حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ عَنْ عَبْدِ الرَّزَّاقِ عَنِ ابْنِ جُرَيْجٍ قَالَ أَخْبَرَنِي عَامِرُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ نِسْطَاسَ عَنْ جُبَيْرٍ قَالَ
فَتَحَهَا النَّبِيُّ ﷺ وَكَانَتْ جَمْعًا لَهُ حَرْثُهَا وَنَخْلُهَا وَلَمْ يَكُنْ لِلنَّبِيِّ ﷺ وَأَصْحَابِهِ رَقِيقٌ فَصَالَحَ النَّبِيُّ ﷺ يَهُودَ عَلَى أَنَّهُمْ يَكْفُونَا الْعَمَلَ وَلَكُمْ شَطْرُ التَّمْرِ عَلَى أَنِّي أُقِرُّكُمْ مَا بَدَا لِلَّهِ وَلِرَسُولِهِ فَذَلِكَ حِينَ بَعَثَ النَّبِيُّ ﷺ ابْنَ رَوَاحَةَ يَخْرِصُ عَلَيْهِمْ فَلَمَّا خَيَّرَهُمْ أَخَذَتْ يَهُودُ التَّمْرَ فَلَمْ يَزَلْ خَيْبَرُ بِيَدِ الْيَهُودِ عَلَى صُلْحِ النَّبِيِّ ﷺ حَتَّى كَانَ عُمَرُ فَأَخْرَجَهُمْ فَقَالَتْ يَهُودُ أَلَمْ يُصَالِحْنَا النَّبِيُّ ﷺ عَلَيْهِ عَلَى كَذَا وَكَذَا؟ قَالَ بَلَى عَلَى أَنَّهُ يُقِرُّكُمْ مَا بَدَا لِلَّهِ وَرَسُولِهِ فَهَذَا حِينَ بَدَا لِي أَنْ أُخْرِجَكُمْ فَأَخْرَجَهُمْ ثُمَّ قَسَّمَهَا بَيْنَ الْمُسْلِمِينَ الَّذِي افْتَتَحُوهَا مَعَ النَّبِيِّ ﷺ وَلَمْ يُعْطِ مِنْهَا أَحَدًا لَمْ يَحْضُرِ افْتِتَاحَهَا قَالَ فَأهْلُهَا الْآنَ الْمُسْلِمُونَ لَيْسَ فِيهَا يَهُودُ وَإِنَّمَا كَانَ أَمَرَ رَسُولُ اللهِ ﷺ بِالْخَرْصِ لِكَيْ يُحْصِيَ الزَّكَاةَ قَبْلَ أَنْ تُؤْكَلَ الثِّمَارُ وَتَفَرَّقَ فَكَانُوا عَلَى ذَلِكَ

✧ The Prophet ﷺ conquered it, and it was a collection (of land) belonging to him—its cultivated fields and its palm trees. The Prophet ﷺ and his Companions had no slaves, so the Prophet ﷺ made a settlement with the Jews on condition that they do the work for us, and you have half of the dates, on condition that I will let you remain as long as Allah and His Messenger see fit. That was when the Prophet ﷺ sent Ibn Rawahah to assess the crop for them. When he gave them the choice, the Jews took the dates, and Khaybar remained in the hands of the Jews under the Prophet ﷺ's settlement until ʿUmar came and expelled them. The Jews said, "Did the Prophet ﷺ not make a settlement with us on such and such?" He replied, "Yes, on condition that he would let you remain as long as Allah and His Messenger saw fit. Now it has become my view to expel you." So he expelled them, then divided it among the Muslims who had conquered it with the Prophet ﷺ, and he did not give any of it to anyone who had not been present at its conquest. He said: So its people now are the Muslims; there are no Jews in it. The Messenger of Allah ﷺ only ordered the estimation so that he might calculate the zakah before the fruits were eaten and dispersed. They continued on that basis.
