The Farewell Pilgrimage
وَاسْتَأْذَنَهُ الْعَبَّاسُ بْنُ عَبْدِ الْمُطَّلِبِ أَنْ يَبِيتَ بِمَكَّةَ لَيَالِيَ مِنًى مِنْ أَجْلِ سِقَايَتِهِ فَأَذِنَ لَهُ. وَاسْتَأْذَنَهُ رِعَاءُ الْإِبِلِ فِي الْبَيْتُوتَةِ خَارِجَ مِنًى عِنْدَ الْإِبِلِ، فَأَرْخَصَ لَهُمْ أَنْ يَرْمُوا يَوْمَ النَّحْرِ، ثُمَّ يَجْمَعُوا رَمْيَ يَوْمَيْنِ بَعْدَ يَوْمِ النَّحْرِ يَرْمُونَهُ فِي أَحَدِهِمَا. قَالَ مالك: ظَنَنْتُ أَنَّهُ قَالَ: فِي أَوَّلِ يَوْمٍ مِنْهُمَا، ثُمَّ يَرْمُونَ يَوْمَ النَّفْرِ. وَقَالَ ابْنُ عُيَيْنَةَ فِي هَذَا الْحَدِيثِ: رَخَّصَ لِلرُّعَاءِ أَنْ يَرْمُوا يَوْمًا، وَيَدَعُوا يَوْمًا فَيَجُوزُ لِلطَّائِفَتَيْنِ بِالسُّنَّةِ تَرْكُ الْمَبِيتِ بِمِنًى ، وَأَمَّا الرَّمْيُ فَإِنَّهُمْ لَا يَتْرُكُونَهُ بَلْ لَهُمْ أَنْ يُؤَخِّرُوهُ إِلَى اللَّيْلِ، فَيَرْمُونَ فِيهِ، وَلَهُمْ أَنْ يَجْمَعُوا رَمْيَ يَوْمَيْنِ فِي يَوْمٍ، وَإِذَا كَانَ النَّبِيُّ ﷺ قَدْ رَخَّصَ لِأَهْلِ السِّقَايَةِ وَلِلرِّعَاءِ فِي الْبَيْتُوتَةِ، فَمَنْ لَهُ مَالٌ يَخَافُ ضَيَاعَهُ، أَوْ مَرِيضٌ يَخَافُ مِنْ تَخَلُّفِهِ عَنْهُ، أَوْ كَانَ مَرِيضًا لَا تَمْكُنُهُ الْبَيْتُوتَةُ، سَقَطَتْ عَنْهُ بِتَنْبِيهِ النَّصِّ عَلَى هَؤُلَاءِ، وَاللَّهُ أَعْلَمُ.
Translation
✧ Al-ʿAbbās b. ʿAbd al-Muṭṭalib asked his permission to spend the nights of Minā in Makkah on account of his water-giving duty, and he permitted him. And the camel herdsmen asked his permission to spend the night outside Minā near the camels, and he granted them a dispensation to cast pebbles on the Day of Sacrifice, then to combine the casting of two days after the Day of Sacrifice and cast it on one of them. Mālik said: I think he said: on the first of those two days, then they cast on the Day of Departure. And Ibn ʿUyaynah said concerning this ḥadīth: He granted the herdsmen a dispensation to cast one day and omit one day. Thus it is permissible for both groups, by the Sunnah, to omit spending the night at Minā. As for the casting of pebbles, they do not omit it; rather they may postpone it until night and cast it then, and they may combine the casting of two days in one day. Since the Prophet ﷺ granted a dispensation to the people of the water-giving and to the herdsmen regarding spending the night, then whoever has property which he fears may be lost, or a sick person whom he fears to leave behind, or is himself too ill to spend the night, the obligation is dropped from him by the indication of the text concerning these people, and God knows best.
