عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ: أَخْبَرَنِي أَبُو بَكْرِ بْنُ عَبْدِ اللهِ، عَنْ مُحَمَّدِ بْنِ عَمْرِو بْنِ يَحْيَى بْنِ عَبْدِ الرَّحْمَنِ، عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ، وَعَنْ عَمْرِو بْنِ سُلَيْمٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، وَعَنْ أَبِي النَّضْرِ، عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ أَنَّهُمْ قَالُوا
فِي الرَّجُلِ مِنْ أَهْلِ الْحَرْبِ يَدْخُلُ بِأَمَانٍ فَيَهْلِكُ بَعْضُ أَوْلِيَائِهِ فِي النَّسَبِ الَّذِي هُوَ وَارِثُهُ، إِنْ كَانَ أَظْهَرَ السُّكُونَ فِي الْعَرَبِ، قَبْلَ أَنْ يَمُوتَ فَلَهُ مِيرَاثُهُ، وَإِلَّا فَلَا، وَقَالُوا فِي الْمَرْأَةِ مِنْ أَهْلِ الْكِتَابِ مِنْ أَهْلِ الْحَرْبِ تَدْخُلُ أَرْضَ الْعَرَبِ بِأَمَانٍ إِذَا أَظْهَرَتِ السُّكُونَ فِي أَرْضِ الْعَرَبِ فَلَا بَأْسَ أَنْ يَنْكِحَهَا الْمُسْلِمُونَ، وَإِنْ لَمْ تُظْهِرْ ذَلِكَ إِلَّا عِنْدَ الْخِطْبَةِ فَلَا تُنْكَحُ
Translation
✧ Regarding a man from the people of war who enters with a guarantee of safety, and then some of his relatives in the lineage of which he is an heir die: if he had demonstrated residence among the Arabs before the relative died, then he has inheritance; otherwise, no. They said regarding a woman from the People of the Book, from the people of war, who enters the land of the Arabs with a guarantee of safety: if she demonstrates residence in the land of the Arabs, there is no harm in Muslims marrying her; but if she only shows that at the time of the proposal, she is not to be married.
