machine translationShuʿbah and al-Thawrī narrated this hadith from Abū Isḥāq, from Abū Burdah, from the Prophet ﷺ as mursal. Whoever accepts mursal reports is obliged to accept it; the mention of those among the scholars who accept them and use them as proof, and those who refuse to accept them, has already appeared at the beginning of this collection. As for the one who does not accept mursal reports, he too is obliged to accept this hadith of Abū Burdah, because those who narrated it as connected are people of memorization and reliability, and Isrāʾīl and those who followed him are memorizers (ḥuffāẓ), and the addition of a memorizer is accepted. This is an addition supported by sound principles. This hadith has also been narrated as musnad through Yazīd b. Zurayʿ from Shuʿbah, and through Bishr b. Manṣūr from al-Thawrī, but the sound report from both of them is that it is mursal.

machine translationThe narration of those who narrated from Abū Isḥāq, from Abū Burdah, from Abū Mūsā, from the Prophet ﷺ: "There is no marriage without a guardian" is in my view more sound (aṣaḥḥ), because they heard it from Abū Isḥāq at different times. Even though Shuʿbah and al-Thawrī were better memorizers and more reliable than all of those who narrated this hadith from Abū Isḥāq, the narration of those others is in my view more fitting and more sound, because Shuʿbah and al-Thawrī heard this hadith from Abū Isḥāq in a single session.

machine translationThe students of al-Thawrī also narrated it as mursal from al-Thawrī, among them Abū Nuʿaym and others.
