حَدَّثَنَا الْحُسَيْنُ حَدَّثَنِي ابْنُ أَبِي الزِّنَادِ عَنْ عَبْدِ الرَّحْمَنِ يَعْنِي ابْنَ الْحَارِثِ أَخْبَرَنِي عَمْرُو بْنُ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ

أَنَّهُ سَمِعَ رَجُلًا مِنْ مُزَيْنَةَ سَأَلَ رَسُولَ اللهِ ﷺ مَاذَا تَقُولُ يَا رَسُولَ اللهِ، فِي ضَالَّةِ الْإِبِلِ ؟ فَقَالَ رَسُولُ اللهِ ﷺ: مَا لَكَ وَلَهَا ؟ مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا. قَالَ: فَضَالَّةُ الْغَنَمِ، قَالَ: لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ. قَالَ: فَمَنْ أَخَذَهَا مِنْ مَرْتَعِهَا ؟ قَالَ: عُوقِبَ وَغُرِّمَ مِثْلَ ثَمَنِهَا. وَمَنِ اسْتَطْلَقَهَا مِنْ عِقَالٍ أَوِ اسْتَخْرَجَهَا مِنْ حِفْشٍ، وَهِيَ الْمَظَالُّ فَعَلَيْهِ الْقَطْعُ. قَالَ: يَا رَسُولَ اللهِ، فَالثَّمَرُ يُصَابُ فِي أَكْمَامِهِ فَقَالَ رَسُولُ اللهِ ﷺ: لَيْسَ عَلَى آكِلٍ سَبِيلٌ، فَمَنِ اتَّخَذَ خُبْنَةً غُرِّمَ مِثْلَ ثَمَنِهَا وَعُوقِبَ، وَمَنْ أَخَذَ شَيْئًا مِنْهَا بَعْدَ أَنْ أَوَى إِلَى مِرْبَدٍ أَوْ كَسَرَ عَنْهَا بَابًا فَبَلَغَ مَا يَأْخُذُ ثَمَنَ الْمِجَنِّ فَعَلَيْهِ الْقَطْعُ. قَالَ: يَا رَسُولَ اللهِ، فَالْكَنْزُ نَجِدُهُ فِي الْخَرِبِ وَفِي الْآرَامِ ؟ فَقَالَ رَسُولُ اللهِ ﷺ: فِيهِ، وَفِي الرِّكَازِ الْخُمُسُ

✧ That he heard a man from Muzaynah ask the Messenger of Allah ﷺ: 'What do you say, O Messenger of Allah, about a stray camel?' The Messenger of Allah ﷺ said: 'What do you have to do with it? It has its own shoes and its own water-skin.' He said: 'What about a stray sheep?' He said: 'It is for you, or for your brother, or for the wolf.' He said: 'What about one who takes it from its pasture?' He said: 'He is punished and fined the like of its price. And whoever unties it from a hobble or takes it out of a pen – and that is the shelters – upon him is amputation.' He said: 'O Messenger of Allah, what about fruit found in its husks?' The Messenger of Allah ﷺ said: 'There is no way against one who eats. But whoever takes a pouch-full is fined the like of its price and punished. And whoever takes something from it after it has been gathered into an enclosure or breaks a door for it, and what he takes reaches the price of a shield, upon him is amputation.' He said: 'O Messenger of Allah, what about treasure we find in ruins and in ancient landmark piles?' The Messenger of Allah ﷺ said: 'In it, and in buried treasure, is one-fifth.'
