نا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الْبَزَّازُ نا الْحَسَنُ بْنُ عَرَفَةَ نا إِسْمَاعِيلُ ابْنُ عُلَيَّةَ عَنِ ابْنِ عَوْنٍ عَنْ عِيسَى بْنِ الْحَارِثِ قَالَ
كَانَتْ أُمُّ وَلَدٍ لِأَخِي شُرَيْحِ بْنِ الْحَارِثِ وَلَدَتْ لَهُ جَارِيَةً فَزُوِّجَتْ فَوَلَدَتْ غُلَامًا ثُمَّ تُوُفِّيَتْ أُمُّ الْوَلَدِ قَالَ فَاخْتَصَمَ فِي مِيرَاثَهَا شُرَيْحُ بْنُ الْحَارِثِ وَابْنُ ابْنَتِهَا إِلَى شُرَيْحٍ فَجَعَلَ شُرَيْحُ بْنُ الْحَارِثِ يَقُولُ لِشُرَيْحٍ إِنَّهُ لَيْسَ لَهُ مِيرَاثٌ فِي كِتَابِ اللَّهِ إِنَّمَا هُوَ ابْنُ ابْنَتِهَا قَالَ فَقَضَى شُرَيْحٌ بِمِيرَاثِهَا لِابْنِ ابْنَتِهَا وَقَالَ وَأُولُو الْأَرْحَامِ بَعْضُهُمْ أَوْلَى بِبَعْضٍ فِي كِتَابِ اللَّهِ الأحزاب 6 فَرَكِبَ مَيْسَرَةُ بْنُ يَزِيدَ إِلَى ابْنِ الزُّبَيْرِ فَأَخْبَرَهُ بِالَّذِي كَانَ مِنْ شُرَيْحٍ فَكَتَبَ ابْنُ الزُّبَيْرِ إِلَى شُرَيْحٍ إِنَّ مَيْسَرَةَ بْنَ يَزِيدَ ذَكَرَ لِي كَذَا وَكَذَا وَإِنَّكَ قُلْتَ عِنْدَ ذَلِكَ وَأُولُو الْأَرْحَامِ بَعْضُهُمْ أَوْلَى بِبَعْضٍ فِي كِتَابِ اللَّهِ الأحزاب 6 وَإِنَّمَا كَانَتْ تِلْكَ الْآيَةُ فِي شَأْنِ الْعَصَبَةِ كَانَ الرَّجُلُ يُعَاقِدُ الرَّجُلَ فَيَقُولُ تَرِثُنِي وَأَرِثُكَ فَلَمَّا نَزَلَتْ تُرِكَ ذَاكَ فَجَاءَ مَيْسَرَةُ بْنُ يَزِيدَ بِالْكِتَابِ إِلَى شُرَيْحٍ فَلَمَّا قَرَأَهُ أَبَى أَنْ يَرُدَّ قَضَاءَهُ وَقَالَ فَإِنَّهُ إِنَّمَا أَعْتَقَهَا خَبَيَاتِ بَطْنِهَا

✧ There was an umm walad belonging to the brother of Shurayh b. al-Harith who bore him a girl, and she was married off and bore a boy. Then the umm walad died. He said: Shurayh b. al-Harith and the son of her daughter disputed over her inheritance before Shurayh. Shurayh b. al-Harith kept saying to Shurayh, 'He has no inheritance in the Book of Allah; he is only her daughter's son.' He said: So Shurayh ruled her inheritance to her daughter's son and said, 'And those of kinship are more entitled to one another in the Book of Allah' [al-Ahzab 6]. So Maysarah b. Yazid rode to Ibn al-Zubayr and informed him of what Shurayh had done. Ibn al-Zubayr wrote to Shurayh: 'Maysarah b. Yazid mentioned to me such-and-such, and that you said at that time, "And those of kinship are more entitled to one another in the Book of Allah" [al-Ahzab 6]. But that verse was about the matter of the agnatic relatives: a man would make a pact with another man and say, "You inherit from me and I inherit from you." When it was revealed, that was abandoned.' Maysarah b. Yazid brought the letter to Shurayh, but when he read it, he refused to reverse his ruling and said, 'He only freed her as the recompense for her womb's offspring.'
