مَنْ تُوُفِّيَ فِي هَذِهِ السَّنَةِ مِنَ الْأَكَابِرِ   شُرَيْكُ بْنُ عَبْدِ اللَّهِ، أَبُو عَبْدِ اللَّهِ النَّخَعِيُّ الْكُوفِيُّ، الْقَاضِي شُرَيْكُ بْنُ عَبْدِ اللَّهِ، أَبُو عَبْدِ اللَّهِ النَّخَعِيُّ الْكُوفِيُّ، الْقَاضِي  . أَدْرَكَ عُمَرَ بْنَ عَبْدِ الرَّحْمَنِ، وَسَمِعَ أَبَا إِسْحَاقَ السَّبِيعِيَّ، وَمَنْصُورَ بْنَ الْمُعْتَمِرِ، وَعَبْدَ الْمَلِكِ بْنَ عُمَيْرٍ، وَسِمَاكَ بْنَ حَرْبٍ، وَسَلَمَةَ بْنَ كُهَيْلٍ، وَحَبِيبَ بْنَ أَبِي ثَابِتٍ، وَالْأَعْمَشَ وَخَلْقًا كَثِيرًا. رَوَى عَنْهُ: ابْنُ الْمُبَارَكِ، وَوَكِيعٌ، وَابْنُ مَهْدِيٍّ، وَغَيْرُهُمْ. وَهُوَ مِنْ كِبَارِ الْعُلَمَاءِ الثِّقَاتُ، إِلَّا أَنَّ قَوْمًا قَدَحُوا فِي حِفْظِهِ. عن أَبُو خَالِدٍ يَزِيدُ بْنُ يَحْيَى بْنِ يَزِيدَ قَالَ: حَدَّثَنِي أَبِي قَالَ: مَرَّ شُرَيْكٌ الْقَاضِي بِالْمُسْتَنِيرِ بْنِ عَمْرٍو النَّخَعِيِّ فَجَلَسَ إِلَيْهِ فَقَالَ: أَبَا عَبْدِ اللَّهِ، مَنْ أَدَّبَكَ ؟ قَالَ: أَدَّبَتْنِي نَفْسِي، وَاللَّهِ وُلِدْتُ بِبُخَارَى فَحَمَلَنِي ابْنُ عَمٍّ لَنَا حَتَّى طَرَحَنِي عِنْدَ بَنِي عَمٍّ لِي، فَكُنْتُ أَجْلِسُ إِلَى مُعَلِّمٍ لَهُمْ فَعَلِقَ بِقَلْبِي تَعَلُّمُ الْقُرْآنِ، فَجِئْتُ إِلَى شَيْخِهِمْ فَقُلْتُ: يَا عَمَّاهُ، الَّذِي كُنْتَ تُجْرِيهِ عَلَيَّ هُنَا أَجْرِهِ عَلَيَّ بِالْكُوفَةِ أَعْرِفُ بِهَا السُّنَّةَ وَقَوْمِي، فَفَعَلَ، فَكُنْتُ بِالْكُوفَةِ أَضْرِبُ اللَّبِنَ وَأَبِيعُهُ وَأَشْتَرِي دَفَاتِرَ وَطُرُوسًا، فَأَكْتُبُ فِيهَا الْعِلْمَ وَالْحَدِيثَ، ثُمَّ طَلَبْتُ الْفِقْهَ فَبَلَغْتُ مَا تَرَى فَقَالَ الْمُسْتَنِيرُ لِوَلَدِهِ: سَمِعْتُمْ قَوْلَ [ابْنِ ] عَمِّكُمْ، وَقَدْ أَكْثَرْتُ عَلَيْكُمْ فِي الْأَدَبِ وَلَا أَرَاكُمْ تُفْلِحُونَ فِيهِ، فَلْيُؤَدِّبْ كُلُّ رَجُلٍ مِنْكُمْ نَفْسَهُ، فَمَنْ أَحْسَنَ فَلَهَا، وَمَنْ أَسَاءَ فَعَلَيْهَا. لَمَّا وَلِيَ الْقَضَاءَ اضْطَرَبَ حِفْظُهُ. وعن مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْحَسَنِ الصَّوَّافُ قَالَ: وَجَدْتُ فِي كِتَابِنَا عَنْ أَبِي الْعَبَّاسِ بْنِ مَسْرُوقٍ مَا يَدُلُّ حَالُهُ عَلَى السَّمَاعِ. قَالَ: سَمِعْتُ أَبَا كُرَيْبٍ يَقُولُ: سَمِعْتُ يَحْيَى بْنَ يَمَانٍ يَقُولُ: لَمَّا وَلِيَ شُرَيْكٌ الْقَضَاءَ أُكْرِهَ عَلَى ذَلِكَ، وَأُقْعِدَ مَعَهُ جَمَاعَةٌ مِنَ الشُّرْطَةِ يَحْفَظُونَهُ، ثُمَّ طَابَ لِلشَّيْخِ [فَقَعَدَ ] مِنْ نَفْسِهِ، فَبَلَغَ الثَّوْرِيَّ أَنَّهُ قَعَدَ مِنْ نَفْسِهِ، فَجَاءَ فَتَرَاءَى لَهُ، فَلَمَّا رَأَى الثَّوْرِيَّ قَامَ إِلَيْهِ فَعَظَّمَهُ وَأَكْرَمَهُ، ثُمَّ قَالَ: يَا أَبَا عَبْدِ اللَّهِ، هَلْ مِنْ حَاجَةٍ ؟ قَالَ: نَعَمْ مَسْأَلَةٌ. قَالَ: أَوَلَيْسَ عِنْدَكَ مِنَ الْعِلْمِ مَا يُجْزِيكَ ؟ قَالَ: أَحْبَبْتُ أَنْ أُذَاكِرَكَ بِهَا. قَالَ: قُلْ. قَالَ: مَا تَقُولُ فِي امْرَأَةٍ جَاءَتْ فَجَلَسَتْ عَلَى بَابِ رَجُلٍ، فَفَتَحَ الرَّجُلُ الْبَابَ وَاحْتَمَلَهَا، فَفَجَرَ بِهَا [، لِمَنْ تَحُدُّ مِنْهُمَا ؟ ] فَقَالَ لَهُ: دُونَهَا لِأَنَّهَا مَغْصُوبَةٌ. قَالَ: فَإِنَّهُ لَمَّا كَانَ مِنَ الْغَدِ جَاءَتْ فَتَزَيَّنَتْ [وَتَبَخَّرَتْ ] وَجَلَسَتْ عَلَى ذَلِكَ الْبَابِ، فَفَتَحَ الرَّجُلُ الْبَابَ فَرَآهَا فَاحْتَمَلَهَا فَفَجَرَ بِهَا، لِمَنْ تَحُدُّ مِنْهُمَا ؟ قَالَ: أَحُدُّهُمَا جَمِيعًا، لِأَنَّهَا جَاءَتْ مِنْ نَفْسِهَا، وَقَدْ عَرَفَتِ الْخَبَرَ بِالْأَمْسِ. قَالَ: أَنْتَ كَانَ عُذْرُكَ حَيْثُ كَانَ الشُّرَطُ يَحْفَظُونَكَ، الْيَوْمَ أَيُّ عُذْرٍ لَكَ ؟ قَالَ: يَا أَبَا عَبْدِ اللَّهِ، أُكَلِّمُكَ. قَالَ: مَا كَانَ اللَّهُ لِيَرَانِي أُكَلِّمُكَ أَوْ تَتُوبَ. قَالَ: فَوَثَبَ فَلَمْ يُكَلِّمْهُ حَتَّى مَاتَ وَكَانَ إِذَا ذَكَرَهُ قَالَ: أَيُّ رَجُلٍ كَانَ لَوْ لَمْ يُفْسِدُوهُ. وعن أَحْمَدُ بْنُ زُهَيْرٍ قَالَ: حَدَّثَنَا سُلَيْمَانُ بْنُ شَيْخٍ قَالَ: حَدَّثَنِي عَبْدُ اللَّهِ بْنُ صَالِحِ بْنِ مُسْلِمٍ قَالَ: كَانَ شُرَيْكٌ عَلَى قَضَاءِ الْكُوفَةِ فَخَرَجَ يَلْقَى الْخَيْزُرَانَ، فَبَلَغَ شَاهِيَ وَأَبْطَأَتِ الْخَيْزُرَانُ، فَأَقَامَ يَنْتَظِرُهَا ثَلَاثًا وَيَبِسَ خُبْزُهُ، فَجَعَلَ يَبُلُّهُ بِالْمَاءِ وَيَأْكُلُهُ، فَقَالَ الْعَلَاءُ بْنُ الْمِنْهَالِ: فَإِنْ كَانَ الَّذِي قَدْ قُلْتَ حَقًّا بِأَنْ قَدْ أَكْرَهُوكَ عَلَى الْقَضَاءِ     فَمَا لَكَ مَوْضِعًا فِي كُلِّ يَوْمٍ تَلَقَّى مَنْ يَحُجُّ مِنَ النِّسَاءِ مُقِيمٌ فِي قُرَى شَاهِي ثَلَاثًا     بِلَا زَادٍ سِوَى كِسْرٍ وَمَاءِ وعَنْ عُمَرَ بْنِ الْهَيَّاجِ بْنِ سَعِيدٍ قَالَ: أَتَتْهُ امْرَأَةٌ يَوْمًا - يَعْنِي شُرَيْكًا - وَهُوَ فِي مَجْلِسِ الْحُكْمِ، فَقَالَتْ: إِنَّا بِاللَّهِ ثُمَّ بِالْقَاضِي، امْرَأَةٌ مِنْ وَلَدِ جَرِيرِ بْنِ عَبْدِ اللَّهِ صَاحِبِ النَّبِيِّ ﷺ. وَرَدَّدَتِ الْكَلَامَ فَقَالَ: إِيهًا عَنْكِ الْآنَ مَنْ ظَلَمَكِ ؟ فَقَالَتْ: الْأَمِيرُ مُوسَى بْنُ عِيسَى، كَانَ لِي بُسْتَانٌ عَلَى شَاطِئِ الْفُرَاتِ، لِي فِيهِ نَخْلٌ وَرِثْتُهُ عَنْ آبَائِي، فَقَاسَمْتُ إِخْوَتِي وَبَنَيْتُ بَيْنِي وَبَيْنَهُمْ حَائِطًا، وَجَعَلْتُ فِيهِ فَارِسِيًّا فِي بَيْتٍ يَحْفَظُ النَّخْلَ، وَيَقُومُ بِبُسْتَانِي، فَاشْتَرَى الْأَمِيرُ مُوسَى بْنُ عِيسَى مِنْ إِخْوَتِي جَمِيعًا، وَسَاوَمَنِي وَأَرْغَبَنِي فَلَمْ أَبِعْهُ، فَلَمَّا كَانَ فِي هَذِهِ اللَّيْلَةِ بَعَثَ بِخَمْسِمِائَةِ فَاعِلٍ فَاقْتَلَعُوا الْحَائِطَ، فَأَصْبَحْتُ لَا أَعْرِفُ مِنْ نَخْلِي شَيْئًا، وَاخْتَلَطَ بِنَخْلِ إِخْوَتِي، فَقَالَ: يَا غُلَامُ طَيِّنْهُ بِخَتْمٍ، ثُمَّ قَالَ لَهَا: امْضِي إِلَى بَابِهِ حَتَّى يَحْضُرَ مَعَكِ. فَجَاءَتِ الْمَرْأَةُ بِالطِّينَةِ فَأَخَذَهَا الْحَاجِبُ وَدَخَلَ بِهَا إِلَى مُوسَى فَقَالَ: أَعْدَى شُرَيْكٌ عَلَيْكَ، فَقَالَ: ادْعُ لِي صَاحِبَ الشُّرَطِ. فَدَعَا بِهِ، فَقَالَ: امْضِ إِلَى شُرَيْكٍ، فَقُلْ يَا سُبْحَانَ اللَّهِ، مَا رَأَيْتُ أَعْجَبَ مِنْ أَمْرِكَ امْرَأَةٌ ادَّعَتْ دَعْوَى لَمْ تَصِحَّ أَعْدَيْتَهَا عَلَيَّ ! قَالَ: يَقُولُ لَهُ صَاحِبُ الشُّرَطِ، إِنْ رَأَى الْأَمِيرُ أَنْ يُعْفِيَنِي فَلْيَفْعَلْ، فَقَالَ: امْضِ وَيْلَكَ. فَخَرَجَ فَأَمَرَ غِلْمَانَهُ أَنْ يَتَقَدَّمُوا إِلَى الْحَبْسِ بِفِرَاشٍ وَغَيْرِهِ مِنْ آلَةِ الْحَبْسِ، فَلَمَّا جَاءَ وَقَفَ بَيْنَ يَدَيْ شُرَيْكٍ فَأَدَّى الرِّسَالَةَ ؟ قَالَ: خُذْ بِيَدِهِ فَضَعْهُ فِي الْحَبْسِ. قَالَ: قَدْ عَرَفْتُ وَاللَّهِ إِنَّكَ تَفْعَلُ بِي هَذَا، فَقَدَّمْتُ مَا يُصْلِحُنِي إِلَى الْحَبْسِ، وَبَلَغَ مُوسَى بْنَ عِيسَى الْخَبَرُ، فَوَجَّهَ الْحَاجِبَ إِلَيْهِ فَقَالَ: هَذَا رَسُولٌ، أَيُّ شَيْءٍ عَلَيْهِ ؟ فَلَمَّا وَقَفَ بَيْنَ يَدَيْهِ وَأَدَّى الرِّسَالَةَ قَالَ: أَلْحِقْهُ بِصَاحِبِهِ فَحُبِسَ. فَلَمَّا صَلَّى الْأَمِيرُ الْعَصْرَ بَعَثَ إِلَى إِسْحَاقَ بْنِ الصَّبَّاحِ الْأَشْعَثِيِّ وَجَمَاعَةٍ مِنْ وُجُوهِ الْكُوفَةِ مِنْ أَصْدِقَاءِ شُرَيْكٍ. فَقَالَ: امْضُوا إِلَيْهِ وَأَبْلِغُوهُ سَلَامِي، وَأَعْلِمُوهُ أَنَّهُ قَدِ اسْتَخَفَّ بِي وَإِنِّي لَسْتُ كَالْعَامَّةِ، فَمَضَوْا وَهُوَ جَالِسٌ فِي مَسْجِدِهِ بَعْدَ الْعَصْرِ، فَدَخَلُوا عَلَيْهِ فَأَبْلَغُوهُ الرِّسَالَةَ، فَلَمَّا انْقَضَى كَلَامُهُمْ قَالَ [لَهُمْ: ] مَا لِي لَا أَرَاكُمْ جِئْتُمْ فِي غَيْرِهِ مِنَ النَّاسِ فَكَلَّمْتُمُونِي ؟ مَنْ هَا هُنَا مِنْ فِتْيَانِ الْحَيِّ ؟ فَلْيَأْخُذْ كُلُّ وَاحِدٍ مِنْكُمْ بِيَدِ رَجُلٍ، فَيَذْهَبْ بِهِ إِلَى الْحَبْسِ لَا يَنَمْ وَاللَّهِ إِلَّا فِيهِ. قَالُوا: أَجَادٌّ أَنْتَ ؟ قَالَ: حَقًّا حَتَّى لَا تَعُودُوا بِرِسَالَةِ ظَالِمٍ. فَحَبَسَهُمْ فَرَكِبَ مُوسَى بْنُ عِيسَى فِي اللَّيْلِ إِلَى بَابِ الْحَبْسِ، فَأَطْلَقَهُمْ جَمِيعًا. فَلَمَّا كَانَ مِنَ الْغَدِ وَجَلَسَ شُرَيْكٌ لِلْقَضَاءِ، جَاءَ السَّجَّانُ فَأَخْبَرَهُ فَدَعَا بِالْقِمَطْرِ فَخَتَمَهُ، وَوَجَّهَ بِهِ إِلَى مَنْزِلِهِ، ثُمَّ قَالَ لِغُلَامِهِ أَلْحِقْنِي بِثِقْلِي إِلَى بَغْدَادَ، فَوَاللَّهِ مَا طَلَبْنَا هَذَا الْأَمْرَ مِنْهُمْ، وَلَكِنْ أَكْرَهُونَا عَلَيْهِ، وَلَقَدْ ضَمِنُوا لَنَا الْإِعْزَازَ فِيهِ إِذْ [قَدْ ] تَقَلَّدْنَاهُ لَهُمْ، وَمَضَى نَحْوَ قَنْطَرَةِ الْكُوفَةِ إِلَى بَغْدَادَ. وَبُلِّغَ مُوسَى بْنَ عِيسَى الْخَبَرُ، فَرَكِبَ فِي مَوْكِبِهِ فَلَحِقَهُ وَجَعَلَ يُنَاشِدُهُ اللَّهَ وَيَقُولُ: يَا أَبَا عَبْدِ اللَّهِ تَثَبَّتْ، انْظُرْ إِخْوَانَكَ تَحْبِسُهُمْ دَعْ أَعْوَانِي. قَالَ: نَعَمْ لِأَنَّهُمْ مَشَوْا لَكَ فِي أَمْرٍ لَمْ يَجِبْ عَلَيْهِمُ الْمَشْيُ فِيهِ، وَلَسْتُ بِبَارِحٍ أَوْ يُرَدُّوا جَمِيعًا إِلَى الْحَبْسِ وَإِلَّا مَضَيْتُ إِلَى أَمِيرِ الْمُؤْمِنِينَ فَاسْتَعْفَيْتُهُ مِمَّا قَلَّدَنِي. فَأَمَرَ بِرَدِّهِمْ جَمِيعًا إِلَى الْحَبْسِ، وَهُوَ وَاللَّهِ وَاقِفٌ مَكَانَهُ حَتَّى جَاءَهُ السَّجَّانُ فَقَالَ لَهُ: قَدْ رَجَعُوا إِلَى الْحَبْسِ. فَقَالَ لِأَعْوَانِهِ: خُذُوا بِلِجَامِهِ، فَرُدُّوهُ بَيْنَ يَدَيَّ إِلَى مَجْلِسِ الْحُكْمِ فَمَرُّوا بِهِ بَيْنَ يَدَيْهِ حَتَّى أُدْخِلَ الْمَسْجِدَ وَجَلَسَ مَجْلِسَ الْقَضَاءِ، ثُمَّ قَالَ: عَلَيَّ بِالْجُوَيْرِيَةِ الْمُتَظَلِّمَةِ [مِنْ هَذَا ] فَجَاءَتْ فَقَالَ: هَذَا خَصْمُكِ قَدْ حَضَرَ، وَهُوَ جَالِسٌ مَعَهَا بَيْنَ يَدَيْهِ، فَقَالَ: أُولَئِكَ يَخْرُجُونَ مِنَ الْحَبْسِ قَبْلَ كُلِّ شَيْءٍ. قَالَ: أَمَّا الْآنَ فَنَعَمْ، أَخْرِجُوهُمْ. ثُمَّ قَالَ لَهُ: مَا تَقُولُ فِيمَا تَدَّعِيهِ هَذِهِ [الْمَرْأَةُ ؟ ] قَالَ: صَدَقَتْ. قَالَ: فَرُدَّ جَمِيعَ مَا أُخِذَ مِنْهَا وَتَبْنِي حَائِطَهَا فِي وَقْتٍ وَاحِدٍ سَرِيعًا كَمَا هُدِمَ. قَالَ: أَفْعَلُ. قَالَ: بَقِيَ لَكَ شَيْءٌ. قَالَ: تَقُولُ الْمَرْأَةُ بَيْتُ الْفَارِسِيِّ وَمَتَاعُهُ. قَالَ: يَقُولُ مُوسَى بْنُ عِيسَى: وَنَرُدُّ ذَلِكَ [جَمِيعَهُ ]، بَقِيَ لَكِ شَيْءٌ تَدَّعِينَهُ ؟ قَالَتْ: لَا، وَجَزَاكَ اللَّهُ خَيْرًا. قَالَ: قُومِي، ثُمَّ وَثَبَ مِنْ مَجْلِسِهِ، فَأَخَذَ بِيَدِ مُوسَى بْنِ عِيسَى، فَأَجْلَسَهُ فِي مَجْلِسِهِ، ثُمَّ قَالَ: السَّلَامُ عَلَيْكَ أَيُّهَا الْأَمِيرُ تَأْمُرُ بِشَيْءٍ ؟ قَالَ: أَيُّ شَيْءٍ آمَرُ ؟ ! وَضَحِكَ. وعن أَحْمَدُ بْنُ عُثْمَانَ بْنِ حَكِيمٍ قَالَ: أَخْبَرَنِي أَبِي قَالَ: كَانَ شُرَيْكٌ الْقَاضِي لَا يَجْلِسُ حَتَّى يَتَغَدَّى ثُمَّ يَأْتِي الْمَسْجِدَ فَيُصَلِّي رَكْعَتَيْنِ، ثُمَّ يُخْرِجُ رُقْعَةً مِنْ قِمَطْرَةٍ فَيَنْظُرُ فِيهَا، ثُمَّ يَدْعُو بِالْخُصُومِ، وَإِنَّمَا كَانَ يُقَدِّمُهُمُ الْأَوَّلَ فَالْأَوَّلَ، فَقِيلَ لِابْنِ شُرَيْكٍ: نُحِبُّ أَنْ نَعْلَمَ مَا فِي هَذِهِ الرُّقْعَةِ ؟ فَنَظَرَ فِيهَا ثُمَّ أَخْرَجَهَا إِلَيْنَا، فَإِذَا فِيهَا: يَا شُرَيْكُ بْنَ عَبْدِ اللَّهِ [اذْكُرِ الصِّرَاطَ وَحِدَّتَهُ، يَا شُرَيْكُ بْنَ عَبْدِ اللَّهِ ] اذْكُرِ الْمَوْقِفَ بَيْنَ يَدَيِ اللَّهِ تَعَالَى. تُوُفِّيَ شُرَيْكٌ بِالْكُوفَةِ يَوْمَ السَّبْتِ غُرَّةَ ذِي الْقَعْدَةِ مِنْ هَذِهِ السَّنَةِ رَحِمَهُ اللَّهُ تَعَالَى. وَفِيهَا تُوُفِّيَ عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ  ، وَقِيلَ سَنَةَ ثَمَانٍ وَسَبْعِينَ. ( وَجَعْفَرُ بْنُ سُلَيْمَانَ ). وَمُحَمَّدُ بْنُ مُسْلِمٍ، وَمُوسَى بْنُ أَعْيَنَ.

Translation

✧ Those of the great ones who died in this year Shurayk b. ʿAbd Allāh, Abū ʿAbd Allāh al-Nakhaʿī al-Kūfī, the judge Shurayk b. ʿAbd Allāh, Abū ʿAbd Allāh al-Nakhaʿī al-Kūfī, the judge. He met ʿUmar b. ʿAbd al-Raḥmān, and heard from Abū Isḥāq al-Sabīʿī, Manṣūr b. al-Muʿtamir, ʿAbd al-Malik b. ʿUmayr, Simāk b. Ḥarb, Salamah b. Kuhayl, Ḥabīb b. Abī Thābit, al-Aʿmash, and many others. Narrated from him: Ibn al-Mubārak, Wakīʿ, Ibn Mahdī, and others. He is one of the great trustworthy scholars, except that some people impugned his memory. From Abū Khālid Yazīd b. Yaḥyā b. Yazīd, who said: My father narrated to me, saying: Shurayk the judge passed by al-Mustanīr b. ʿAmr al-Nakhaʿī and sat with him. He said: Abū ʿAbd Allāh, who disciplined you? He said: My own self disciplined me. By God, I was born in Bukhārā, and a cousin of ours carried me until he threw me down among my paternal cousins. I used to sit with a teacher of theirs, and learning the Qurʾān clung to my heart. I went to their elder and said: Uncle, the allowance you used to give me here, give it to me in al-Kūfah, where I may learn the Sunna and be with my people. He did so. In al-Kūfah I used to mould bricks, sell them, and buy notebooks and parchments, in which I wrote knowledge and ḥadīth. Then I sought fiqh and reached what you see. Al-Mustanīr said to his sons: You have heard the words of your cousin. I have admonished you much about discipline, and I do not see you succeeding in it. Let each man among you discipline himself: whoever does well, it is for him, and whoever does badly, it is against him. When he took up the judgeship, his memory became disordered. From Muḥammad b. Aḥmad b. al-Ḥasan al-Ṣawwāf, who said: I found in our book, from Abū al-ʿAbbās b. Masrūq, something whose circumstance indicates audition. He said: I heard Abā Kurayb say: I heard Yaḥyā b. Yamān say: When Shurayk was appointed judge, he was compelled to it, and a group of the shurṭa was seated with him to guard him. Then it became agreeable to the shaykh, and he sat of his own accord. News reached al-Thawrī that he had sat of his own accord, so he came and showed himself to him. When he saw al-Thawrī, he rose to him, honoured him, and received him hospitably. Then he said: Abū ʿAbd Allāh, is there any need? He said: Yes, a question. He said: Do you not have enough knowledge to suffice you? He said: I wished to discuss it with you. He said: Ask. He said: What do you say about a woman who came and sat at a man's door, and the man opened the door, took her up, and fornicated with her? Whom of the two do you punish? He said to him: She alone, because she was coerced. He said: But when the next day came, she came adorned and perfumed and sat at that door. The man opened the door, saw her, took her up, and fornicated with her. Whom of the two do you punish? He said: I punish both of them, because she came of her own accord and knew what had happened yesterday. He said: You had an excuse when the shurṭa were guarding you; today what excuse do you have? He said: Abū ʿAbd Allāh, let me speak with you. He said: God will not see me speaking with you until you repent. He said: He leapt up and did not speak with him until he died. When he mentioned him, he said: What a man he would have been, had they not corrupted him. From Aḥmad b. Zuhayr, who said: Sulaymān b. Shaykh narrated to us, saying: ʿAbd Allāh b. Ṣāliḥ b. Muslim narrated to me, saying: Shurayk was over the judgeship of al-Kūfah. He went out to meet al-Khayzurān, and reached Shāhī, but al-Khayzurān was delayed. He stayed waiting for her three days. His bread dried up, and he began to moisten it with water and eat it. Al-ʿAlāʾ b. al-Minhāl said: If what you said is true, that they compelled you to the judgeship, then why do you have a place every day receiving those women who go on pilgrimage? Staying in the villages of Shāhī for three days, with no provision but dry bread and water. From ʿUmar b. al-Hayyāj b. Saʿīd, who said: A woman came to him one day—he means Shurayk—while he was in the court of judgement, and said: We appeal to God, then to the judge. I am a woman of the descendants of Jarīr b. ʿAbd Allāh, the Companion of the Prophet ﷺ. She repeated the words. He said: Enough from you. Now, who wronged you? She said: The amīr Mūsā b. ʿĪsā. I had an orchard on the bank of the Euphrates, with palm trees that I inherited from my forefathers. I divided it with my brothers and built a wall between me and them. I placed a Persian in a house to guard the palms and tend my orchard. The amīr Mūsā b. ʿĪsā bought from all my brothers, and bargained with me and enticed me, but I did not sell to him. Last night he sent five hundred labourers and they demolished the wall. In the morning I could not recognise any of my palms; they were mixed with my brothers' palms. He said: Boy, seal it with clay. Then he said to her: Go to his gate so that he may appear with you. The woman came with the clay. The chamberlain took it and entered with it to Mūsā and said: Shurayk has summoned a complaint against you. He said: Call the chief of the shurṭa to me. He called him, and he said: Go to Shurayk and say: Glory be to God! I have not seen anything stranger than your affair. A woman made a claim that is not valid, and you aided her against me! He said: The chief of the shurṭa said to him: If the amīr sees fit to excuse me, let him do so. He said: Go, woe to you. So he went out and ordered his servants to go ahead to the prison with bedding and other prison equipment. When he came, he stood before Shurayk and delivered the message. He said: Take his hand and put him in prison. He said: By God, I knew you would do this to me, so I sent ahead what I need in prison. The news reached Mūsā b. ʿĪsā, and he sent the chamberlain to him, saying: This is a messenger; what is upon him? When he stood before him and delivered the message, he said: Join him to his companion. So he was imprisoned. When the amīr prayed the afternoon prayer, he sent to Isḥāq b. al-Ṣabbāḥ al-Ashʿathī and a group of the notables of al-Kūfah, friends of Shurayk, saying: Go to him, convey my greeting, and inform him that he has belittled me, and I am not like the common people. They went while he was sitting in his mosque after the afternoon prayer. They entered upon him and delivered the message. When their speech ended, he said to them: Why do I not see that you have come among other people and spoken to me? Which of the young men of the quarter is here? Let each one of you take a man by the hand and lead him to prison. By God, he will not sleep except in it. They said: Are you serious? He said: Truly, so that you do not return with the message of an oppressor. So he imprisoned them. Mūsā b. ʿĪsā rode at night to the prison gate and released them all. The next day, when Shurayk sat for judgement, the jailer came and informed him. He called for the box, sealed it, and sent it to his house. Then he said to his servant: Join me with my baggage to Baghdād. By God, we did not seek this matter from them, but they compelled us to it. They promised us honour in it when we undertook it for them. He went towards the bridge of al-Kūfah, to Baghdād. Mūsā b. ʿĪsā was informed of the news. He rode in his procession, caught up with him, and began to adjure him by God, saying: Abū ʿAbd Allāh, be firm. Consider your brothers: you imprison them; leave my aides. He said: Yes, because they went to you in a matter in which they were not obliged to go. I will not leave until they are all returned to prison; otherwise I will go to the Commander of the Faithful and ask to be relieved of what he entrusted to me. So he ordered all of them returned to prison, and by God, he remained standing in his place until the jailer came and said to him: They have returned to prison. He said to his aides: Take his bridle and bring him before me to the court of judgement. They passed with him before him until he entered the mosque and sat in the judgeship. Then he said: Bring me the woman who complained against this man. She came, and he said: This is your adversary; he is present. He was sitting with her before him. He said: Let those leave prison before everything. He said: Now, yes; bring them out. Then he said to him: What do you say about what this woman claims? He said: She is truthful. He said: Then restore all that was taken from her, and rebuild her wall at once, quickly, as it was demolished. He said: I will do it. He said: Is there anything left for you? He said: The woman says the Persian's house and his belongings. Mūsā b. ʿĪsā said: We will restore all of that. Is there anything left you claim? She said: No, and may God reward you well. He said: Arise. Then he rose from his seat, took Mūsā b. ʿĪsā by the hand, seated him in his place, and said: Peace be upon you, O amīr. Do you command anything? He said: What should I command? And he laughed. From Aḥmad b. ʿUthmān b. Ḥakīm, who said: My father informed me, saying: Shurayk the judge would not sit until he had breakfast. Then he would come to the mosque, pray two rakʿas, take out a note from the box, look at it, and then call for the litigants. He would give precedence to them first come, first served. It was said to Ibn Shurayk: We would like to know what is in this note. He looked at it and brought it out to us. In it was: O Shurayk b. ʿAbd Allāh, remember the ṣirāṭ and its sharpness. O Shurayk b. ʿAbd Allāh, remember the standing before God Almighty. Shurayk died in al-Kūfah on Saturday, the first of Dhū al-Qaʿdah of this year, may God Almighty have mercy on him. In this year died ʿAbd al-Wāḥid b. Ziyād. It is also said in the year seventy-eight. (And Jaʿfar b. Sulaymān), Muḥammad b. Muslim, and Mūsā b. Aʿyan.
