( أَخْبَرَنَا ) أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ وَأَبُو بَكْرِ بْنُ الْحَسَنِ قَالَا: ثَنَا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أَنْبَأَ الرَّبِيعُ بْنُ سُلَيْمَانَ، أَنْبَأَ الشَّافِعِيُّ، أَنْبَأَ مُسْلِمُ بْنُ خَالِدٍ، عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ، عَنْ أَيُّوبَ بْنِ مُوسَى، عَنِ ابْنِ شِهَابٍ، وَعَنْ مَكْحُولٍ وَعَطَاءٍ قَالُوا:

أَدْرَكْنَا النَّاسَ عَلَى أَنَّ دِيَةَ الْمُسْلِمِ الْحُرِّ عَلَى عَهْدِ النَّبِيِّ ﷺ مِائَةٌ مِنَ الْإِبِلِ، فَقَوَّمَ عُمَرُ بْنُ الْخَطَّابِ ؓ تِلْكَ الدِّيَةَ عَلَى أَهْلِ الْقُرَى أَلْفَ دِينَارٍ أَوِ اثْنَيْ عَشَرَ أَلْفَ دِرْهَمٍ، وَدِيَةَ الْحُرَّةِ الْمُسْلِمَةِ إِذَا كَانَتْ مِنْ أَهْلِ الْقُرَى خَمْسَمِائَةِ دِينَارٍ أَوْ سِتَّةَ آلَافِ دِرْهَمٍ، فَإِذَا كَانَ الَّذِي أَصَابَهَا مِنَ الْأَعْرَابِ فَدِيَتُهَا خَمْسُونَ مِنَ الْإِبِلِ وَدِيَةُ الْأَعْرَابِيَّةِ إِذَا أَصَابَهَا الْأَعْرَابِيُّ خَمْسُونَ مِنَ الْإِبِلِ لَا يُكَلَّفُ الْأَعْرَابِيُّ الذَّهَبَ وَلَا الْوَرِقَ
