حَدَّثَنَا عَبْدُ الرَّحْمَنِ حَدَّثَنَا سُفْيَانُ عَنْ عَلْقَمَةَ بْنِ مَرْثَدٍ عَنْ سُلَيْمَانَ بْنِ بُرَيْدَةَ عَنْ أَبِيهِ قَالَ

كَانَ رَسُولُ اللهِ ﷺ إِذَا أَمَّرَ أَمِيرًا عَلَى جَيْشٍ، أَوْ سَرِيَّةٍ أَوْصَاهُ فِي خَاصَّتِهِ بِتَقْوَى اللهِ، وَمَنْ مَعَهُ مِنَ الْمُسْلِمِينَ خَيْرًا، ثُمَّ قَالَ: اغْزُوا بِاسْمِ اللهِ فِي سَبِيلِ اللهِ، قَاتِلُوا مَنْ كَفَرَ بِاللهِ اغْزُوا، وَلَا تَغُلُّوا، وَلَا تَغْدِرُوا، وَلَا تُمَثِّلُوا، وَلَا تَقْتُلُوا وَلِيدًا، وَإِذَا لَقِيتَ عَدُوَّكَ مِنَ الْمُشْرِكِينَ، فَادْعُهُمْ إِلَى إِحْدَى ثَلَاثِ خِصَالٍ ( أَوْ خِلَالٍ ) فَأَيَّتُهُنَّ مَا أَجَابُوكَ إِلَيْهِ فَاقْبَلْ مِنْهُمْ، وَكُفَّ عَنْهُمُ؛ ادْعُهُمْ إِلَى الْإِسْلَامِ، فَإِنْ أَجَابُوكَ إِلَيْهِ فَاقْبَلْ مِنْهُمْ، وَكُفَّ عَنْهُمْ ثُمَّ ادْعُهُمْ إِلَى التَّحَوُّلِ مِنْ دَارِهِمْ إِلَى دَارِ الْمُهَاجِرِينَ، وَأَخْبِرْهُمْ أَنَّهُمْ إِنْ فَعَلُوا أَنَّ لَهُمْ مَا لِلْمُهَاجِرِينَ، وَعَلَيْهِمْ مَا عَلَى الْمُهَاجِرِينَ، وَإِنْ هُمْ أَبَوْا أَنْ يَتَحَوَّلُوا مِنْهَا، فَأَخْبِرْهُمْ أَنَّهُمْ يَكُونُونَ كَأَعْرَابِ الْمُسْلِمِينَ يَجْرِي عَلَيْهِمْ حُكْمُ اللهِ الَّذِي يَجْرِي عَلَى الْمُسْلِمِينَ، وَلَا يَكُونُ لَهُمْ فِي الْغَنِيمَةِ، وَالْفَيْءِ شَيْءٌ إِلَّا أَنْ يُجَاهِدُوا مَعَ الْمُسْلِمِينَ، فَإِنْ هُمْ أَبَوْا، فَسَلْهُمُ الْجِزْيَةَ، فَإِنْ هُمْ أَجَابُوكَ، فَاقْبَلْ مِنْهُمْ، وَكُفَّ عَنْهُمْ، وَإِنْ هُمْ أَبَوْا، فَاسْتَعِنْ بِاللهِ، وَقَاتِلْهُمْ، وَإِذَا حَاصَرْتَ أَهْلَ حِصْنٍ، فَأَرَادُوكَ أَنْ تَجْعَلَ لَهُمْ ذِمَّةَ اللهِ، وَذِمَّةَ نَبِيِّكَ، فَلَا تَجْعَلْ لَهُمْ ذِمَّةَ اللهِ، وَلَا ذِمَّةَ نَبِيِّهِ، وَلَكِنِ اجْعَلْ لَهُمْ ذِمَّتَكَ، وَذِمَّةَ أَبِيكَ، وَذِمَمَ أَصْحَابِكَ، فَإِنَّكُمْ أَنْ تُخْفِرُوا ذِمَمَكُمْ، وَذِمَمَ آبَائِكُمْ أَهْوَنُ مِنْ أَنْ تُخْفِرُوا ذِمَّةَ اللهِ، وَذِمَّةَ رَسُولِهِ، وَإِنْ حَاصَرْتَ أَهْلَ حِصْنٍ، فَأَرَادُوكَ أَنْ تُنْزِلَهُمْ عَلَى حُكْمِ اللهِ، فَلَا تُنْزِلْهُمْ عَلَى حُكْمِ اللهِ، وَلَكِنْ أَنْزِلْهُمْ عَلَى حُكْمِكَ، فَإِنَّكَ لَا تَدْرِي أَتُصِيبُ حُكْمَ اللهِ فِيهِمْ، أَمْ لَا

✧ When the Messenger of Allah ﷺ appointed a commander over an army or a raiding party, he would enjoin him personally to fear Allah, and to treat the Muslims with him well. Then he said: 'Raid in the name of Allah, in the path of Allah. Fight those who disbelieve in Allah. Raid, and do not steal from the spoils, do not act treacherously, do not mutilate, and do not kill a child. When you meet your enemy from the polytheists, call them to one of three options (or qualities); whichever they respond to, accept from them and refrain from them. Call them to Islam; if they respond, accept from them and refrain. Then call them to move from their land to the land of the emigrants, and tell them that if they do so, they will have what the emigrants have and owe what the emigrants owe. If they refuse to move, tell them they will be like the Bedouin Muslims: the ruling of Allah that applies to the Muslims will apply to them, and they will have no share in the spoils or the fay' unless they fight alongside the Muslims. If they refuse, ask them for the jizya; if they respond, accept from them and refrain. If they refuse, seek help from Allah and fight them. If you besiege the people of a fortress and they ask you to grant them the protection of Allah and the protection of your Prophet, do not grant them the protection of Allah or the protection of his Prophet, but grant them your protection, the protection of your father, and the protections of your companions; for if you violate your own protections and your fathers' protections, it is lighter than violating the protection of Allah and the protection of His Messenger. If you besiege the people of a fortress and they ask you to let them descend upon the judgment of Allah, do not let them descend upon the judgment of Allah, but let them descend upon your judgment; for you do not know whether you will attain the judgment of Allah concerning them or not.'
