حَدَّثَنَا مُحَمَّدُ بْنُ عَلِيٍّ، ثَنَا خَالِدٌ، نَا أَبُو الْغُصْنِ، أَنَّهُ سَمِعَ عُرْوَةَ بْنَ الزُّبَيْرِ يُحَدِّثُ، عَنْ عَائِشَةَ، أَنَّ رَسُولَ اللهِ ﷺ قَالَ:

أَيُّمَا امْرَأَةٍ تَزَوَّجَتْ بِغَيْرِ إِذْنِ وَلِيِّهَا فَنِكَاحُهَا بَاطِلٌ، فَإِنْ كَانَ دَخَلَ بِهَا فَلَهَا صَدَاقُهَا بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا، فَإِنِ اشْتَجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ

Translation

✧ Any woman who marries without the permission of her guardian, her marriage is void. If he has consummated the marriage, then she is entitled to her dowry because of what he has made lawful of her private part. If they dispute, then the ruler is the guardian of the one who has no guardian.
