حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ نا مُحَمَّدُ بْنُ بَكَّارٍ نا عَبْدُ الرَّحْمَنِ بْنُ أَبِي الزِّنَادِ عَنْ أَبِيهِ عَنْ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ عَنْ أَبِيهِ

قَالَ كُلُّ قَوْمٍ يَتَوَارَثُونَ إِلَّا مَنْ عُمِّي مَوْتُ بَعْضِهِمْ قَبْلَ بَعْضٍ فِي هَدْمٍ أَوْ حَرْقٍ أَوْ قِتَالٍ وَغَيْرِ ذَلِكَ مِنْ وُجُوهِ الْمُتَؤَالِفِ فَإِنَّ بَعْضَهُمْ لَا يَرِثُ بَعْضًا وَلَكِنْ يُورَثُ كُلُّ إِنْسَانٍ مِنْهُمْ يَرِثُهُ أَوْلَى النَّاسِ بِهِ مِنَ الْأَحْيَاءِ كَأَنَّهُ لَيْسَ بَيْنَهُ وَبَيْنَ مَنْ عُمِّي مَوْتُهُ مَعَهُ قَرَابَةٌ

✧ He said: Every people inherit from one another, except those whose deaths are obscured, some before others, in a collapse, a fire, a battle, or other similar circumstances; for some of them do not inherit from others, but each person among them is inherited by the closest of the living people to him, as though there were no kinship between him and the one whose death was obscured along with him.
