✧ A Muslim dies leaving a Christian child

أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ: أَخْبَرَنَا مَعْمَرٌ، عَنْ أَيُّوبَ، عَنْ أَبِي قِلَابَةَ قَالَ:

نص إضافيكَتَبَ إِلَيْهِ: بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ، أَمَّا بَعْدُ، فَإِنَّكَ كَتَبْتَ إِلَيَّ أَنْ سَلْ يَزِيدَ بْنَ قَتَادَةَ عَمَّا أَمَرْتَنِي، وَإِنِّي سَأَلْتُهُ، فَقَالَ: تُوُفِّيَتْ أُمِّي نَصْرَانِيَّةً وَأَنَا مُسْلِمٌ، وَإِنَّهَا تَرَكَتْ ثَلَاثِينَ عَبْدًا وَوَلِيدَةً، وَمِائَتَيْ نَخْلَةٍ. فَرَكِبْنَا فِي ذَلِكَ إِلَى عُمَرَ بْنِ الْخَطَّابِ، فَقَضَى عُمَرُ أَنَّ مِيرَاثَهَا لِزَوْجِهَا وَلِابْنِ أَخِيهَا، وَهُمَا نَصْرَانِيَّانِ، وَلَمْ يُوَرِّثْنِي شَيْئًا. قَالَ يَزِيدُ بْنُ قَتَادَةَ: ثُمَّ تُوُفِّيَ جَدِّي وَهُوَ مُسْلِمٌ، كَانَ بَايَعَ النَّبِيَّ ﷺ، وَشَهِدَ مَعَهُ حُنَيْنًا، وَتَرَكَ ابْنَتَهُ. فَرَكِبْنَا فِي ذَلِكَ إِلَى عُثْمَانَ أَنَا وَابْنُ أَخِيهِ، وَابْنَتُهُ نَصْرَانِيَّةٌ، فَوَرَّثَنِي عُثْمَانُ مَالَهُ كُلَّهُ، وَلَمْ يُوَرِّثِ ابْنَتَهُ شَيْئًا. فَحُزْتُهُ عَامًا أَوِ اثْنَيْنِ، ثُمَّ أَسْلَمَتِ ابْنَتُهُ، فَرَكِبْنَا إِلَى عُثْمَانَ، فَسَأَلَ عَبْدَ اللهِ بْنَ الْأَرْقَمِ، فَقَالَ لَهُ: كَانَ عُمَرُ يَقْضِي: مَنْ أَسْلَمَ عَلَى مِيرَاثٍ قَبْلَ أَنْ يُقْسَمَ فَإِنَّ لَهُ مِيرَاثَهُ وَاجِبًا بِإِسْلَامِهِ، فَوَرَّثَهَا عُثْمَانُ كُلَّ ذَلِكَ، وَأَنَا شَاهِدٌ "

Translation

✧ He wrote to him: In the name of God, the Compassionate, the Merciful. To proceed: you wrote to me asking me to ask Yazid b. Qatadah about what you commanded me. I asked him, and he said: My mother died a Christian while I was a Muslim, and she left thirty slaves, a slave girl, and two hundred palm trees. We went with that matter to Umar b. al-Khattab, and Umar ruled that her inheritance belonged to her husband and her brother's son, both of whom were Christians, and he did not give me anything as an heir. Yazid b. Qatadah said: Then my grandfather died, and he was a Muslim who had pledged allegiance to the Prophet ﷺ and fought with him at Hunayn, and he left his daughter. So we—I and his brother's son—went with that matter to Uthman, while his daughter was a Christian. Uthman gave me all of his wealth as an heir and did not give his daughter anything. I held possession of it for a year or two, then his daughter embraced Islam. So we went to Uthman, and he asked Abdullah b. al-Arqam, who said to him: Umar used to rule that whoever embraced Islam regarding an inheritance before it was divided has his inheritance obligatory by his Islam. So Uthman gave her all of that as an heir, and I was present.
