وَبِهِ: حَدَّثَنِي اللَّيْثُ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللهِ بْنِ عُمَرَ، عَنْ رَسُولِ اللهِ ﷺ قَالَ:

إِذَا تَبَايَعَ الرَّجُلَانِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ، مَا لَمْ يَتَفَرَّقَا وَكَانَا جَمِيعًا، أَوْ يُخَيِّرْ أَحَدُهُمَا الْآخَرَ، فَإِنْ خَيَّرَ أَحَدُهُمَا الْآخَرَ فَتَبَايَعَا عَلَى ذَلِكَ وَجَبَ الْبَيْعُ، وَإِنْ تَفَرَّقَا بَعْدَ أَنْ يَتَبَايَعَا، وَإِنْ لَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا الْبَيْعَ فَقَدْ وَجَبَ الْبَيْعُ

Translation

✧ When two men conduct a transaction, each of them retains the option as long as they have not separated and are still together, or one of them gives the other the choice. If one of them gives the other the choice and they transact on that basis, the sale becomes binding. If they separate after transacting, even if neither of them has abandoned the sale, the sale becomes binding.
