حَدَّثَنَا مُحَمَّدُ بْنُ مَعْمَرٍ، قَالَ: نَا مُحَمَّدُ بْنُ كَثِيرٍ، قَالَ: نَا سُلَيْمَانُ بْنُ كَثِيرٍ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ، رَفَعَهُ، قَالَ:

مَنْ قُتِلَ فِي عِمِّيَّةٍ، أَوْ قَالَ: " عِمِّيَّةٍ "، بِحَجَرٍ أَوْ سَوْطٍ، أَوْ عَصًا، فَعَلَيْهِ عَقْلُ الْخَطَأِ، وَمَنْ قُتِلَ عَمْدًا فَهُوَ قَوَدٌ، وَمَنْ حَالَ بَيْنَهُ وَبَيْنَهُ، فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ، لَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ

Translation

✧ Whoever is killed in blind violence — or he said: "in blind violence" — with a stone, a whip, or a stick, then upon [the killer] is the blood-money for accidental killing. Whoever is killed deliberately, then retaliation is due. And whoever intervenes between [the killer and retaliation], upon him is the curse of Allah, the angels, and all people. Neither an obligatory nor a supererogatory act will be accepted from him.
