There is no partnership of equal shares (mufāwaḍah) until the two are equal in property and until they mix their properties together. Neither mufāwaḍah nor ordinary partnership is made with goods, with this one bringing a good and that one bringing a good, unless there is between them a slave, a house, gold or silver, and they mix it and enter into mufāwaḍah over it, and over everything. That is mufāwaḍah. And if there were dinars or dirhams between them, it would not be mufāwaḍah until they mix them. And whatever debt one of the two partners incurs, saying: "I have incurred such and such a debt," he is believed concerning his partner, and if one of them dies, the other takes it. And if the creditor wishes, he may take either of them to whom he sold his goods; the buyer may take whichever of them he wishes. Mufāwaḍah is not for a man to say: "Whatever you and I buy of anything is between me and you," without their mixing anything. In that case, if one of them claims that he bought something, he is asked for proof that he bought it on behalf of his partner, when... on behalf of his partner, and if he wishes he may leave him.
