عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَمْرِو بْنِ دِينَارٍ قَالَ:
لَا بَأْسَ بِنَزْعِ الْمَيْسِ، وَالصَّغَابَيْسِ، وَالسِّوَاكِ مِنَ الْبَشَامَةِ فِي الْحَرَمِ " قَالَ: لَا نَرَاهُ أَرَادَ بِقَوْلِهِ: لَا يُخْتَلَى خَلَاهَا إِلَّا لِلْمَاشِيَةِ. قَالَ عَمْرٌو: " وَبِوَرَقِ السَّنَا لِلْمَشِيِّ، وَلَعَمْرِي لَئِنْ كَانَ مِنْ أَصْلِهِ أَبْلَغَ لَيُنْتَزَعَنَّ كَمَا تُنْتَزَعُ مِنْهُ الصَّغَابَيْسُ وَالنُّهَيْسُ، وَأَمَّا التِّجَارَةُ فَلَا
Translation
✧ There is no harm in pulling out the mays tree, the young palm shoots, and the siwak from the bashama tree in the Haram." He said: We do not think that by his saying 'its fresh herbage is not to be cut' he meant anything except for grazing animals. ʿAmr said: "And the leaves of senna for walking; and by my life, if it is more effective from its root, it will be pulled out just as young palm shoots and the nahīs are pulled out from it. As for trade, then no."
