حَدَّثَنَا دَرَّانُ بْنُ سُفْيَانَ الْقَطَّانُ الْبَصْرِيُّ ثنا عَمْرُو بْنُ مَرْزُوقٍ ثنا شُعْبَةُ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ قَالَ
كَانَ عِنْدَ رَجُلٍ مِنْ هُذَيْلٍ امْرَأَتَانِ فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِفِهْرٍ أَوْ بِعَمُودِ فُسْطَاطٍ فَأَسْقَطَتْ فَرَفَعَ ذَلِكَ إِلَى النَّبِيِّ ﷺ فَقَضَى فِيهِ النَّبِيُّ ﷺ بِغُرَّةٍ فَقَالَ أَوْلِيَاؤُهَا كَيْفَ نَدِي مَنْ لَا صَاحَ وَلَا اسْتَهَلَّ وَلَا شَرِبَ وَلَا أَكَلَ فَمِثْلُ ذَلِكَ يُطَلُّ؟ فَقَالَ النَّبِيُّ ﷺ «أَسَجْعٌ كَسَجْعِ الْأَعْرَابِ؟» وَقَضَى بِعَقْلِهِ عَلَى أَوْلِيَاءِ الْمَرْأَةِ

✧ A man of Hudhayl had two wives. One of them threw at the other a stone or a tent pole and caused her to miscarry. That was brought to the Prophet ﷺ, and the Prophet ﷺ judged in it a ghurra. Her guardians said, 'How should we pay blood money for one who neither cried out nor wailed nor drank nor ate? Should such a one be requited?' The Prophet ﷺ said, 'Is it rhymed prose like the rhymed prose of the Bedouins?' And he judged its blood money upon the woman's guardians.
