أَخْبَرَنَا ) أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثَنَا أَبُو الْعَبَّاسِ، أَنْبَأَ الرَّبِيعُ، أَنْبَأَ الشَّافِعِيُّ، أَنْبَأَ عَبْدُ الْوَهَّابِ عَنْ أَيُّوبَ بْنِ أَبِي تَمِيمَةَ، عَنْ مُحَمَّدِ بْنِ سِيرِينَ:

أَنَّ الْأَشْعَثَ بْنَ قَيْسٍ صَحِبَ رَجُلًا، فَرَأَى امْرَأَتَهُ فَأَعْجَبَتْهُ، فَتُوُفِّيَ فِي الطَّرِيقِ، فَخَطَبَهَا الْأَشْعَثُ بْنُ قَيْسٍ، فَأَبَتْ أَنْ تَتَزَوَّجَهُ إِلَّا عَلَى حُكْمِهَا، فَتَزَوَّجَهَا عَلَى حُكْمِهَا، ثُمَّ طَلَّقَهَا قَبْلَ أَنْ تَحْكُمَ، فَقَالَ: احْكُمِي. فَقَالَتْ: أُحَكِّمُ فُلَانًا وَفُلَانًا رَقِيقًا كَانُوا لِأَبِيهِ مِنْ تِلَادِهِ فَقَالَ: احْكُمِي غَيْرَ هَؤُلَاءِ فَأَبَتْ فَأَتَى عُمَرَ ؓ فَقَالَ: يَا أَمِيرَ الْمُؤْمِنِينَ عَجَزْتُ ثَلَاثَ مَرَّاتٍ، فَقَالَ: مَا هُنَّ ؟ قَالَ: عَشِقْتُ امْرَأَةً، قَالَ: هَذَا مَا لَمْ تَمْلِكْ، قَالَ: ثُمَّ تَزَوَّجْتُهَا عَلَى حُكْمِهَا ثُمَّ طَلَّقْتُهَا قَبْلَ أَنْ تَحْكُمَ. فَقَالَ عُمَرُ - ؓ: امْرَأَةٌ مِنَ الْمُسْلِمِينَ
