عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ قَالَ:
فِي كَبِيرٍ وَصَغِيرٍ قَتَلَا رَجُلًا قَالَ: " لَا يُقْتَلُ وَاحِدٌ مِنْهُمَا لِأَنَّهُ لَا يَدْرِي أَيُّهُمَا الَّذِي أَجَازَ عَلَيْهِ، وَعَلَيْهِمَا الدِّيَةُ حِصَّةُ الصَّغِيرِ عَلَى الْعَاقِلَةِ، وَحِصَّةُ الْآخَرِ فِي مَالِهِ
