حَدَّثَنَا أَبُو دَاوُدَ، قَالَ: حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، وَقَيْسُ بْنُ الرَّبِيعِ، وَأَبُو عَوَانَةَ - كُلُّهُمْ - عَنْ سِمَاكِ بْنِ حَرْبٍ، عَنْ حَنَشِ بْنِ الْمُعْتَمِرِ الْكِنَانِيِّ، حَدَّثَنَا عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ، قَالَ:
لَمَّا بَعَثَنِي رَسُولُ اللهِ ﷺ إِلَى الْيَمَنِ حَفَرَ قَوْمٌ زُبْيَةً لِلْأَسَدِ، فَازْدَحَمَ النَّاسُ عَلَى الزُّبْيَةِ، وَوَقَعَ فِيهَا الْأَسَدُ، فَوَقَعَ فِيهَا رَجُلٌ، وَتَعَلَّقَ الرَّجُلُ بِرَجُلٍ، وَتَعَلَّقَ الْآخَرُ بِالْآخَرِ، حَتَّى صَارُوا أَرْبَعَةً، فَجَرَحَهُمُ الْأَسَدُ فِيهَا فَهَلَكُوا، وَحَمَلَ الْقَوْمُ السِّلَاحَ، فَكَادُوا أَنْ يَكُونَ بَيْنَهُمْ قِتَالٌ، قَالَ: فَأَتَيْتُهُمْ فَقُلْتُ: أَتَقْتُلُونَ مِائَتَيْ رَجُلٍ مِنْ أَجْلِ أَرْبَعَةِ أُنَاسٍ ؟ تَعَالَوْا أَقْضِ بَيْنَكُمْ بِقَضَاءٍ، فَإِنْ رَضِيتُمُوهُ فَهُوَ قَضَاءٌ بَيْنَكُمْ، وَإِنْ أَبَيْتُمْ رَفَعْتُمْ إِلَى رَسُولِ اللهِ ﷺ فَهُوَ أَحَقُّ بِالْقَضَاءِ، قَالَ: فَجَعَلَ لِلْأَوَّلِ رُبُعَ الدِّيَةِ، وَجَعَلَ لِلثَّانِي ثُلُثَ الدِّيَةِ، وَجَعَلَ لِلثَّالِثِ نِصْفَ الدِّيَةِ، وَجَعَلَ لِلرَّابِعِ الدِّيَةَ، وَجَعَلَ الدِّيَاتِ عَلَى مَنْ حَضَرَ الزُّبْيَةَ، عَلَى الْقَبَائِلِ الْأَرْبَعَةِ، فَسَخِطَ بَعْضُهُمْ وَرَضِيَ بَعْضُهُمْ، ثُمَّ قَدِمُوا عَلَى رَسُولِ اللهِ ﷺ فَقَصُّوا عَلَيْهِ الْقِصَّةَ، فَقَالَ: " أَنَا أَقْضِي بَيْنَكُمْ "، فَقَالَ قَائِلٌ: فَإِنَّ عَلِيًّا قَدْ قَضَى بَيْنَنَا، فَأَخْبَرُوهُ بِمَا قَضَى عَلِيٌّ، فَقَالَ رَسُولُ اللهِ ﷺ: الْقَضَاءُ كَمَا قَضَى عَلِيٌّ

✧ When the Messenger of Allah ﷺ sent me to Yemen, some people dug a pit for a lion. People crowded around the pit, and the lion fell into it. A man fell in after it, and he grabbed hold of another man, and the other grabbed hold of yet another, until they became four. The lion mauled them in the pit and they died. The people took up arms and nearly fought among themselves. He said: I went to them and said: 'Would you kill two hundred men because of four people? Come, let me judge among you with a ruling. If you accept it, it will be a judgment between you, and if you refuse, you may take it up to the Messenger of Allah ﷺ, and he is more entitled to judge.' He said: He gave the first man a quarter of the blood money, the second a third, the third a half, and the fourth the full blood money. He made the blood moneys payable by those who were present at the pit, upon the four tribes. Some of them were displeased and some were pleased. Then they came to the Messenger of Allah ﷺ and told him the story, and he said: 'I will judge between you.' A man said: 'But 'Ali has already judged between us.' They told him what 'Ali had ruled, and the Messenger of Allah ﷺ said: 'The ruling is as 'Ali ruled.'
