حَدَّثَنَا يَحْيَى بْنُ أَيُّوبَ الْعَلَّافُ وَعَمْرُو بْنُ أَبِي الطَّاهِرِ بْنِ السَّرْحِ الْمِصْرِيَّانِ قَالَا ثنا سَعِيدُ بْنُ أَبِي مَرْيَمَ ثنا نَافِعُ بْنُ عُمَرَ حَدَّثَنِي ابْنُ أَبِي مُلَيْكَةَ قَالَ كَتبْتُ إِلَى ابْنِ عَبَّاسٍ أَسْأَلُهُ
عَنِ امْرَأَتَيْنِ كَانَتَا تَخْرِزَانِ فَخَرَجَتْ إِحْدَاهُمَا فَادَّعَتْ أَنَّ صَاحِبَتَهَا ضَرَبَتْهَا بِالْاشفا وَأَنْكَرَتِ الْأُخْرَى فَكَتَبَ إِلَيَّ ابْنُ عَبَّاسٍ أَنَّ رَسُولَ اللهِ ﷺ قَضَى «أَنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ وَلَوْ أَنَّ النَّاسَ أُعْطُوا دَعْوَاهُمْ لَادَّعَى أُنَاسٌ مِنَ النَّاسِ أَمْوَالَ أُنَاسٍ وَدِمَاءَهُمْ وَلَكِنِ ادْعُهَا» فاتْلُ عَلَيْهَا {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا أُولَئِكَ لَا خَلَاقَ لَهُمْ فِي الْآخِرَةِ} قَالَ فَفَعَلْتُ فَاعْتَرَفَتْ فَبَلَغَهُ ذَلِكَ فَسُرَّ بِهِ

✧ From two women who were stitching leather. One of them went out and claimed that her companion had struck her with an awl, while the other denied it. Ibn ʿAbbās wrote to me that the Messenger of Allah ﷺ ruled: "The oath is upon the defendant. If people were given what they claimed, men would claim the wealth of other men and their blood. But call her" – so recite to her: {Indeed, those who purchase a small gain with the covenant of Allah and their oaths – those will have no share in the Hereafter}. He said: So I did that, and she confessed. That reached him, and he was pleased with it.
