✧ The polytheist coming to a Muslim without a treaty

عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ:

سُئِلَ عَطَاءٌ عَنِ الرَّجُلِ مِنْ أَهْلِ الذِّمَّةِ يُؤْخَذُ فِي أَهْلِ الشِّرْكِ، وَقَدِ اشْتَرَطَ عَلَيْهِمْ أَنْ لَا يَأْتِيَهُمْ، فَيَقُولُ: لَمْ أُرِدْ عَوْنَهُمْ، فَكَرِهَ قَتْلَهُ إِلَّا بِبَيِّنَةٍ فَقَالَ لَهُ بَعْضُ أَهْلِ الْعِلْمِ: " إِذَا نَقَضَ شَيْئًا وَاحِدًا مِمَّا عَلَيْهِ فَقَدْ نَقَضَ الصُّلْحَ

Translation

✧ Ata was asked about a man from the people of the covenant (dhimmah) who is captured among the polytheists, though the condition had been imposed on them that he should not come to them. He says, 'I did not intend to help them.' Ata disliked killing him except with clear evidence. One of the people of knowledge said to him, 'If he violates any one thing of what is upon him, he has broken the treaty.'
