The Treaty of al-Hudaybiyah
[ هِجْرَةُ أُمِّ كُلْثُومٍ إِلَى الرَّسُولِ وَإِبَاؤُهُ رَدَّهَا ] وَلَمَّا رَجَعَ إِلَى الْمَدِينَةِ جَاءَهُ نِسَاءٌ مُؤْمِنَاتٌ، مِنْهُنَّ أم كلثوم بنت عقبة بن أبي معيط، فَجَاءَ أَهْلُهَا يَسْأَلُونَهَا رَسُولَ اللَّهِ ﷺ بِالشَّرْطِ الَّذِي كَانَ بَيْنَهُمْ، فَلَمْ يُرْجِعْهَا إِلَيْهِمْ، وَنَهَاهُ اللَّهُ عَزَّ وَجَلَّ عَنْ ذَلِكَ، فَقِيلَ: هَذَا نَسْخٌ لِلشَّرْطِ فِي النِّسَاءِ. وَقِيلَ: تَخْصِيصٌ لِلسُّنَّةِ بِالْقُرْآنِ، وَهُوَ عَزِيزٌ جِدًّا. وَقِيلَ: لَمْ يَقَعِ الشَّرْطُ إِلَّا عَلَى الرِّجَالِ خَاصَّةً، وَأَرَادَ الْمُشْرِكُونَ أَنْ يُعَمِّمُوهُ فِي الصِّنْفَيْنِ فَأَبَى اللَّهُ ذَلِكَ.
Translation
✧ [ THE EMIGRATION OF UMM KULTHŪM TO THE MESSENGER AND HIS REFUSAL TO RETURN HER ] When he returned to Madinah, believing women came to him, among them Umm Kulthūm bt. ʿUqbah b. Abī Muʿayṭ. Her family came asking the Messenger of Allah ﷺ for her according to the condition that was between them. He did not return her to them, and Allah, Mighty and Majestic, forbade him from that. It was said: This is an abrogation of the condition regarding women. It was said: A specification of the Sunnah by the Qurʾān, and this is very rare. It was said: The condition only applied to men specifically, and the polytheists wanted to generalize it to both categories, but Allah refused that.
