حَدَّثَنَا بِشْرُ بْنُ مُوسَى ثنا خَلَفُ بْنُ الْوَلِيدِ ثنا إِسْرَائِيلُ عَنْ أَبِي إِسْحَاقَ عَنِ الْحَارِثِ عَنْ عَلِيٍّ أَنَّهُ أُتِيَ فِي فَرِيضَةِ ابْنَيْ عَمٍّ أَحَدُهُمَا أَخٌ لِأُمٍّ فَقَالُوا أَعْطَاهُ ابْنُ مَسْعُودٍ الْمَالَ كُلَّهُ فَقَالَ

«يَرْحَمُ اللهُ ابْنَ مَسْعُودٍ إِنْ كَانَ لَفَقِيهًا لَكِنِّي أُعْطِيهِ سَهْمَ الْأَخِ مِنَ الْأُمِّ مِنْ قِبَلِ أُمِّهِ ثُمَّ أَقْسِمُ الْمَالَ بَيْنَهُمَا»

Translation

✧ “May God have mercy on Ibn Masʿud. He was indeed a jurist, but I will give him the share of a maternal brother on account of his mother, then divide the property between them.”
