( أَخْبَرَنَا ) أَبُو عَبْدِ اللهِ الْحَافِظُ، ثَنَا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثَنَا يَحْيَى بْنُ أَبِي طَالِبٍ، ثَنَا يَزِيدُ بْنُ هَارُونَ، أَنَا دَاوُدُ بْنُ أَبِي هِنْدٍ، عَنِ الشَّعْبِيِّ، قَالَ:

أُتِيَ زِيَادٌ فِي رَجُلٍ تُوُفِّيَ، وَتَرَكَ عَمَّتَهُ وَخَالَتَهُ، فَقَالَ: هَلْ تَدْرُونَ كَيْفَ قَضَى عُمَرُ ؓ فِيهَا ؟ قَالُوا: لَا، فَقَالَ: وَاللهِ إِنِّي لَأَعْلَمُ النَّاسِ بِقَضَاءِ عُمَرَ فِيهَا، جَعَلَ الْعَمَّةَ بِمَنْزِلَةِ الْأَخِ، وَالْخَالَةَ بِمَنْزِلَةِ الْأُخْتِ، فَأَعْطَى الْعَمَّةَ الثُّلُثَيْنِ، وَالْخَالَةَ الثُّلُثَ
