عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ عُيَيْنَةَ، عَنِ ابْنِ شُبْرُمَةَ قَالَ:
سَأَلْتُ عَامِرًا الشَّعْبِيَّ عَنْ رَجُلٍ أَشَارَ إِلَى صَيْدٍ وَهُوَ مُحْرِمٌ فَقَتَلَهُ، فَقَالَ: " عَلَى كُلِّ وَاحِدٍ مِنْهُمَا عِدْلٌ "، قَالَ: قُلْتُ لَهُ: فَإِنَّ حَمَّادًا قَالَ: فَإِنَّ كَفَّارَةً وَاحِدَةً تُجْزِيهِمَا، قَالَ: " تَاللهِ ؟ " قَالَ: قُلْتُ: نَعَمْ، قَالَ: " لَئِنْ كَانَ قَالَهُ لَقَدْ جُنَّ "، قَالَ: فَأَتَيْتُ الْحَارِثَ الْعُكْلِيَّ فَحَدَّثْتُهُ بِحَدِيثِهِمَا، وَكَانَ أَحَبَّ الْقَوْمِ إِلَيَّ أَنْ يُوافِقَنِي، فَقَالَ لِي: الْقَوْلُ قَوْلُ عَامِرٍ أَلَا تَرَى أَنَّهُ إِذَا قَتَلَ نَفَرٌ رَجُلًا كَانَ عَلَى كُلِّ وَاحِدٍ مِنْهُمْ كَفَّارَةٌ، قَالَ: قُلْتُ: هَذَا الْقَوْلُ قَوْلُ حَمَّادٍ، أَلَا تَرَى أَنَّهَا تَكُونُ عَلَيْهِمْ دِيَةٌ وَاحِدَةٌ
Translation
✧ I asked Amir al-Sha'bi about a man who pointed to game while he was in a state of ihram, and someone killed it. He said: "Each one of the two owes a compensation." He (the narrator) said: I said to him: But Hammad said that a single expiation suffices for both of them. He said: "By Allah?" He said: I said: Yes. He said: "If he said that, he has gone mad." He said: Then I went to al-Harith al-Ukli and told him their statements, and he was the one among the people whose agreement I most loved. He said to me: The correct saying is that of Amir. Do you not see that if a group kills a man, each one of them owes an expiation? He (the narrator) said: I said: This saying is the saying of Hammad. Do you not see that they owe a single blood-money?
