حَدَّثَنَا أَحْمَدُ بْنُ يَحْيَى الْحُلْوَانِيُّ ثنا سَعِيدُ بْنُ سُلَيْمَانَ عَنْ مَنْصُورِ بْنِ أَبِي الْأَسْوَدِ عَنْ أَبِي يَعْقُوبَ عَنِ ابْنِ أَبِي نَجِيحٍ عَنْ عَطَاءٍ عَنِ ابْنِ عَبَّاسٍ قَالَ
قَالَ رَسُولُ اللهِ ﷺ «أَيُّمَا امْرَأَةٍ تَزَوَّجَتْ بِغَيْرِ وَلِيٍّ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَإِنْ دَخَلَ بِهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَإِنِ اشْتَجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ»

✧ The Messenger of God ﷺ said: “Any woman who marries without a guardian, her marriage is invalid; her marriage is invalid. If he has consummated the marriage with her, she is entitled to the dower for what he made lawful of her private part. If they dispute, the ruler is the guardian of the one who has no guardian.”
