حَدَّثَنَا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ الْبَغَوِيُّ ثنا عَلِيُّ بْنُ الْجَعْدِ ثنا عَبْدُ الْعَزِيزِ بْنُ أَبِي سَلَمَةَ الْمَاجِشُونَ عَنِ ابْنِ شِهَابٍ عَنْ سَهْلِ بْنِ سَعْدٍ قَالَ جَاءَ رَجُلٌ مِنْ بَنِي الْعَجْلَانِ إِلَى عَاصِمِ بْنِ عَدِيٍّ فَقَالَ

يَا عَاصِمُ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ سَلْ لِي رَسُولَ اللهِ ﷺ فَكَرِهَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللهِ ﷺ؟ فَقَالَ عَاصِمٌ قَدْ كَرِهَ رَسُولُ اللهِ ﷺ الْمَسْأَلَةَ الَّتِي سَأَلْتَ عَنْهَا فَأَقْبَلَ عُوَيْمِرٌ حَتَّى سَأَلَ رَسُولَ اللهِ ﷺ فِي وَسَطِ النَّاسِ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ قَالَ «قَدْ نَزَلَ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَائْتِ بِهَا» قَالَ سَهْلٌ فَتَلَاعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللهِ ﷺ فَلَمَّا فَرَغَا مِنْ تَلَاعُنِهِمَا قَالَ يَا رَسُولَ اللهِ كَذَبْتُ عَلَيْهَا إِنْ أَمْسَكْتُهَا قَالَ فَطَلَّقَهَا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللهِ ﷺ بِطَلَاقِهَا وَكَانَ فِرَاقُهُ إِيَّاهَا سُنَّةً بَيْنَ الْمُتَلَاعِنَيْنِ

✧ O ‘Āṣim, what do you think about a man who finds another man with his wife—should he kill him and then you would kill him, or what should he do? Ask the Messenger of God ﷺ for me. The Messenger of God ﷺ disliked such questions and criticized them, until what ‘Āṣim heard from the Messenger of God ﷺ weighed heavily on him. When ‘Āṣim returned to his family, ‘Uwaymir came and said, “O ‘Āṣim, what did the Messenger of God ﷺ say to you?” ‘Āṣim replied, “The Messenger of God ﷺ disliked the question you asked about.” So ‘Uwaymir went and asked the Messenger of God ﷺ in the midst of the people, saying, “O Messenger of God, what do you think about a man who finds another man with his wife—should he kill him and then you would kill him, or what should he do?” The Prophet ﷺ said, “Something has been revealed concerning you and your wife, so go and bring her.” Sahl said, “So they performed li‘ān while I was among the people with the Messenger of God ﷺ. When they finished their mutual cursing, ‘Uwaymir said, ‘O Messenger of God, I have lied against her if I keep her.’ So he divorced her before the Messenger of God ﷺ commanded him to divorce her, and his separation from her became the sunnah between the two who perform li‘ān.”
