  • Abū Bakr Aḥmad b. al-Ḥusayn al-Bayhaqī

machine translationEven though Sufyān al-Thawrī and Shuʿbah do not mention in it "from Abū Mūsā", because it is indicated in the hadith of Shuʿbah that both of them heard it at one and the same time, whereas those who narrated from Abū Isḥāq, from Abū Burdah, from Abū Mūsā heard it at different times. Yūnus b. Abī Isḥāq said: He narrated this from his father, and Yūnus met some of his father's shaykhs, so his hearing is early. Isrāʾīl also narrated it, and he is the most reliable of the students of Abū Isḥāq after Shuʿbah and al-Thawrī.

machine translationThe origin of this hadith is mursal, from Abū Burdah, from the Prophet ﷺ.

  • al-Tirmidhi

machine translationThe hadith of Abū Burdah from Abū Mūsā is, in my view, and God knows best, more sound (aṣaḥḥ).

  • Dāraquṭnī

machine translationMuḥammad b. al-Minhāl, al-Ḥusayn al-Marwazī and others narrated it from Yazīd b. Zurayʿ, from Shuʿbah, as mursal. The students of Shuʿbah likewise reported it from him this way, and this is the preserved (maḥfūẓ) version.

  • Dāraquṭnī

machine translationThe students of al-Thawrī also narrated it as mursal from al-Thawrī, among them Abū Nuʿaym and others.

  • al-Tirmidhi

machine translationThe narration of those who narrated from Abū Isḥāq, from Abū Burdah, from Abū Mūsā, from the Prophet ﷺ: "There is no marriage without a guardian" is in my view more sound (aṣaḥḥ), because they heard it from Abū Isḥāq at different times. Even though Shuʿbah and al-Thawrī were better memorizers and more reliable than all of those who narrated this hadith from Abū Isḥāq, the narration of those others is in my view more fitting and more sound, because Shuʿbah and al-Thawrī heard this hadith from Abū Isḥāq in a single session.

  • Ibn ʿAbd al-Barr

machine translationShuʿbah and al-Thawrī narrated this hadith from Abū Isḥāq, from Abū Burdah, from the Prophet ﷺ as mursal. Whoever accepts mursal reports is obliged to accept it; the mention of those among the scholars who accept them and use them as proof, and those who refuse to accept them, has already appeared at the beginning of this collection. As for the one who does not accept mursal reports, he too is obliged to accept this hadith of Abū Burdah, because those who narrated it as connected are people of memorization and reliability, and Isrāʾīl and those who followed him are memorizers (ḥuffāẓ), and the addition of a memorizer is accepted. This is an addition supported by sound principles. This hadith has also been narrated as musnad through Yazīd b. Zurayʿ from Shuʿbah, and through Bishr b. Manṣūr from al-Thawrī, but the sound report from both of them is that it is mursal.
