حَدَّثَنَا جَعْفَرُ بْنُ مُحَمَّدٍ الْقَلَانِسِيُّ ثنا آدَمُ ثنا شُعْبَةُ ح وَحَدَّثَنَا أَبُو خَلِيفَةَ الْفَضْلُ بْنُ الْحُبَابِ ثنا أَبُو مَعْمَرٍ الْمُقْعَدُ ثنا عَبْدُ الْوَارِثِ بْنُ سَعِيدٍ حَدَّثَنِي شُعْبَةُ أَخْبَرَنِي عَبْدُ الرَّحْمَنِ بْنُ ثَرْوَانَ عَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ أَنَّ أَبَا مُوسَى سُئِلَ عَنْ بِنْتٍ وَبِنْتِ ابْنٍ وَأُخْتٍ فَقَالَ
لِلِابْنَةِ النِّصْفُ وَلِلْأُخْتِ النِّصْفُ وَلَمْ يَجْعَلْ لِابْنَةِ الِابْنِ شَيْئًا وَقَالَ سَلُوا ابْنَ مَسْعُودٍ؛ فَإِنَّهُ يُتَابِعُنِي فَسَأَلُوا ابْنَ مَسْعُودٍ وَأَخْبَرَهُ بِقَوْلِ الْأَشْعَرِيِّ فَقَالَ قَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ أَقْضِي بَيْنَكُمْ بِقَضَاءِ رَسُولِ اللهِ ﷺ قَالَ رَسُولُ اللهِ ﷺ «لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ وَلِلْأُخْتِ الثُّلُثُ» فَبَلَغَ الْأَشْعَرِيَّ فَقَالَ لَا تَسْأَلُونِي عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ

✧ To the daughter one half and to the sister one half, and he did not assign anything to the son's daughter. He said, 'Ask Ibn Masʿud, for he will agree with me.' So they asked Ibn Masʿud and informed him of al-Ashʿari's statement. He said, 'Then I have gone astray and I am not among the rightly guided. I judge among you by the ruling of the Messenger of Allah ﷺ. The Messenger of Allah ﷺ said, "To the daughter one half, to the son's daughter one sixth, and to the sister one third."' This reached al-Ashʿari, and he said, 'Do not ask me about anything as long as this learned man is among you.'
