machine translationHe said: On this topic there is also a report from ʿAbdullāh b. ʿAmr. Abū Hishām al-Rifāʿī narrated to us: Ibn Abī Zāʾidah and Abū Khālid al-Aḥmar informed us, from al-Ḥajjāj b. Arṭāh, similar to it. Abū ʿĪsā said: We do not know the ḥadīth of Ibn Masʿūd as raised to the Prophet (marfūʿ) except through this route. It has been narrated from ʿAbdullāh as his own statement (mawqūf). Some of the people of knowledge held this view, and it is the saying of Aḥmad and Isḥāq. The people of knowledge are agreed that the blood money (diyah) is taken over three years, with a third of the diyah in each year, and they held that the diyah for accidental killing falls upon the ʿāqilah (the paternal kin responsible for paying). Some of them held that the ʿāqilah are the man's relatives on his father's side, and this is the saying of Mālik and al-Shāfiʿī. Some of them said: The diyah is only upon the men, not the women and children, of the paternal kin (ʿaṣabah); each man of them is made to bear a quarter of a dinar. Some of them said up to half a dinar. If the diyah is completed, well and good; otherwise the nearest tribes to them are considered and are obliged with that.

What scholars said about it

In their own words, as Hadith Unlocked records them. They are shown, not summarised into a grade.

  • Dāraquṭnī

إسناد حسن أي الموقوف وضعف الأول أي المرفوع من أوجه عديدة

machine translationThe chain is good (ḥasan), meaning the mawqūf report, and the first, meaning the marfūʿ report, is weak (ḍaʿīf) through many routes.

  • Abū Bakr Aḥmad b. al-Ḥusayn al-Bayhaqī

وتعقبه بأن الدارقطني وهم فيه والجواد قد يعثر

machine translationHe objected to it, saying that al-Dāraquṭnī erred in it, and even the noble steed may stumble.

machine translationZayd b. Jubayr narrates it from Khashf b. Mālik; al-Ḥajjāj b. Arṭāh was alone in transmitting it. There is disagreement from al-Ḥajjāj regarding his ḥadīth. Abū Muʿāwiyah al-Ḍarīr, Ḥafṣ b. Ghiyāth and Abū Khālid al-Aḥmar narrated it from al-Ḥajjāj, from Zayd b. Jubayr, from Khashf b. Mālik, from ʿAbdullāh, that the Messenger of Allah ﷺ set the diyah for accidental killing in fifths; they did not add to this. ʿAbd al-Raḥīm b. Sulaymān, ʿAbd al-Wāḥid b. Ziyād and Yaḥyā b. Abī Zāʾidah narrated it from al-Ḥajjāj and added from him the explanation of that from the Prophet ﷺ: twenty ḥiqqah, twenty jadhaʿah, twenty bint makhāḍ, twenty ibn makhāḍ and twenty bint labūn. This is not known from the Prophet ﷺ except in this ḥadīth of Khashf. Khashf has a second ḥadīth from ʿAbdullāh, and he has nothing else. Yaḥyā b. Saʿīd al-Umawī narrated this ḥadīth from al-Ḥajjāj and differed regarding the mention of the ages of the camels taken in the diyah.
