عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنْ صَالِحِ بْنِ كَيْسَانَ، عَنْ نَافِعِ بْنِ جُبَيْرِ بْنِ مُطْعِمٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ رَسُولَ اللهِ ﷺ قَالَ:
لَيْسَ لِلْوَلِيِّ مَعَ الثَّيِّبِ أَمْرٌ، وَالْيَتِيمَةُ تُسْتَأْمَرُ فَصَمْتُهَا إِقْرَارُهَا
Translation
✧ The guardian has no authority over a previously married woman, but the orphan girl is consulted, and her silence is her consent.
