حَدَّثَنَا عَبْدُ الْوَهَّابِ بْنُ عَطَاءٍ أَخْبَرَنَا جَرِيرُ بْنُ حَازِمٍ عَنْ قَيْسِ بْنِ سَعْدٍ عَنْ يَزِيدَ بْنِ هُرْمُزَأَنَّ نَجْدَةَ كَتَبَ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ عَنْ سَهْمِ ذِي الْقُرْبَى لِمَنْ هُوَ؟ وَعَنِ الْيَتِيمِ مَتَى يَنْقَضِي يُتْمُهُ؟ وَعَنِ الْمَرْأَةِ وَالْعَبْدِ يَشْهَدَانِ الْغَنِيمَةَ؟ وَعَنْ قَتْلِ أَطْفَالِ الْمُشْرِكِينَ؟ فَقَالَ ابْنُ عَبَّاسٍ لَوْلا أَنْ أَرُدَّهُ
أَنَّ نَجْدَةَ كَتَبَ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ عَنْ سَهْمِ ذِي الْقُرْبَى لِمَنْ هُوَ ؟ وَعَنِ الْيَتِيمِ مَتَى يَنْقَضِي يُتْمُهُ ؟ وَعَنِ الْمَرْأَةِ وَالْعَبْدِ يَشْهَدَانِ الْغَنِيمَةَ ؟ وَعَنْ قَتْلِ أَطْفَالِ الْمُشْرِكِينَ ؟ فَقَالَ ابْنُ عَبَّاسٍ: لَوْلَا أَنْ أَرُدَّهُ عَنْ شَيْءٍ يَقَعُ فِيهِ مَا أَجَبْتُهُ، وَكَتَبَ إِلَيْهِ إِنَّكَ كَتَبْتَ إِلَيَّ تَسْأَلُنِي عَنْ سَهْمِ ذِي الْقُرْبَى لِمَنْ هُوَ ؟ وَإِنَّا كُنَّا نَرَاهَا لِقَرَابَةِ رَسُولِ اللهِ ﷺ، فَأَبَى ذَلِكَ عَلَيْنَا قَوْمُنَا، وَعَنِ الْيَتِيمِ مَتَى يَنْقَضِي يُتْمُهُ ؟ قَالَ: إِذَا احْتَلَمَ وَأُونِسَ مِنْهُ خَيْرٌ، وَعَنِ الْمَرْأَةِ وَالْعَبْدِ يَشْهَدَانِ الْغَنِيمَةَ ؟ فَلَا شَيْءَ لَهُمَا، وَلَكِنَّهُمَا يُحْذَيَانِ وَيُعْطَيَانِ، وَعَنْ قَتْلِ أَطْفَالِ الْمُشْرِكِينَ ؟ فَإِنَّ رَسُولَ اللهِ ﷺ لَمْ يَقْتُلْهُمْ، وَأَنْتَ فَلَا تَقْتُلْهُمْ إِلَّا أَنْ تَعْلَمَ مِنْهُمْ مَا عَلِمَ الْخَضِرُ مِنَ الْغُلَامِ حِينَ قَتَلَهُ

✧ Najdah wrote to Ibn ʿAbbās asking him about the share of the near relatives, to whom is it? About the orphan, when does his orphanhood end? About the woman and the slave who attend the battle and witness the spoils? And about killing the children of the polytheists? Ibn ʿAbbās said: Were it not that I would be turning him away from something he might fall into, I would not have answered him. He wrote to him: You wrote to me asking about the share of the near relatives, to whom is it? We considered it for the relatives of the Messenger of Allah ﷺ, but our people refused that to us. As for the orphan, when does his orphanhood end? He said: When he reaches puberty and good is perceived from him. As for the woman and the slave who attend the battle, there is no share for them, but they are given a small portion. As for killing the children of the polytheists, the Messenger of Allah ﷺ did not kill them, and you should not kill them unless you know from them what al-Khiḍr knew about the boy when he killed him.
