حَدَّثَنَا أَحْمَدُ بْنُ إِبْرَاهِيمَ بْنِ عَنْبَرٍ الْبَصْرِيُّ ثنا أَبُو الرَّبِيعِ الزَّهْرَانِيُّ ثنا فُلَيْحُ بْنُ سُلَيْمَانَ عَنِ الزُّهْرِيِّ عَنْ سَهْلِ بْنِ سَعْدٍ السَّاعِدِيِّ

أَنَّ رَجُلًا أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا رَأَى مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ بِهِ أَمْ كَيْفَ يَفْعَلُ بِهِ؟ فَأَنْزَلَ اللهُ ﷻ فِيهِمَا مَا ذُكِرَ فِي الْقُرْآنِ مِنَ التَّلَاعُنِ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ «قَدْ قُضِيَ فِيكَ وَفِي امْرَأَتِكَ» قَالَ فَتَلَاعَنَا وَأَنَا شَاهِدٌ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنْ أَمْسَكْتُهَا فَقَدْ كَذَبْتُ عَلَيْهَا فَفَارَقَهَا فَجَرَتِ السُّنَّةُ بَعْدُ فِيهِمَا أَنْ يُفَرَّقَ بَيْنَ الْمُتَلَاعِنَيْنِ وَكَانَتْ حَامِلًا فَأَنْكَرَ حَمْلَهَا وَكَانَ يُدْعَى إِلَيْهَا وَجَرَتِ السُّنَّةُ بَعْدُ فِي الْمِيرَاثِ أَنْ يَرِثَهَا فَتَرِثَ مِنْهُ مَا فَرَضَ اللهُ لَهَا

✧ A man came to the Messenger of God ﷺ and said, “O Messenger of God, what do you think about a man who sees another man with his wife—should he kill him, and then you would kill him in retribution, or what should he do?” Then God, exalted is He, revealed concerning them what is mentioned in the Qur’an about mutual cursing. The Messenger of God ﷺ said to him, “Judgment has been passed regarding you and your wife.” He said, “So they performed li‘ān while I was present with the Messenger of God ﷺ.” Then he said, “O Messenger of God, if I keep her, I will have lied against her.” So he separated from her. Thus the sunnah was established thereafter that the two who perform li‘ān are to be separated. She was pregnant, and he denied the pregnancy, though the child was attributed to her. The sunnah was also established thereafter concerning inheritance: that she inherits from him and he inherits from her whatever God has ordained for her.
