حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْحَضْرَمِيُّ ثنا مَحْفُوظُ بْنُ نَصْرٍ الْهَمْدَانِيُّ ثنا عَمْرُو بْنُ شِمْرٍ عَنْ جَابِرٍ قَالَ سَمِعْتُ سَالِمَ بْنَ عَبْدِ اللهِ وَأَبَانَ بْنَ حَسَنٍ يَذْكُرُونَ أَنَّ عُثْمَانَ بْنَ عَفَّانَ ؓ أُتِيَ بِرَجُلٍ قَدْ فَجَرَ بِغُلَامٍ مِنْ قُرَيْشٍ مَعْرُوفِ النَّسَبِ فَقَالَ

عُثْمَانُ وَيْحَكُمْ أَيْنَ الشُّهُودُ أُحْصِنَ؟ قَالُوا قَدْ تَزَوَّجَ بِامْرَأَةٍ وَلَمْ يَدْخُلْ بِهَا بَعْدُ فَقَالَ عَلِيٌّ لِعُثْمَانَ ؓ لَوْ دَخَلَ بِهَا لَحَلَّ عَلَيْهِ الرَّجْمُ فَأَمَّا إِذْ لَمْ يَدْخُلْ بِأَهْلِهِ فَاجْلِدْهُ الْحَدَّ فَقَالَ أَبُو أَيُّوبَ أَشْهَدُ إِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ الَّذِي ذَكَرَ أَبُو الْحَسَنِ فَأَمَرَ بِهِ عُثْمَانُ ؓ فَجَلَدَ مِئَةً

✧ 'Uthman said: 'Woe to you! Where are the witnesses? Has he consummated the marriage?' They said: 'He married a woman but has not yet consummated with her.' 'Ali said to 'Uthman ؓ: 'If he had consummated with her, stoning would be lawful upon him. But since he has not consummated with his wife, flog him with the hadd punishment.' Abu Ayyub said: 'I bear witness that I heard the Messenger of Allah ﷺ say what Abu al-Hasan mentioned.' So 'Uthman ؓ ordered it, and he was flogged with one hundred lashes.
