✧ As for the story of the resignation of Muhammad bin Muslima al-Ansari from the allegiance.

سَمِعْتُ قَاضِي الْقُضَاةَ أَبَا الْحَسَنِ مُحَمَّدَ بْنَ صَالِحٍ الْهَاشِمِيَّ يَقُولُ سَمِعْتُ أَبَا عُمَرَ الْقَاضِي يَقُولُ سَمِعْتُ إِسْمَاعِيلَ بْنَ إِسْحَاقَ الْقَاضِي يَقُولُ وَذُكِرَ لَهُ قَوْلُ قُثَمَ هَذَا فَقَالَ

«إِنَّمَا يَرِثُ الْوَارِثُ بِالنَّسَبِ أَوْ بِالْوَلَاءِ وَلَا خِلَافَ بَيْنَ أَهْلِ الْعِلْمِ أَنَّ ابْنَ الْعَمِّ لَا يَرِثُ مَعَ الْعَمِّ فَقَدْ ظَهَرَ بِهَذَا الِإِجْمَاعِ أَنَّ عَلِيًّا وَرِثَ الْعِلْمَ مِنَ النَّبِيِّ ﷺ دُونَهُمْ وَبِصِحَّةِ مَا ذَكَرَهُ الْقَاضِي» سكت عنه الذهبي في التلخيص

Translation

  2. Abū ʿUmar al-Qāḍī
  3. Ismāʿīl b. Isḥāq al-Qāḍī
  4. And Dhukir Lah Qawl Qutham Hadhā

✧ The heir inherits only through kinship or clientage, and there is no disagreement among the people of knowledge that a paternal cousin does not inherit together with a paternal uncle. Thus it becomes clear by this consensus that Ali inherited knowledge from the Prophet ﷺ apart from them, and by the soundness of what the judge mentioned.” Al-Dhahabi remained silent about it in the Talkhis.
