✧ The man marries a woman on the condition that the dower is according to her judgment

أَخْبَرَنَا ) أَبُو بَكْرِ بْنُ إِبْرَاهِيمَ الْأَرْدَسْتَانِيُّ، أَنْبَأَ أَبُو نَصْرٍ الْعِرَاقِيُّ، ثَنَا سُفْيَانُ الْجَوْهَرِيُّ، ثَنَا عَلِيُّ بْنُ الْحَسَنِ، ثَنَا عَبْدُ اللهِ بْنُ الْوَلِيدِ، ثَنَا سُفْيَانُ عَنْ أَيُّوبَ السَّخْتِيَانِيِّ، وَهِشَامٍ عَنِ ابْنِ سِيرِينَ:

أَنَّ الْأَشْعَثَ بْنَ قَيْسٍ تَزَوَّجَ امْرَأَةً عَشِقَهَا عَلَى حُكْمِهَا فَاحْتَكَمَتْ عَلَيْهِ مَمْلُوكَيْنِ لَهُ فَأَتَى عُمَرَ بْنَ الْخَطَّابِ ؓ فَقَالَ: عَشِقْتُ امْرَأَةً، قَالَ: ذَاكَ مِمَّا لَمْ تَمْلِكْ، قَالَ: جَعَلْتُ لَهَا حُكْمَهَا، قَالَ: حُكْمُهَا لَيْسَ بِشَيْءٍ لَهَا سُنَّةُ نِسَائِهَا
