أَخْبَرَنَا ) أَبُو نَصْرِ بْنُ قَتَادَةَ، أَنْبَأَ أَبُو مَنْصُورٍ النَّضْرَوِيُّ، أَنْبَأَ أَحْمَدُ بْنُ نَجْدَةَ، ثَنَا سَعِيدُ بْنُ مَنْصُورٍ، ثَنَا خَالِدُ بْنُ عَبْدِ اللهِ عَنْ دَاوُدَ عَنِ الشَّعْبِيِّ، عَنْ شُرَيْحٍ
فِي قَوْلِهِ: أَوْ آخَرَانِ مِنْ غَيْرِكُمْ قَالَ: إِذَا مَاتَ الرَّجُلُ فِي أَرْضِ غُرْبَةٍ فَلَمْ يَجِدْ مُسْلِمًا، فَأَشْهَدَ مِنْ غَيْرِ الْمُسْلِمِينَ شَاهِدَيْنِ فَشَهَادَتُهُمَا جَائِزَةٌ، فَإِنْ جَاءَ مُسْلِمَانِ، فَشَهِدَا بِخِلَافِ ذَلِكَ أُخِذَ بِشَهَادَةِ الْمُسْلِمَيْنِ، وَرُدَّتْ شَهَادَتُهُمَا
