✧ The polytheist coming to a Muslim without a treaty

عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ: أَخْبَرَنِي عَطَاءٌ الْخُرَاسَانِيُّ:

أَنَّ تُسْتَرَ كَانَتْ فِي صُلْحٍ فَكَفَرَ أَهْلُهَا فَغَزَاهُمُ الْمُهَاجِرُونَ، فَقَتَلُوهُمْ فَهَزَمُوهُمْ، فَسَبَوْهُمْ فَأَصَابَ الْمُسْلِمُونَ نِسَاءَهُمْ، حَتَّى وُلِدَ لَهُمْ أَوْلَادٌ مِنْهُمْ قَالَ: لَقَدْ رَأَيْتُ أَوْلَادَهُنَّ، كَانُوا مِنْ تِلْكَ الْوِلَادَةِ، فَأَمَرَ عُمَرُ بْنُ الْخَطَّابِ ؓ بِمَنْ سَبَى مِنْهُمْ فَرُدَّ فِيهَا عَلَى جِزْيَتِهِمْ، وَفَرَّقَ بَيْنَ سَادَتِهِمْ وَبَيْنَهُنَّ

Translation

✧ Tustar was in a peace treaty, but its people disbelieved. The Muhajirun raided them, killed them, defeated them, and took them captive. The Muslims took their women, and children were born to them from those women. He said, 'I saw their children from those births.' Umar b. al-Khattab ؓ ordered that anyone who had been taken captive from them be returned to them under their jizyah, and he separated them from their captors.
