عَبْدُ الرَّزَّاقِ، عَنْ حُمَيْدِ بْنِ رُوَيْمَانَ - رَجُلٍ مِنْ أَهْلِ الشَّامِ - عَنِ الْحَجَّاجِ بْنِ أَرْطَاةَ، عَنْ عَبْدِ الْمَلِكِ بْنِ الْمُغِيرَةِ الطَّائِفِيِّ، عَنْ عَبْدِ اللهِ بْنِ الْمِقْدَامِ، عَنْ عَمْرِو بْنِ الْحَبَشِيِّ، قَالَ:
كُنْتُ عِنْدَ ابْنِ عَبَّاسٍ فَجَاءَتِ امْرَأَةٌ، وَقَالَتْ: أَشَرْتُ إِلَى أَرْنَبٍ فَرَمَاهَا الْكَرِيُّ، فَقَالَ ابْنُ عَبَّاسٍ ﴿يَحْكُمُ بِهِ ذَوَا عَدْلٍ مِنْكُمْ ﴾قَالَ: فَقُلْتُ لِلْمَرْأَةِ: قُولِي: احْكُمْ أَنْتَ، فَقَالَتْ لَهُ، فَقَالَ: لَا بُدَّ مِنْ آخَرَ مَعِي، فَقُلْتُ لَهَا: قُولِي لَهُ: اخْتَرْ مَنْ شِئْتَ، فَوَضَعَ يَدَهُ عَلَيَّ وَقَالَ: مَنْ هَذَا ؟ قُلْتُ: عَمْرُو بْنُ حَبَشِيٍّ، قَالَ: أَفْتِنَا فِي دَابَّةٍ تَرْعَى الشَّجَرَ، وَتَشْرَبُ الْمَاءَ فِي كِرْشٍ لَمْ تُثْغِرْ، قَالَ: فَقُلْتُ: " تِلْكَ عِنْدَنَا الْفَطِيمَةُ، وَالتَّوَّالَةُ، وَالْجَذَعَةُ، فَقَالَ لَهَا: " اخْتَارِي مِنْ هَؤُلَاءِ إِنْ شِئْتِ " قَالَتْ: إِنِّي أَجِدُ مِنْ ذَلِكَ أَكْثَرَ، قَالَ: " فَأَمْلِقِي مَا شِئْتِ "
Translation
✧ I was with Ibn Abbas when a woman came and said: I pointed to a rabbit, and the hirer threw at it. Ibn Abbas said: "Two just men from among you shall judge concerning it." He (the narrator) said: I said to the woman: Say: You judge. So she said that to him. He said: "There must be another with me." I said to her: Say to him: Choose whomever you wish. So he placed his hand on me and said: "Who is this?" I said: Amr b. Habashi. He said: "Give us a verdict concerning an animal that grazes on trees and drinks water into a stomach that has not yet teethed." He (the narrator) said: I said: "That, in our view, is the weaned young, the female that follows (its mother), and the one in its second year." So he said to her: "Choose from these if you wish." She said: I find more than that. He said: "Then give whatever you wish."
