51. Wills and Testaments

    سَأَلْتُ عَبْدَ اللَّهِ بْنَ أَبِي أَوْفَى «هَلْ أَوْصَى رَسُولُ اللَّهِ ﷺ؟ قَالَ مَا تَرَكَ رَسُولُ اللَّهِ ﷺ شَيْئًا يُوصِي فِيهِ قُلْتُ فَكَيْفَ يَأْمُرُ النَّاسَ بِالْوَصِيَّةِ؟ قَالَ » أَوْصَى بِكِتَابِ اللَّهِ

    ✧ I asked 'Abd Allah b. Abi Awfa: Did the Messenger of Allah ﷺ leave a will? He said: The Messenger of Allah ﷺ did not leave anything to bequeath. I said: Then how can he command the people to make a will? He said: He bequeathed the Book of Allah.

    «مَا حَقُّ امْرِئٍ مُسْلِمٍ لَهُ شَيْءٌ يُوصِي فِيهِ يَبِيتُ لَيْلَتَيْنِ إِلَّا وَوَصِيَّتُهُ مَكْتُوبَةٌ عِنْدَهُ»

    ✧ It is not the right of a Muslim man who has something to bequeath to spend two nights except with his will written with him.

    «مَا حَقُّ امْرِئٍ مُسْلِمٍ تَمُرُّ عَلَيْهِ ثَلَاثُ لَيَالٍ إِلَّا وَوَصِيَّتُهُ عِنْدَهُ»

    ✧ It is not the right of a Muslim man that three nights pass except with his will with him.

    جَاءَنِي رَسُولُ اللَّهِ ﷺ يَعُودُنِي عَامَ حَجَّةِ الْوَدَاعِ مِنْ وَجَعٍ اشْتَدَّ بِي فَقُلْتُ يَا رَسُولَ اللَّهِ بَلَغَ بِي مِنَ الْوَجَعِ مَا تَرَيْ وَأَنَا ذُو مَالٍ وَلَا يَرِثُنِي إِلَّا ابْنَةٌ لِي أَفَأَتَصَدَّقُ بِثُلُثَيْ مَالِي؟ قَالَ «لَا» قُلْتُ فَبِشَطْرِهِ؟ قَالَ «لَا» ثُمَّ قَالَ «الثُّلُثُ وَالثُّلُثُ كَثِيرٌ أَوْ كَبِيرٌ إِنَّكَ إِنْ تَذَرْ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ يَكُونُوا عَالَةً يَتَكَفَّفُونَ النَّاسَ وَإِنَّكَ لَنْ تُنْفِقَ نَفَقَةً تَبْتَغِي بِهَا وَجْهَ اللَّهِ إِلَّا أُجِرْتَ بِهِ حَتَّى مَا تَجْعَلُ فِي فِي امْرَأَتِكَ» فَقُلْتُ يَا رَسُولَ اللَّهِ أُخَلَّفُ بَعْدَ أَصْحَابِي؟ قَالَ «إِنَّكَ لَنْ تُخَلَّفَ فَتَعْمَلَ عَمَلًا صَالِحًا تَبْتَغِي بِهِ وَجْهَ اللَّهِ إِلَّا ازْدَدْتَ بِهِ دَرَجَةً وَرِفْعَةً وَلَعَلَّكَ أَنْ تُخَلَّفَ حَتَّى يَنْتَفِعَ بِكَ أَقْوَامٌ وَيُضَرَّ بِكَ آخَرُونَ اللَّهُمَّ أَمْضِ لِأَصْحَابِي هِجْرَتَهُمْ وَلَا تَرُدَّهُمْ عَلَى أَعْقَابِهِمْ لَكِنَّ الْبَائِسَ سَعْدَ بْنَ خَوْلَةَ» يَرْثِي لَهُ رَسُولُ اللَّهِ ﷺ أَنْ مَاتَ بِمَكَّةَ

    ✧ The Messenger of Allah ﷺ came to visit me in the year of the Farewell Pilgrimage because of an illness that had become severe for me. I said: O Messenger of Allah, the illness has reached me to the extent you see, and I am a man of wealth, and no one will inherit from me except a daughter of mine. Should I give two-thirds of my wealth as charity? He said: No. I said: Then half? He said: No. Then he said: A third, and a third is much or great. If you leave your heirs rich, it is better than leaving them poor, begging from people. You will not spend any expenditure seeking thereby the face of Allah except that you will be rewarded for it, even what you put in your wife's mouth. I said: O Messenger of Allah, will I be left behind after my companions? He said: You will not be left behind and do a righteous deed seeking thereby the face of Allah except that you will increase in degree and elevation. Perhaps you will be left behind until some people benefit by you and others are harmed by you. O Allah, complete the emigration of my companions and do not turn them back on their heels. But the miserable one is Sa'd b. Khawlah. The Messenger of Allah ﷺ mourned for him that he died in Makkah.

    هَاجَرَ عُبَيْدُ اللَّهِ بْنُ جَحْشٍ بِأُمِّ حَبِيبَةَ بِنْتِ أَبِي سُفْيَانَ وَهِيَ امْرَأَتُهُ إِلَى أَرْضِ الْحَبَشَةِ فَلَمَّا قَدِمَ أَرْضَ الْحَبَشَةِ مَرِضَ فَلَمَّا حَضَرَتْهُ الْوَفَاةُ أَوْصَى إِلَى رَسُولِ اللَّهِ ﷺ فَتَزَوَّجَ رَسُولُ اللَّهِ ﷺ أُمَّ حَبِيبَةَ وَبَعَثَ مَعَهَا النَّجَاشِيُّ شُرَحْبِيلَ بْنَ حَسَنَةَ

    ✧ Ubayd Allah b. Jahsh emigrated with Umm Habibah bt. Abi Sufyan—and she was his wife—to the land of Abyssinia. When he arrived in the land of Abyssinia, he fell ill. When death was near, he bequeathed to the Messenger of Allah ﷺ. The Messenger of Allah ﷺ married Umm Habibah, and the Negus sent Shurahbil b. Hasanah with her.
