✧ The polytheist coming to a Muslim without a treaty

عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنْ عُثْمَانَ الْجَزَرِيِّ، عَنْ مِقْسَمٍ

أَنَّ النَّبِيَّ ﷺ لَمَّا صَالَحَ أَهْلَ خَيْبَرَ صَالَحَهُمْ عَلَى أَنَّ لَهُ أَمْوَالَهُمْ، وَأَنَّهُمْ آمِنُونَ عَلَى دِمَائِهِمْ، وَذَرَارِيِّهِمْ، وَنِسَائِهِمْ، فَدَعَا النَّبِيُّ ﷺ ابْنَيْ أَبِي الْحُقَيْقِ فَقَالَ: " أَيْنَ الْمَالُ الَّذِي خَرَجْتُمَا بِهِ مِنَ النَّضِيرِ ؟ " قَالَا: اسْتَنْفَقْنَاهُ، وَهَلَكَ قَالَ: " أَفَرَأَيْتُمَا إِنْ كُنْتُمَا كَاذِبَيْنِ فَقَدْ حَلَّتْ لِي دِمَاؤُكُمَا، وَأَمْوَالُكُمَا، وَنِسَاؤُكُمَا ؟ " قَالَا: نَعَمْ، وَأَشْهَدَ عَلَيْهِمَا فَقَالَ: " إِنَّكُمَا قَدْ خَبَّأْتُمَاهُ فِي مَكَانِ كَذَا وَكَذَا " فَأَرْسَلَ مَعَهُمَا فَوَجَدَ النَّبِيُّ ﷺ الْمَالَ كَمَا ذَكَرَ، فَضَرَبَ أَعْنَاقَهُمَا، وَأَخَذَ أَمْوَالَهُمَا، وَسَبَى نِسَاءَهُمَا، وَكَانَتْ صَفِيَّةُ تَحْتَ أَحَدِهِمَا

Translation

✧ When the Prophet ﷺ made peace with the people of Khaybar, he made peace with them on condition that he would have their property, and that they would be safe regarding their blood, their offspring, and their women. The Prophet ﷺ called the two sons of Abu al-Huqayq and said, 'Where is the wealth that you two brought out from the Banu al-Nadir?' They said, 'We spent it, and it is gone.' He said, 'Do you think if you two are lying, then your blood, your property, and your women become lawful to me?' They said, 'Yes.' And he made them testify to that. Then he said, 'You two have hidden it in such-and-such a place.' He sent someone with them, and the Prophet ﷺ found the wealth as he had described. So he struck their necks, took their property, and took their women captive. Safiyyah was the wife of one of them.
