أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ: أَخْبَرَنَا ابْنُ جُرَيْجٍ قَالَ: أَخْبَرَنِي عَمْرُو بْنُ دِينَارٍ قَالَ: سَمِعْتُ أَبَا الْمُنْذِرِ يَقُولُ:
إِنْ مَاتَ مُسْلِمٌ وَلَهُ وَلَدٌ..... مُسْلِمٌ وَكَافِرٌ، فَلَمْ يُقْسَمْ مِيرَاثُهُ حَتَّى أَسْلَمَ الْكَافِرُ، وَرِثَ مَعَ الْمُؤْمِنِ، وَرِثَا جَمِيعًا "، فَلَمْ يُعْجِبْنِي مَا قَالَ. وَقَالَ لِي قَائِلٌ: ذَلِكَ مِيرَاثُ أَهْلِ الْجَاهِلِيَّةِ، مَا أَدْرَكَ الْإِسْلَامَ، وَلَمْ يُقْسَمْ كَانَ عَلَى قَسْمِ الْإِسْلَامِ، قَالَ ابْنُ جُرَيْجٍ: وَأَقُولُ أَنَا: كَلَّا، وَقَعَتِ الْمَوَارِيثُ فِي الْإِسْلَامِ، وَغَيْرِي قَالَ ذَلِكَ
Translation

machine translationʿAbd al-Razzāq informed us, he said: Ibn Jurayj informed us, he said: ʿAmr b. Dīnār informed me, he said: I heard Abū al-Mundhir say:
✧ If a Muslim dies leaving a child... a Muslim and a disbeliever, and his inheritance is not divided until the disbeliever embraces Islam, he inherits together with the believer; they both inherit. But I did not like what he said. And someone said to me: That is the inheritance of the people of the Jahiliyyah. Whatever Islam came upon and was not divided is according to the division of Islam. Ibn Jurayj said: And I say: No, the inheritances came into effect in Islam, and someone other than me said that.
