حَدَّثَنَا مُحَمَّدُ بْنُ مَيْمُونٍ الزَّعْفَرَانِيُّ قَالَ حَدَّثَنِي جَعْفَرٌ عَنْ أَبِيهِ عَنْ يَزِيدَ بْنِ هُرْمُزَ قَالَ
كَتَبَ نَجْدَةُ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ عَنْ خَمْسِ خِلَالٍ، فَقَالَ ابْنُ عَبَّاسٍ: إِنَّ النَّاسَ يَزْعُمُونَ أَنَّ ابْنَ عَبَّاسٍ يُكَاتِبُ الْحَرُورِيَّةَ، وَلَوْلَا أَنِّي أَخَافُ أَنْ أَكْتُمَ عِلْمِي لَمْ أَكْتُبْ إِلَيْهِ. كَتَبَ إِلَيْهِ نَجْدَةُ: أَمَّا بَعْدُ، فَأَخْبِرْنِي هَلْ كَانَ رَسُولُ اللهِ ﷺ يَغْزُو بِالنِّسَاءِ مَعَهُ ؟ وَهَلْ كَانَ يَضْرِبُ لَهُنَّ بِسَهْمٍ ؟ وَهَلْ كَانَ يَقْتُلُ الصِّبْيَانَ ؟ وَمَتَى يَنْقَضِي يُتْمُ الْيَتِيمِ ؟ وَأَخْبِرْنِي عَنِ الْخُمُسِ لِمَنْ هُوَ ؟ فَكَتَبَ إِلَيْهِ ابْنُ عَبَّاسٍ أَنَّ رَسُولَ اللهِ ﷺ قَدْ كَانَ يَغْزُو بِالنِّسَاءِ مَعَهُ، فَيُدَاوِينَ الْمَرْضَى، وَلَمْ يَكُنْ يَضْرِبُ لَهُنَّ بِسَهْمٍ، وَلَكِنَّهُ كَانَ يُحْذِيهِنَّ مِنَ الْغَنِيمَةِ، وَأَنَّ رَسُولَ اللهِ ﷺ لَمْ يَكُنْ يَقْتُلُ الصِّبْيَانَ، وَلَا تَقْتُلِ الصِّبْيَانَ إِلَّا أَنْ تَكُونَ تَعْلَمُ مَا عَلِمَ الْخَضِرُ مِنَ الصَّبِيِّ الَّذِي قَتَلَهُ، فَتَقْتُلَ الْكَافِرَ، وَتَدَعَ الْمُؤْمِنَ. وَكَتَبْتَ تَسْأَلُنِي عَنْ يُتْمِ الْيَتِيمِ مَتَى يَنْقَضِي ؟ وَلَعَمْرِي، إِنَّ الرَّجُلَ تَنْبُتُ لِحْيَتُهُ وَهُوَ ضَعِيفُ الْأَخْذِ لِنَفْسِهِ، فَإِذَا كَانَ يَأْخُذُ لِنَفْسِهِ مِنْ صَالِحِ مَا يَأْخُذُ النَّاسُ، فَقَدْ ذَهَبَ الْيُتْمُ. وَأَمَّا الْخُمُسُ، فَإِنَّا كُنَّا نَرَى أَنَّهُ لَنَا، فَأَبَى ذَلِكَ عَلَيْنَا قَوْمُنَا

✧ Najdah wrote to Ibn Abbas asking him about five matters. Ibn Abbas said: People claim that Ibn Abbas corresponds with the Haruriyyah, and were I not afraid of concealing my knowledge, I would not have written to him. Najdah wrote to him: Now then, inform me whether the Messenger of God ﷺ used to go on military expeditions with women accompanying him, and whether he used to assign them a share, and whether he used to kill children, and when does the orphanhood of an orphan end, and inform me about the fifth, to whom does it belong? So Ibn Abbas wrote to him: The Messenger of God ﷺ indeed used to go on military expeditions with women accompanying him; they would treat the sick, but he did not assign them a share; rather, he used to give them a gift from the spoils. And the Messenger of God ﷺ did not kill children, so do not kill children unless you know what al-Khidr knew about the boy he killed, so that you kill the disbeliever and spare the believer. And you wrote asking me about the orphanhood of an orphan, when does it end? By my life, a man’s beard may grow while he is still weak in taking for himself. When he can take for himself from what is good as people take, then orphanhood has gone. As for the fifth, we used to consider it to be ours, but our people refused that to us.
