذَلِكَ قَتَلْتُهُ. فَقُلْتُ لِعِيسَى: لِمَ لَمْ تَفْعَلْ؟ فَقَالَ: إِنِّي حَالِفٌ بِالطَّلَاقِ وَالْعَتَاقِ وَصَدَقَةِ مَالِي كُلِّهِ أَنْ لَا أَبِيعَهَا وَلَا أَهَبَهَا. فَقَالَ لِي الرَّشِيدُ: فَهَلْ لَهُ مِنْ مَخْلَصٍ؟ فَقُلْتُ: نَعَمْ، يَبِيعُكُ نِصْفَهَا، وَيَهَبُكَ نِصْفَهَا. فَوَهَبَهُ النِّصْفَ، وَبَاعَهُ النِّصْفَ بِمِائَةِ أَلْفِ دِينَارٍ، فَقَبِلَ مِنْهُ ذَلِكَ، وَأُحْضِرَتِ الْجَارِيَةُ، فَلَمَّا رَآهَا الرَّشِيدُ قَالَ: هَلْ لِي مِنْ سَبِيلٍ عَلَيْهَا اللَّيْلَةَ؟ قُلْتُ: إِنَّهَا مَمْلُوكَةٌ، وَلَا بُدَّ مِنَ اسْتِبْرَائِهَا، إِلَّا أَنْ تُعْتِقَهَا وَتَتَزَوَّجَهَا، فَإِنَّ الْحُرَّةَ لَا تُسْتَبْرَأُ. قَالَ: فَأَعْتَقَهَا وَزَوَّجْتُهَا مِنْهُ بِعِشْرِينَ أَلْفَ دِينَارٍ، وَأَمَرَ لِي بِمِائَتَيْ أَلْفِ دِرْهَمٍ وَعِشْرِينَ تَخْتًا مِنْ ثِيَابٍ، وَأَرْسَلَتْ إِلَيَّ الْجَارِيَةُ بِعَشَرَةِ آلَافِ دِينَارٍ. قَالَ يَحْيَى بْنُ مَعِينٍ: كُنْتُ عِنْدَ أَبِي يُوسُفَ، فَجَاءَتْهُ هَدِيَّةٌ مِنْ ثِيَابٍ دَبِيقِيٍّ وَطِيبٍ وَتَمَاثِيلَ نِدٍّ وَغَيْرِ ذَلِكَ، فَذَاكَرَنِي رَجُلٌ فِي إِسْنَادِ حَدِيثِ: " مَنْ أُهْدِيَتْ لَهُ هَدِيَّةٌ وَعِنْدَهُ قَوْمٌ جُلُوسٌ فَهُمْ شُرَكَاؤُهُ ". فَقَالَ أَبُو يُوسُفَ: إِنَّمَا ذَاكَ فِي الْأَقِطِ وَالتَّمْرِ وَالزَّبِيبِ، وَلَمْ تَكُنِ الْهَدَايَا مَا تَرَوْنَ، يَا غُلَامُ، شِلْ إِلَى الْخَزَائِنِ. وَقَالَ بِشْرُ بْنُ غِيَاثٍ الْمَرِيسِيُّ: سَمِعْتُ أَبَا يُوسُفَ يَقُولُ: صَحِبْتُ أَبَا حَنِيفَةَ سَبْعَ عَشْرَةَ سَنَةً، ثُمَّ انْصَبَّتْ عَلَيَّ الدُّنْيَا سَبْعَ عَشْرَةَ سَنَةً، وَمَا أَظُنُّ أَجَلِي إِلَّا قَدِ اقْتَرَبَ. فَمَا كَانَ شُهُورٌ حَتَّى مَاتَ. وَقَدْ مَاتَ أَبُو يُوسُفَ فِي رَبِيعٍ الْأَوَّلِ مِنْ هَذِهِ السَّنَةِ عَنْ تِسْعٍ وَسِتِّينَ سَنَةً، وَقَدْ مَكَثَ فِي الْقَضَاءِ سِتَّ عَشْرَةَ سَنَةً، وَوَلِيَ الْقَضَاءَ مِنْ بَعْدِهِ وَلَدُهُ يُوسُفُ. وَقَدْ كَانَ نَائِبَهُ عَلَى الْجَانِبِ الْغَرْبِيِّ مِنْ بَغْدَادَ. وَمَنْ زَعَمَ مِنَ الرُّوَاةِ أَنَّ الشَّافِعِيَّ اجْتَمَعَ بِأَبِي يُوسُفَ كَمَا يَقُولُهُ عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الْبَلَوِيُّ الْكَذَّابُ فِي الرِّحْلَةِ الَّتِي سَاقَهَا الشَّافِعِيُّ، فَقَدْ أَخْطَأَ فِي ذَلِكَ، فَإِنَّ الشَّافِعِيَّ إِنَّمَا وَرَدَ بَغْدَادَ فِي أَوَّلِ قَدْمَةٍ قَدِمَهَا إِلَيْهَا فِي سَنَةِ أَرْبَعٍ وَثَمَانِينَ. وَإِنَّمَا اجْتَمَعَ بِمُحَمَّدِ بْنِ الْحَسَنِ الشَّيْبَانِيِّ، فَأَحْسَنَ إِلَيْهِ وَأَقْبَلَ عَلَيْهِ، وَلَمْ يَكُنْ بَيْنَهُمَا شَنَآنٌ، كَمَا قَدْ يَذْكُرُهُ بَعْضُ مَنْ لَا خِبْرَةَ لَهُ بِهَذَا الشَّأْنِ. وَاللَّهُ أَعْلَمُ. يَعْقُوبُ بْنُ دَاوُدَ بْنِ طَهْمَانَ أَبُو عَبْدِ اللَّهِ، مَوْلَى عَبْدِ اللَّهِ بْنِ خَازِمٍ السُّلَمِيِّ وَفِيهَا تُوُفِّيَ يَعْقُوبُ بْنُ دَاوُدَ بْنِ طَهْمَانَ أَبُو عَبْدِ اللَّهِ، مَوْلَى عَبْدِ اللَّهِ بْنِ خَازِمٍ السُّلَمِيِّ،  اسْتَوْزَرَهُ الْمَهْدِيُّ، وَسَلَّمَ إِلَيْهِ أَزِمَّةَ الْأُمُورِ، وَحَظِيَ عِنْدَهُ جِدًّا، ثُمَّ لَمَّا أَمَرَهُ بِقَتْلِ ذَلِكَ الْعَلَوِيِّ فَأَرْسَلَهُ، وَنَمَّتْ عَلَيْهِ الْجَارِيَةُ، وَتَحَقَّقَ أَنَّهُ لَمْ يَفْعَلْ، سَجَنَهُ فِي بِئْرٍ، وَبُنِيَتْ عَلَيْهِ قُبَّةٌ، وَنَبَتَ عَلَيْهِ شَعْرٌ كَمَا يَنْبُتُ شَعْرُ الْأَنْعَامِ، وَعَمِيَ، وَيُقَالُ: عَشِيَ بَصَرُهُ، وَمَكَثَ نَحْوًا مِنْ خَمْسَ عَشْرَ سَنَةً فِي ذَلِكَ الْمَكَانِ لَا يَرَى شَيْئًا، وَلَا يَسْمَعُ صَوْتًا إِلَّا حِينَ الصَّلَوَاتِ يُعْلَمُ بِهِ، وَيُدَلَّى إِلَيْهِ فِي كُلِّ يَوْمٍ رَغِيفٌ وَكُوزُ مَاءٍ، حَتَّى انْقَضَتْ أَيَّامُ الْمَهْدِيِّ وَأَيَّامُ الْهَادِي وَصَدْرٌ مِنْ خِلَافَةِ الرَّشِيدِ، قَالَ يَعْقُوبُ: فَأَتَانِي آتٍ فِي مَنَامِي فَقَالَ: عَسَى الْكَرْبُ الَّذِي أَمْسَيْتَ فِيهِ     يَكُونُ وَرَاءَهُ فَرَجٌ قَرِيبُ فَيَأَمَنَ خَائِفٌ وَيُفَكُّ عَانٍ     وَيَأْتِي أَهْلَهُ النَّائِي الْغَرِيبُ فَلَمَّا أَصْبَحْتُ نُودِيتُ فَظَنَنْتُ أَنِّي أُعْلَمُ بِوَقْتِ الصَّلَاةِ، وَدُلِيَّ إِلَيَّ حَبْلٌ، وَقِيلَ لِي: ارْبُطْ هَذَا الْحَبْلَ فِي وَسَطِكِ. فَأَخْرَجُونِي، فَلَمَّا نَظَرْتُ إِلَى الضِّيَاءِ لَمْ أُبْصِرْ شَيْئًا، وَأُوقِفْتُ بَيْنَ يَدَيِ الْخَلِيفَةِ. فَظَنَنْتُهُ الْمَهْدِيَّ، فَسَلَّمْتُ عَلَيْهِ أَنَّهُ الْمَهْدِيُّ، فَقَالَ: لَسْتُ بِهِ. قُلْتُ: فَالْهَادِي؟ فَقَالَ: لَسْتُ بِهِ. فَقُلْتُ: السَّلَامُ عَلَيْكَ يَا أَمِيرَ الْمُؤْمِنِينَ الرَّشِيدَ. فَقَالَ: نَعَمْ. ثُمَّ قَالَ: وَاللَّهِ إِنَّهُ لَمْ يَشْفَعْ فِيكَ عِنْدِي أَحَدٌ، وَلَكِنِّي الْبَارِحَةَ حَمَلْتُ جَارِيَةً لِي صَغِيرَةً عَلَى عُنُقِي، فَذَكَرْتُ حَمْلَكَ إِيَّايَ عَلَى عُنُقِكَ، فَرَحِمْتُ مَا أَنْتَ فِيهِ مِنَ الضِّيقِ، فَأَخْرَجْتُكَ. ثُمَّ أَنْعَمَ عَلَيْهِ وَأَحْسَنَ إِلَيْهِ. فَغَارَ مِنْهُ يَحْيِي بْنُ خَالِدِ بْنِ بَرْمَكَ، وَخَشِيَ أَنْ يُعِيدَهُ إِلَى الْمَنْزِلَةِ الَّتِي كَانَ فِيهَا أَيَّامِ الْمَهْدِيِّ، وَفَهِمَ ذَلِكَ يَعْقُوبُ، فَاسْتَأْذَنَ الْخَلِيفَةَ فِي الذَّهَابِ إِلَى مَكَّةَ، فَأَذِنَ لَهُ، فَكَانَ بِهَا حَتَّى مَاتَ فِي هَذِهِ السَّنَةِ، رَحِمَهُ اللَّهُ. يَزِيدُ بْنُ زُرَيْعٍ أَبُو مُعَاوِيَةَ الْعَيْشِيُّ وَيَزِيدُ بْنُ زُرَيْعٍ أَبُو مُعَاوِيَةَ الْعَيْشِيُّ،  كَانَ ثِقَةً عَالِمًا عَابِدًا وَرِعًا، تُوُفِّيَ أَبُوهُ وَكَانَ وَالِيَ الْبَصْرَةِ، وَتَرَكَ مِنَ الْمَالِ خَمْسَمِائَةِ أَلْفِ دِرْهَمٍ، فَلَمْ يَأْخُذْ مِنْهَا يَزِيدُ دِرْهَمًا وَاحِدًا، وَكَانَ يَعْمَلُ الْخُوصَ، وَيَأْكُلُ مِنْهُ. وَتُوُفِّيَ بِالْبَصْرَةِ فِي هَذِهِ السَّنَةِ، وَقِيلَ قَبْلَ ذَلِكَ. فَاللَّهُ أَعْلَمُ. وَفِي هَذِهِ السَّنَةِ مَاتَ مُحَمَّدُ بْنُ جَعْفَرٍ الطَّيَالِسِيُّ الْمُحَدِّثُ. وَعَبْدُ الْعَزِيزِ بْنُ مُحَمَّدِ بْنِ أَبِي عُبَيْدٍ الدَّرَاوَرْدِيُّ، مَوْلَى جُهَيْنَةَ، وَكَانَ أَبُوهُ مِنْ دَارَابَجِرْدَ، فَاسْتَثْقَلُوا نِسْبَتَهُ إِلَيْهَا فَقَالُوا دَرَاوَرْدِيُّ. وَفِيهَا تُوُفِّيَ دَرَّاجُ أَبُو السَّمْحِ، ( وَاسْمُهُ عَبْدُ اللَّهِ بْنُ السَّمْحِ، وَقِيلَ: عَبْدُ الرَّحْمَنِ بْنُ السَّمْحِ بْنِ ) أُسَامَةَ التُّجِيبِيُّ، الْمِصْرِيُّ، وَكَانَ مَوْلِدُهُ سَنَةَ خَمْسٍ وَعِشْرِينَ وَمِائَةٍ. وَعَفِيفُ بْنُ سَالِمٍ الْمَوْصِلِيُّ.

Translation

✧ Those of the notables who died in this year Ismāʿīl b. ʿAyyāsh b. Sulaym al-ʿAnsī, Abū ʿUtbah Ismāʿīl b. ʿAyyāsh b. Sulaym al-ʿAnsī, Abū ʿUtbah. He was from the people of Ḥimṣ, born in the year 102. It is also said: in the year 106. He heard from the elders, from Abū Bakr b. Abī Maryam, Yaḥyā b. Saʿīd al-Anṣārī, Sahl b. Abī Ṣāliḥ, and others. Those who narrated from him: al-Aʿmash, Ibn al-Mubārak, and Yazīd b. Hārūn. He came to Baghdad to see al-Manṣūr, who appointed him over the wardrobe treasury. He used to say: "I inherited four thousand dinars from my father and spent them in the pursuit of knowledge." Yaḥyā b. Maʿīn said: "Ismāʿīl is trustworthy, but the Iraqis dislike his ḥadīth." Al-Bukhārī said: "When he narrates from the people of his own region, it is sound; but when he narrates from other than the people of his region, there is something questionable in it." He died in this year, though some say in the year 181. ʿAmmār b. Muḥammad, Abū al-Yaqẓān al-Kūfī ʿAmmār b. Muḥammad, Abū al-Yaqẓān al-Kūfī. He was the son of the sister of Sufyān al-Thawrī. He settled in Baghdad and narrated from al-Aʿmash. Those who narrated from him: Aḥmad b. Ḥanbal and al-Ḥasan b. ʿArafah. Some people declared him trustworthy. Ibn Ḥibbān said: "He was one whose errors were gross and whose delusions were many, so he deserved to be abandoned." He died in Muḥarram of this year. Muḥammad b. Abī Shaybah b. Ibrāhīm b. ʿUthmān [al-ʿAbsī] al-Kūfī Muḥammad b. Abī Shaybah b. Ibrāhīm b. ʿUthmān [al-ʿAbsī] al-Kūfī. He was the father of Abū Bakr, ʿUthmān, and others. Abū Zakariyyā [Yaḥyā b. Maʿīn] said: "He was a handsome man, trustworthy, and astute. He was judge of Fārs, and he died in Fārs in this year at the age of seventy-seven." Muḥammad b. Ḥumayd, Abū Sufyān al-Yashkurī, known as al-Maʿmarī Muḥammad b. Ḥumayd, Abū Sufyān al-Yashkurī, known as al-Maʿmarī. He met Maʿmar b. Rāshid, and because of his journey to him he was called al-Maʿmarī. He heard Sufyān al-Thawrī and others. He was trustworthy, truthful, and virtuous. He died in this year. Marwān b. Sulaymān [b. Yaḥyā] b. Abī Ḥafṣah, Abū al-Haydhām Marwān b. Sulaymān [b. Yaḥyā] b. Abī Ḥafṣah, Abū al-Haydhām. It is also said: Abū al-Simṭ. The name of Abū Ḥafṣah was Yazīd. He was among the captives of Iṣṭakhr, taken captive as a boy. ʿUthmān b. ʿAffān bought him and gave him as a gift to Marwān [b. al-Ḥakam], who freed him on the Day of the House, because he fought well that day. It is also said that Abū Ḥafṣah was a Jewish physician who embraced Islam at the hands of ʿUthmān b. ʿAffān. It is also said: at the hands of Marwān b. al-Ḥakam. Marwān b. Sulaymān was an excellent poet, and he praised al-Mahdī, al-Rashīd, and Maʿn b. Zāʾidah. Al-Kisāʾī said: "Poetry is but a churn that produces butter; the butter was given to Marwān b. Abī Ḥafṣah." It is reported from al-Faḍl b. Bazīʿ who said: I saw Marwān b. Abī Ḥafṣah enter upon al-Mahdī after the death of Maʿn [b. Zāʾidah], and he praised him with some verses. Al-Mahdī asked, "Who are you?" He replied, "Your poet Marwān b. Abī Ḥafṣah." Al-Mahdī said, "Are you not the one who said: We stayed in al-Yamāmah after Maʿn A stay from which we did not wish to depart And we said, where shall we journey after Maʿn When bounty has gone, and there is no bounty You have come seeking our bounty, but bounty is gone, and you will have nothing from us. Drag him by his foot." So he was dragged by his foot until he was expelled. The next year, he used subtle means until he entered with the poets. The poets used to enter upon the caliphs once each year. He stood before him and recited: A visiting phantom came to you, so greet her apparition until he reached from it: She testified from the Anfal, the last verse Of their inheritance, and you wished to invalidate it Al-Mahdī began to edge away from his prayer mat in admiration of his verses. Then he asked, "How many verses are these?" He said, "One hundred verses." He ordered for him one hundred thousand dirhams. When the caliphate passed to al-Rashīd, he recited to him, and al-Rashīd said, "Are you not the one who said about Maʿn such and such?" and he mentioned the two verses. Then he ordered him expelled. He used subtle means until he returned and entered after two days, and recited a qasida to him. Al-Rashīd ordered for him thousands equal to the number of its verses. It is reported from ʿAbd Allāh b. Isḥāq b. Sallām who said: Marwān left the palace of al-Mahdī with eighty thousand dirhams. He passed by a crippled man who begged from him, and he gave him two-thirds of a dirham. Someone said to him, "Why not give him a dirham?" He said, "If I had been given one hundred thousand, I would have completed the dirham for him." He said: Marwān was miserly, and no lamp was lit for him in his house. When he wanted to sleep, a slave girl would light a reed for him until he fell asleep. It is reported from ʿAlī b. Muḥammad al-Nawfalī who said: I heard my father say: Al-Mahdī used to give Ibn Abī Ḥafṣah and Salm al-Khāsir a single gift. Salm would come to al-Mahdī's gate on a horse worth ten thousand dirhams, wearing silk brocade and fine cloth, and perfume wafted from him. Marwān would come wearing a worn fur garment and a coarse cotton shirt and a rough cloak. He would not eat meat out of miserliness unless it was offered to him. If it was offered, he would send his servant to buy a head for him, and he would eat it. It was said to him, "We see you eat only heads." He said, "I know the head's hair, so I am safe from the servant's treachery. It is not meat that the servant cooks and could eat from it; and I eat from it various kinds: I eat its eyes as one kind, its ears as another, its throat as another, and its brain as another. I am spared the trouble of cooking it. So many conveniences are combined for me." Al-Marzubānī said, with his chain of narration from Abū al-ʿAynāʾ who said: Marwān b. Abī Ḥafṣah was one of the most miserly people. He went out intending to see al-Mahdī, and a woman of his family said to him, "What do I get if you return with the prize?" He said, "If I am given one hundred thousand dirhams, I will give you one dirham." He was given sixty thousand, and he handed her four dāniqs. Marwān died in this year and was buried in Baghdad in the cemetery of Naṣr b. Mālik. Al-Qāḍī Abū Yūsuf and al-Qāḍī Abū Yūsuf, who is Yaʿqūb b. Ibrāhīm b. Ḥabīb b. Saʿd b. Ḥabtah—and she is his mother—and his father was Baḥīr b. Muʿāwiyah, and this Saʿd had companionship of the Prophet, being considered too young on the day of Uḥud. This Abū Yūsuf the judge was the greatest of the companions of Abū Ḥanīfah, may God have mercy on him. He narrated ḥadīth from al-Aʿmash, Hishām b. ʿUrwah, Muḥammad b. Isḥāq, Yaḥyā b. Saʿīd, and others. Those who narrated from him: Muḥammad b. al-Ḥasan, Aḥmad b. Ḥanbal, and Yaḥyā b. Maʿīn. ʿAlī b. al-Jaʿd said: I heard him say: My father died when I was small, and my mother put me to work for a fuller. I used to pass by the circle of Abū Ḥanīfah and sit in it. My mother would follow me, take me by the hand, and lead me back to the fuller. Then I would defy her and go to Abū Ḥanīfah. When this went on for a long time, my mother said to Abū Ḥanīfah, "This is an orphan boy; he has nothing except what I feed him from my spinning. You have corrupted him for me." He said to her, "Be quiet, foolish woman. Here he is learning knowledge, and he will eat fālūdhaj with pistachio oil." She said to him, "You are an old man who has become senile." Abū Yūsuf said: When I was appointed judge—and the first to appoint him judge was al-Hādī, and he was the first to be titled Qāḍī al-Quḍāt (Chief Judge), and he was called the Judge of the Judges of the world because he appointed deputies in all the provinces over which the caliph ruled—Abū Yūsuf said: One day I was with al-Rashīd when fālūdhaj was brought, and I did not know it. He said to me, "Eat of this, for it is not made for us all the time." I said, "What is this, O Commander of the Faithful?" He said, "This is fālūdhaj." I smiled. He asked, "Why do you smile?" I said, "Nothing, may God preserve the Commander of the Faithful." He said, "You must tell me." So I related the story from the beginning. He said, "Knowledge benefits and elevates in this world and the next." Then he said, "May God have mercy on Abū Ḥanīfah; he saw with the eye of his intellect what he did not see with the eye of his head." Abū Ḥanīfah used to say of Abū Yūsuf that he was the most learned of his companions. Al-Muzanī said: Abū Yūsuf was the most adherent of them to ḥadīth. Ibn al-Madīnī said: He was truthful. Ibn Maʿīn said: He was trustworthy. Abū Zurʿah said: He was free from Jahmism. Bashshār al-Khaffāf said: I heard Abū Yūsuf say: Whoever says the Qurʾān is created, it is forbidden to speak with him, and it is obligatory to shun him. Among his sayings that deserve to be written in gold water is his statement: "Whoever seeks wealth through alchemy will go bankrupt; whoever pursues rare and strange ḥadīth will lie; and whoever seeks knowledge through speculative theology will become a zindīq." When he and Mālik debated in Madinah in the presence of al-Rashīd concerning the question of the ṣāʿ and the zakāt on vegetables, Mālik argued with the ṣāʿ measures he had brought, which had been transmitted from their ancestors and forebears, and with the fact that vegetables were not subject to zakāt in the time of the rightly-guided caliphs. Abū Yūsuf said: "If my companion had seen what I have seen, he would have retracted as I have retracted." This is fairness. Scholars of various ranks used to attend his judgment sessions, so much so that Aḥmad b. Ḥanbal, then a young man, used to attend his session among the people, and they would debate and discuss, while he, in addition, would judge and also compose works. He said: I took charge of this judgeship, and I hope God will not ask me about any injustice or favoritism to anyone except one day. A man came to me and mentioned that he had a garden, and that it was in the possession of the Commander of the Faithful. I entered upon the Commander of the Faithful and informed him. He said, "The garden is mine; al-Mahdī bought it for me." I said, "If the Commander of the Faithful sees fit, let him bring it so that I may hear his claim." He brought it and claimed the garden. I said, "What do you say, O Commander of the Faithful?" He said, "It is my garden." I said to the man, "You have heard what he answered." The man said, "Let him swear an oath." I said, "Will you swear, O Commander of the Faithful?" He said, "No." I said, "I will offer you the oath three times; if you swear, fine, otherwise I will judge against you." I offered it three times, and he refused, so I judged the garden for the claimant. He said: During the dispute, I wished we could be done with it, and I could not seat the man alongside the caliph. Judge Abū Yūsuf sent someone to deliver the garden to the man. Al-Muʿāfā b. Zakariyyā al-Jarīrī narrated with his chain of narration from Bishr b. al-Walīd, from Abū Yūsuf who said: One night I had gone to bed when the caliph's messenger knocked on the door. I went out startled, and he said, "The Commander of the Faithful summons you." I went, and there he was sitting with ʿĪsā b. Jaʿfar. Al-Rashīd said to me, "I asked this man for a slave girl either to give her to me or to sell her to me, and he did neither. I call you to witness that if he does not comply, I will kill him." I said to ʿĪsā, "Why did you not comply?" He said, "I have sworn by divorce, manumission, and giving all my wealth as charity that I will not sell her or give her away." Al-Rashīd said to me, "Is there any way out for him?" I said, "Yes; he can sell you half of her and give you the other half." So he gave him half as a gift and sold him the other half for one hundred thousand dinars. Al-Rashīd accepted that from him, and the slave girl was brought. When al-Rashīd saw her, he said, "Is there any way for me to have her tonight?" I said, "She is a slave, and she must be observed for one menstrual period, unless you manumit her and marry her, for a free woman is not subject to istibrāʾ." He said: So he manumitted her, and I married her to him for twenty thousand dinars. He ordered for me two hundred thousand dirhams and twenty bundles of clothes, and the slave girl sent me ten thousand dinars. Yaḥyā b. Maʿīn said: I was with Abū Yūsuf when a gift came to him of Dabīqī linen clothes, perfume, aloeswood statues, and other things. A man reminded me of the chain of the ḥadīth: "Whoever is given a gift while people are sitting with him, they are his partners in it." Abū Yūsuf said: "That is only about dried curd, dates, and raisins. Gifts were not what you see now. O boy, carry it to the storerooms." Bishr b. Ghiyāth al-Marīsī said: I heard Abū Yūsuf say: "I accompanied Abū Ḥanīfah for seventeen years, then the world poured upon me for seventeen years, and I think my term is near." Only a few months passed before he died. Abū Yūsuf died in Rabīʿ al-Awwal of this year at the age of sixty-nine. He had served as judge for sixteen years. After him, his son Yūsuf assumed the post of judge. He had been his deputy on the western side of Baghdad. Whoever among the narrators claims that al-Shāfiʿī met Abū Yūsuf, as the liar ʿAbd Allāh b. Muḥammad al-Balawī says in the journey he attributes to al-Shāfiʿī, has erred in that. For al-Shāfiʿī first came to Baghdad in the year 184. He met only Muḥammad b. al-Ḥasan al-Shaybānī, who treated him well and welcomed him, and there was no rancor between them, as some people without knowledge of this matter may mention. And God knows best. Yaʿqūb b. Dāwūd b. Ṭahmān Abū ʿAbd Allāh, client of ʿAbd Allāh b. Khāzim al-Sulamī In this year died Yaʿqūb b. Dāwūd b. Ṭahmān Abū ʿAbd Allāh, client of ʿAbd Allāh b. Khāzim al-Sulamī. Al-Mahdī made him his wazir and entrusted the reins of affairs to him, and he enjoyed great favor with him. Then when al-Mahdī ordered him to kill that ʿAlid, he let him go, and a slave girl informed on him, and it was confirmed that he had not done it. Al-Mahdī imprisoned him in a well, built a dome over him, and hair grew on him as it grows on cattle. He became blind—or it is said his eyesight became weak—and he remained in that place for about fifteen years seeing nothing and hearing no sound except at prayer times, by which he knew the hours. Each day a loaf of bread and a jug of water were lowered to him, until the days of al-Mahdī, al-Hādī, and part of al-Rashīd's caliphate passed. Yaʿqūb said: Then someone came to me in my sleep and said: Perhaps the distress in which you have ended the evening will be followed by a near relief, So a fearful one will feel safe, a captive will be released, and the far-away stranger will come to his family. When I entered the morning, I was called, and I thought I was being informed of the time of prayer. A rope was lowered to me, and I was told: Tie this rope around your waist. They brought me out, and when I looked at the light, I could not see anything. I was made to stand before the caliph. I thought he was al-Mahdi, so I greeted him as al-Mahdi. He said: I am not he. I said: Then al-Hadi? He said: I am not he. I said: Peace be upon you, O Commander of the Faithful, al-Rashid. He said: Yes. Then he said: By God, no one interceded for you with me, but last night I carried a small slave-girl of mine on my neck, and I remembered your carrying me on your neck, so I took pity on the distress you are in, and brought you out. Then he bestowed favor upon him and treated him kindly. Yahya b. Khalid b. Barmak grew jealous of him and feared that he would restore him to the station he had held in the days of al-Mahdi. Yaʿqub understood that, so he asked the caliph for permission to go to Makkah, and he granted him permission. He remained there until he died in this year, may God have mercy on him. Yazid b. Zurayʿ Abu Muʿawiya al-ʿAyshi, and Yazid b. Zurayʿ Abu Muʿawiya al-ʿAyshi, was trustworthy, learned, devout, and pious. His father died, having been governor of al-Basra, and left five hundred thousand dirhams of wealth, but Yazid did not take a single dirham of it. He used to work with palm leaves and eat from that. He died in al-Basra in this year, and it was said before that. God knows best. In this year Muhammad b. Jaʿfar al-Tayalisi the traditionist died. And ʿAbd al-ʿAziz b. Muhammad b. Abi ʿUbayd al-Darawerdi, client of Juhayna. His father was from Darabjird, and they found his nisba to it cumbersome, so they said Darawerdi. In this year died Darraj Abu al-Samh, whose name was ʿAbd Allah b. al-Samh, and it is said: ʿAbd al-Rahman b. al-Samh b. Usama al-Tujibi, the Egyptian. He was born in the year one hundred and twenty-five. And ʿAfif b. Salim al-Mawsili.
